Based upon the information in your most recent email as well as Planning Commission Resolution 4686, it
would appear that the Commission will have found the vacation to be consistent with the General Plan as
long as it occurs prior to, or concurrent with, the recordation of the Final Map.

The map for Spyglass has not recorded. It is in the final stages of the process to be sent to CC for
approval. Hopefully in the next couple of months. Frank is out of the country until August I believe.

Frank,
I've had the chance to review the Planning Commission materials that Van sent me related to Spyglass in
relation to whether the vacation will need to go to the Planning Commission for a General Plan
consistency finding.
Question- has the final map recorded? If not, we should be OK and it will not need to go to the Planning
Commission. If it recorded, things might be a bit more difficult and the process lengthier. Please advise.

Please make the following corrections to the Engineering Conditions:
1. Drop Condition No, 47.A.
2. Add the following condition after Condition No. 47:
The traffic signal at the intersection of Carlsbad Village Drive and
Avenida de Anita/Appian Road is a Circulation System Traffic Signal.
The City will enter into an agreement with the developer prior to
recordation of the final map, so that the developer can obtain
proportionate share reimbursement for the traffic signal from the
City.

The developer is required to install a 8-inch diameter water pipeline in all streets to provide potable water
service to each residence and for irrigation.
The developer is required to terminate each water pipeline with a fire hydrant. The water pipelines shall
not be connected to the existing lower pressure water pipeline in Carlsbad Village Drive.

The followings conditions shall apply to the subject project:
1. The water and sewer pipelines shown on the Sheet 2 exhibit map are
acceptable.
2. The water pipeline at the intersection with "proposed" Apian Way and
Carlsbad Village Drive shall be extended easterly in Carlsbad Village Drive to
existing Apian Road, and connected to the existing water pipeline at that
location. The proposed water pipeline shall not be connected to the existing
water pipeline at the intersection of the "proposed" Apian Way and Carlsbad
Village Drive.
3. A 30' wide sewer easement dedicated to the City of Carlsbad is required for
the sewer pipeline planned to extend from the "proposed" Apian Road west to
El Camino Real.
4. The irrigation system for the landscaping in open space lots "A" and "B" shall
be designed to use recycled water in conformance with CMWD standards
and requirements.

The District is responding to the Review and Comment Memo dated June 28. 1999.
We are unable to further clarify issues identified in our Comment Memo dated April 6,
1999 because the Developer has not provided any additional information in response to
our concerns. All comments made in the April Memo still apply. The following is a brief
summary of significant issues which should be resolved prior to conditioning:
4. All District pipelines, pump stations, pressure reducing stations and
appurtenances required for this project by the District shall be within public right-
of-way or within minimum 20' wide easements granted to the District or the City
of Carlsbad. A wider easement may be required for the sewer running down the
hillside into El Camino Real.
5. Sequentially, the Developer's Engineer shall do the following:
A. Meet with the City Fire Marshal and establish the fire protection
requirements.

B. Prepare and submit a colored recycled water use area map and submit
this map to the Planning Department for processing and approval by the
District.
C. Prior to the preparation of sewer, water and recycled water improvement
plans, the Developer shall submit preliminary system layouts to the District
for review, comment and approval.
5. All potable water and recycled water meters shall be placed within public right of
way. The Developer will be responsible for showing the locations of such meters
in relationship to the driveways and the edge of right of way. All sewer cleanouts
shall be placed at property line in a location approved by the District.
6. No more than 19 homes shall be served on a single potable water distribution
pipeline. The connections for the looped pipeline system will include a
connection in Appian Way and in Carlsbad Village Drive. The Developer
will be responsible for construction of sufficient potable water pipeline in
Carlsbad Village Drive to connect to the existing 446 HGL Zone near the
intersection of El Camino Real.
7. The Developer will be responsible for connecting to the existing sewer
system in Carlsbad Village Drive.

CT 99-08: SPYGLASS II- CONDITIONS
The Engineering Department has completed its review of the subject project. The
Engineering Department is recommending that the project be approved subject to the
following conditions:
General
42. NOTE: Unless specifically stated in the condition, all of the
following engineering conditions upon the approval of
this proposed major subdivision must be met prior to
approval of a final map.
38. Prior to issuance of any building permit, the developer shall comply with the
requirements of the City's anti-graffiti program for wall treatments if and when
such a program is formerly established by the City.
39. There shall be one final subdivision map recorded for this project.
43. The developer shall provide an acceptable means for maintaining the private
easements within the subdivision and all the private: streets, sidewalks, street
lights, storm drain facilities and sewer facilities located therein and to distribute
the costs of such maintenance in an equitable manner among the owners of the
properties within the subdivision. Adequate provision for such maintenance shall
be included with the CC&Rs subject to the approval of the City Engineer.
44. All concrete terrace drains shall be maintained by the homeowner's association
(if on commonly owned property) or the individual property owner (if on an
individually owned lot). An appropriately worded statement clearly identifying the
responsibility shall be placed in the CC&Rs (if maintained by the Association)
and on the Final Map.
45. The developer shall defend, indemnify and hold harmless the City and its agents,
officers, and employees from any claim, action or proceeding against the City or
its agents, officers, or employees to attack, set aside, void or null an approval of
the City, the Planning Commission or City Engineer which has been brought
against the City within the time period provided for by Section 66499.37 of the
Subdivision Map Act.
46. Prior to hauling dirt or construction materials to or from any proposed
construction site within this project, the developer shall submit to and receive
approval from the City Engineer for the proposed haul route. The developer
shall comply with all conditions and requirements the City Engineer may impose
with regards to the hauling operation.
48. The developer shall provide for sight distance corridors at all street intersections
in accordance with Engineering Standards and shall record the following
statement on the Final Map (and in the CC&R's).
"No structure, fence, wall, tree, shrub, sign, or other object over 30 inches
above the street level may be placed or permitted to encroach within the
area identified as a sight distance corridor in accordance with City
Standard Public Street-Design Criteria, Section 8.B.3. The underlying
property owner shall maintain this condition."
Fees/Agreements
50. The developer shall pay all current fees and deposits required.
51. The owner of the subject property shall execute an agreement holding the City
harmless regarding drainage across the adjacent property.
55. The owner shall execute a hold harmless agreement for geologic failure.
56. Prior to approval of any grading or building permits for this project, the owner
shall give written consent to the annexation of the area shown within the
boundaries of the subdivision plan into the existing City of Carlsbad Street
Lighting and Landscaping District No. 1 on a form provided by the City.
Grading
58. Based upon a review of the proposed grading and the grading quantities shown
on the tentative map, a grading permit for this project is required. The developer
must submit and receive approval for grading plans in accordance with city
codes and standards prior to issuance of a building permit for the project.
59. Prior to the issuance of a grading permit or building permit, whichever occurs
first, the developer shall submit proof that a Notice of Intention has been
submitted to the State Water Resources Control Board.
60. Upon completion of grading, the developer shall ensure that an "as-graded"
geologic plan is submitted to the City Engineer. The plan shall clearly show all
the geology as exposed by the grading operation, all geologic corrective
measures as actually constructed and must be based on a contour map which
represents both the pre and post site grading. This plan shall be signed by both
the soils engineer and the engineering geologist. The plan shall be prepared on
a 24" x 36" mylar or similar drafting film and shall become a permanent record.
61. No grading for private improvements shall occur outside the limits of the
subdivision unless a grading or slope easement or agreement is obtained from
the owners of the affected properties and recorded. If the developer is unable to
obtain the grading or slope easement, or agreement, no grading permit will be
issued. In that case the developer must either amend the tentative map or
modify the plans so grading will not occur outside the project site in a manner
which substantially conforms to the approved tentative map as determined by the
City Engineer and Planning Director.

63. Additional drainage easements may be required. Drainage structures shall be
provided or installed prior to or concurrent with any grading or building permit as
may be required by the City Engineer.
64. The owner shall make an offer of dedication to the City for all public streets and
easements required by these conditions or shown on the tentative map. The
offer shall be made by a certificate on the final map for this project. All land so
offered shall be granted to the City free and clear of all liens and encumbrances
and without cost to the City. Streets that are already public are not required to
be rededicated.
66. Prior to issuance of building permits, the developer shall underground all existing
overhead utilities along the subdivision boundary.
67. Direct access rights for all lots abutting El Camino Real and Carlsbad Village
Drive, and lot 6 to Appian Road shall be waived on the final map.
69. The drainage system shall be designed to ensure that runoff resulting from 10-
year frequency storms of 6 hours and 24 hours duration under developed
conditions, are equal to or less than the runoff from a storm of the same
frequency and duration under existing developed conditions. Both 6 hour and 24
hour storm durations shall be analyzed to determine the detention basin
capacities necessary to accomplish the desired results.
70. The developer shall comply with the City's requirements of the National Pollutant
Discharge Elimination System (NPDES) permit. The developer shall provide
best management practices as referenced in the "California Storm Water Best
Management Practices Handbook" to reduce surface pollutants to an acceptable
level prior to discharge to sensitive areas. Plans for such improvements shall be
approved by the City Engineer. Said plans shall include but not be limited to
notifying prospective owners and tenants of the following:
A. All owners and tenants shall coordinate efforts to establish or work
with established disposal programs to remove and properly dispose
of toxic and hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline,
motor oil, antifreeze, solvents, paints, paint thinners, wood
preservatives, and other such fluids shall not be discharged into
any street, public or private, or into storm drain or storm water
conveyance systems. Use and disposal of pesticides, fungicides,
herbicides, insecticides, fertilizers and other such chemical
treatments shall meet Federal, State, County and City
requirements as prescribed in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce
surface pollutants when planning any changes to the landscaping
and surface improvements.
71. Plans, specifications, and supporting documents for all public improvements
shall be prepared to the satisfaction of the City Engineer. In accordance with
City Standards, the developer shall install, or agree to install and secure with
appropriate security as provided by law, improvements shown on the tentative
map and the following improvements:
A. El Camino Real to prime arterial standards.
B. Carlsbad Village Drive to secondary arterial, including a 150-foot long right
turn lane into Appian Road plus adequate transition.
C. A traffic signal at the intersection of Carlsbad Village Drive and Avenida de
Anita/Appian Road.
A list of the above improvements shall be placed on an additional map sheet on
the final map per the provisions of Sections 66434.2 of the Subdivision Map Act.
Improvements listed above shall be constructed within 18 months of approval of
the secured improvement agreement or such other time as provided in said
agreement.
72. The developer shall install street lights along all public and private street
frontages in conformance with City of Carlsbad Standards.
73. The developer shall install sidewalks along all public streets abutting the project
in conformance with City of Carlsbad Standards prior to occupancy of any
buildings.
74. Prior to occupancy of any buildings, the developer shall install wheelchair ramps
at the public street corners abutting the Subdivision in conformance with City of
Carlsbad Standards.
75. The structural section for the access aisles must be designed with a traffic index
of 5.0 in accordance with City Standards due to truck access through the parking
area and/or aisles with an ADT greater than 500. The structural pavement design
of the aisle ways shall be submitted together with required R-value soil test
information and approved by the City as part of the building site plan review.
76. The design of all private streets and drainage systems shall be approved by the
City Engineer. The structural section of all private streets shall conform to City of
Carlsbad Standards based on R-value tests. All private streets and drainage
systems shall be inspected by the City. The standard improvement plan check
and inspection fees shall be paid prior to approval of the final for this project.
Final Map Notes

78.A. All improvements are private and are to be privately maintained
with the exception of the following:
1. Appian Road.
2. Street "A"
78.B. Geotechnical Caution:
The owner of this property on behalf of itself and all of its
successors in interest has agreed to hold harmless and
indemnify the City of Carlsbad from any action that may arise
through any geological failure, ground water seepage or land
subsidence and subsequent damage that may occur on, or
adjacent to, this subdivision due to its construction, operation
or maintenance.e

COMPLETENESS REVIEW AND ISSUES STATEMENT
CT 99- 08,: SPYGLASS
The Engineering Department has completed another review of the above referenced project for
application completeness and has determined that the application and plans submitted for this
project are complete and suitable for continued review.
Additionally, staff has completed a review of the project for Engineering issues. Engineering
issues which need to be resolved or adequately addressed prior to scheduling of this project for a
hearing are as follows:
1. Title ownership seems to have an error % ownership (Preliminary Title Report) should add up
to 100%.
2. The easements and dedications should be shown and called out on the title page of the
Tentative Map.
3. The relinquishment rights along El Camino Real should be shown (item #4 of title report).
4. The correct cross sections for Carlsbad Village Drive should be shown, (median and
deceleration lane)
5. The legend should include 5% min. slope gradient for terrace ditch as identified in the soils
report.
6. The drainage condition at Carlsbad Village Drive and Appian Road should be reviewed. It
appears that an inlet will be required up stream of the intersection. The drainage system
should also include the outlet from open space lot "B" & lot 3.
7. Sight Distance cutoffs are required at Talus Ct. and Appian Road and at the inside Knuckle of
Appian Road. Pull slopes and other obstructions (fences, landscaping, driveways,) back to
clear this important design issue.
8. Driveways need to maintain a minimum of 3' from property line to top of "X" (flair).
9. Show the required traffic signal at Carlsbad Village Drive and Appian Road.

10. The undergrounding of power poles is unclear. If any are to be undergrounded show them.
Show the last pole to remain standing and "sweep underground" along the frontage of this
project.
Attached are redlined check prints of the project for the applicant's use. The applicant must
return these check prints with the revised plans to assist staff in our approval of the
project. We have prepared conditions of approval anticipating the corrections to be made and the
comments mentioned above to be completed.

The District is responding to the Land Use Review dated March 18. 1999. Based on
our review of the project, we have the following comments regarding potable water,
recycled water and sewer systems:
1. The Developer shall be responsible for all fees, deposits and charges which will
be collected before and/or at the time of issuance of the building permit. The
San Diego County Water Authority capacity charge will be collected at issuance
of application for any meter installation.
2. The Developer shall provide detailed information to the District Engineer
regarding water demand, irrigation demand, fire flow demand in gallons per
minute, and projected sewer flow in million gallons per day.
3. The entire potable water system, recycled water system and sewer system shall
be evaluated in detail by Developer and District Engineer to insure that adequate
capacity, pressure and flow demands can be met.
4. All District pipelines, pump stations, pressure reducing stations and
appurtenances required for this project by the District shall be within public right-
of-way or within easements granted to the District or the City of Carlsbad

5. Sequentially, the Developer's Engineer shall do the following:
A. Meet with the City Fire Marshal and establish the fire protection
requirements.
B. Prepare and submit a colored recycled water use area map and submit
this map to the Planning Department for processing and approval by the
District Engineer.
C. Prior to the preparation of sewer, water and recycled water improvement
plans, the Developer shall submit preliminary system layouts to the District
Engineer for review, comment and approval.
6. The following note shall be placed on the final map. "This project is approved
upon the expressed condition that building permits will not be issued for
development of the subject property unless the District serving the development
has adequate water and sewer capacity available at the time development is to
occur, and that such water and sewer capacity will continue to be available until
time of occupancy."
7. All potable water and recycled water meters shall be placed within public right of
way. The Developer will be responsible for showing the locations of such meters
in relationship to the driveways and the edge of right of way.
8. No more than 19 homes shall be served on a single potable water distribution
pipeline. The connections for the looped pipeline system will include a
connection in Appian Way and in Carlsbad Village Drive. The Developer
will be responsible for construction of sufficient potable water pipeline in
Carlsbad Village Drive to connect to the existing 446 HGL Zone near the
intersection of El Camino Real.
9. The Developer will be responsible for connecting to the existing sewer system in
Carlsbad Village Drive.

The Engineering Department has performed a preliminary review of this project and offers the
following comments:
1 . On future plans, show sight distance lines for vehicles on Appian Road to Carlsbad
Village Drive. The required sight distance is 440', measured 15' behind the extension of
the curb face.
2. It appears the intersection of Appian Road with Carlsbad Village Drive is slightly
skewed. City standards require streets to intersect at right angles with at least 50' of
tangent on Appian Road, measured from the extension of the curb face.
3. A dedicated right-turn lane is required for vehicles traveling east on Carlsbad Village
Drive and turning south to Appian Road.
4. With regard to the slopes along El Camino Real and Carlsbad Village Drive, a flat
setback area is required between the subdivision boundary (right-of-way line) and the
toe of slope. Please see City standard drawing GS-14 for more details.
5. A traffic signal is to be installed at the intersection of Appian Road and Carlsbad Village
Drive. The project may be required to install this improvement, with a portion of the
costs to be reimbursed by the City.

I agree that something must be done to secure the signoff! We are going on
our 4th year and must finalize the mitigation. Mitch and I have spoken about
discing and reseeding and this has been authorized as per the
recommendation. His recommendation was not to irrigate, however, I am all
for anything that will work. Please let me know your thoughts. Thanks.
