Van Peski" <gvp@home.com> To: "Lynch, Van" <vlync@ci.carlsbad.ca.us> Date: 4/14/00 3:42PM Subject: Carlsbad Airport Centre Lot 10 Van- I have ordered a copy of the SDG&E easement document that should be faxed to me today. I have also requested a copy of a sample right-of-way use agreement from John Hernandez at SDG&E. I spoke with John today, and he mentioned a couple of things pertaining to the project: 1. Hernandez said that the right-of-way use agreement is revocable. This is why SDG&E does not normally allow parking other than overflow parking within their easement. Hernandez mentioned the Cornerstone project, and said they only had "extra" parking, and non-essential items like tennis court located in the easement. Hernandez is faxing me a copy of the agreement on Monday so we can review it (though I guess there is probably a copy in the Cornerstone file at the City). 2. Hernandez said that they have determined future locations of poles for the two future lines to be added within the easement. He has provided this information to Smith Architects, but they have not had a chance to put it on the plans yet. This seems like something that we might want to see, to verify that the project still meets parking requirements and circulation patterns when future lines are added. 3. Hernandez said that in the event SDG&E decides to put in another line, they will bring large equipment and may be blocking large portions of the parking lot for months. After they are done and leave, any damage to the parking lot would be the responsibility of the owners to repair or replace, not SDG&E. I will get a copy of the easement and the use agreement to you for your review. --Glen CC: "Plummer, Bill" <bplum@ci.carlsbad.ca.us>, <msmit@ci.carlsbad.ca.us>, <mogaw@ci.carlsbad.ca.us>
