Bill-
I have been talking with Jorge Pallacio, the applicant's engineer for Lot 10 re. the proposed sewer and
water system. As it stands right now, Van Lynch asked for conditions, and Mikhail gave him conditions
including that the systems be public. Jorge feels that he got approval from Kelly Effimof and Mike Smith to
do a private system. If everyone agrees that the City wants to allow what they have proposed, that's okay
with me, but I want to make sure we consider everything before we do. From what I can tell, Jorge's
conversations with Mike and Kelly were general in nature, and he never presented a specific layout for
review. There is nothing in writing indicating any kind of approval.
The City has a standard that water systems be public, and looped. There are good reasons for these
policies. SDG&E has a policy (apparently) that it does not allow parallel utility lines within it's easements.
I have pointed out to Carl King at Smith Architects that we have not been provided with any written
documentation from the applicant regarding SDG&E, like copies of their regulations prohibiting parallel
utilities, memos that the waterline could not be put anywhere within their easement, meeting notes spelling
out who was contacted, etc. On the face of it, we have conflicting policies or regulations. I am obliged to
point out that it is the project design that is creating a conflict in the policies - there is no inherent conflict.
Mike Smith has pointed out in his conversations with John Hernandez that with most policies, there are
points where exceptions are granted. The applicant should be finding out what the SDG&E reasons for
their policy is, talking to people further up the chain of authority, etc. From the City's side, we need to be
looking at our reasons for our policies, and considering what if any accomodations we are willing to make.
I have told Carl King at Smith Architects that before he called for a meeting, he should put together
information demonstrating the efforts that had been expended in dealing with SDG&E, who they had
talked to, etc. I have not received any information to date. Jorge Pallacio also requested a meeting, but I
wanted to talk with you first, and show you the plan that JP Engineering had come up with. I will look you
up on Monday.
