MEMORANDUM

SUBJECT: REVISIONS TO CONDITIONS FOR
CT 99-13, SDP 99-10, HDP 99-12, LCPA 99-05.ZC 99-06
STEINER PROPERTY
This memorandum serves to summarize our revisions to the engineering conditions for the
above application(s). We have described the changes below, in which the changes are
reflected in bold.
Please revise the staff report to include the following under section D (Subdivision Ordinance)
after the first paragraph:
"There are two boundary adjustments proposed as part of this project. These
adjustments occur between the tract boundary and adjacent parcels of land to the east
and west. The western tract boundary includes a proposed boundary adjustment
between lots 67 and 68 of Map no. 13839. The easterly remnant parcel of land, which
included within the project boundary, also requires a boundary adjustment to reconfigure
the northerly right-of-way line of Poinsettia as shown on the tentative map. Conditions
of this project include approval of these boundary adjustments prior to or concurrent with
Final Map approval."
Under PC resolution 4702, page 2, Finding's section, item no. 4, revise the finding to be as
follows:
4. That the design of the subdivision or type of improvements will not conflict with
easements of record or easements established by court judgment, or acquired by the
public at large, for access through or use of property within the proposed subdivision, in
that prior to, or concurrent with, recordation of the final map, the developer will vacate
and adjust any easements that conflict with the development.
Under PC resolution 4702, page 8, Open Space and Trails section, item no. 22, revise the
condition to be as follows:
22. The developer shall dedicate to the City on the final map, an open space easement for
those portions of lots 4 through 9 which are in open space slopes to prohibit any
encroachment or development, including, but not limited to fences, walls, decks, storage
buildings, pools, spas, stairways, and landscaping, as shown on Exhibits "A"-"Y", dated

Under PC resolution 4702, page 9, Fees and Agreements section, delete item no. 33.
Under PC resolution 4702, page 9, Fees and Agreements section, item no. 34, revise the
condition to be as follows:
34. Prior to, or concurrent with the approval of the final map, or prior to issuance of
building permits, whichever comes first, the developer shall submit for and
receive approval for a boundary adjustment between the existing lots along the
westerly project boundary (known as Lots 67 and 68 of Map no. 13839), and the
proposed Lots 1 and 9 of this development. Said boundary adjustment shall
conform to the configuration as depicted on the tentative map and shall define the
westerly subdivision boundary of the project. The developer shall comply with all
requirements or conditions which may arise from the proposed boundary
adjustment.
Under PC resolution 4702, page 10, Fees and Agreements section, item no. 35, revise the
condition to be as follows:
35. Prior to, or concurrent with the approval of the final map, or prior to issuance of
building permits, whichever comes first, the developer shall submit for and
receive approval for a boundary adjustment for the remnant parcel of land, as
denoted on the tentative map. Said remnant parcel shall be incorporated to Lot 8
of Map no. 13889. Said boundary adjustment shall conform to the configuration
as depicted on the tentative map and shall define the easterly subdivision
boundary. This boundary adjustment shall coincide with the northerly right-of-
way line of Poinsettia Lane. The developer shall comply with all requirements or
conditions which may arise from the proposed boundary adjustment.
Under PC resolution 4702, page 10, Dedications/Improvements section, revise condition no. 41
not to include underlines under "Poinsettia Lane".
Under PC resolution 4702, page 11, Dedications/Improvements section, replace condition no.
43 as follows:
43. Plans, specifications, and supporting documents for all public improvements shall be
prepared to the satisfaction of the City Engineer. In accordance with City Standards, the
developer shall install, or agree to install and secure with appropriate security as
provided by law, improvements shown on the tentative map and the following
improvements:
On-site Improvements
a) Full-width improvements of Skimmer Court pursuant to City Standards. The
improvements shall include the removal of temporary turn-around, barricade,
etc. at the existing easterly terminus of Skimmer Court and any transitions to
the existing easterly terminus of Skimmer Court (pavement, curb, gutter,
sidewalk, etc.).

b) Full-width improvements of Poinsettia Lane within the subdivision boundary
pursuant to City Standards.
c) Water and sewer service to the off-site Saska Parcel (APN 215-050-57)
d) Continuous access from Poinsettia Lane to the Saska Parcel (APN 215-050-57)
as required by the City Engineer.
Off-site Improvements
a) Full-width improvements of Oriole Court and Skimmer Court from Poinsettia
Lane to the subdivision boundary pursuant to City Standards.
b) Improvements of Poinsettia Lane to include two 18-foot wide lanes (the center
portion of a 102' major arterial) east of Oriole Court to southerly subdivision
boundary line. The off-site improvement of Poinsettia Lane shall include full
width grading, transitions, AC berms, drainage facilities, median curbs, etc. as
identified in the Aviara Parkway-Poinsettia Lane Bridge and Thoroughfare
District. A reimbursement agreement between the developer and the City may
be entered into for the work identified in the Aviara Parkway - Poinsettia Lane
Bridge and Thoroughfare District. The reimbursement agreement shall be
approved prior to design and construction of this arterial.
c) Full-width improvements of Poinsettia Lane between El Camino Real to the
easterly subdivision boundary line pursuant to City Standards.
A list of the above improvements shall be placed on an additional map sheet on the final
map per the provisions of Sections 66434.2 of the Subdivision Map Act. Improvements
listed above shall be constructed within 18 months of approval of the secured
improvement agreement or such other time as provided in said agreement.
