year extension of CUP 00-22 to allow the continued operation of a drive-thru prescription drug
window at 7760 Rancho Santa Fe Road in Local Facilities Management Zone 11 and more

I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5929
APPROVING a five year extension of CUP 00-22 based upon the findings and subject to the
conditions contained therein.
II. INTRODUCTION
This proposed five year extension of CUP 00-22 will allow the continued operation of the drive-
thru prescription drug window at the Sav-On Drug Store located at 7760 Rancho Santa Fe Road
from August 2, 2005 through August 1, 2010. The drive-thru prescription drug window has
operated in conformance with the required conditions of approval for the past 5 years.
III. PROJECT DESCRIPTION AND BACKGROUND
The site is generally located on the southeast comer of Rancho Santa Fe Road and La Costa
Avenue. On August 2, 2000 the Planning Commission approved CUP 00-22 to allow a drive-
thru prescription drug window at the Sav-On Drug Store in the Rancho La Costa Village
neighborhood shopping center. Condition No. 2 of the approving CUP Resolution No. 4811
specifies that CUP 00-22 is granted for a period of 5 years but may be extended upon written
application of the permittee (Cynthia Bell and Associates, Inc.). The applicant, Cynthia Bell and
Associates, Inc., is requesting a 5-year extension of CUP 00-22, effective August 2, 2005
through August 1, 2010.
The applicant applied for the CUP extension on May 2, 2005 prior to its expiration date and
within the required time frame.

IV. ANALYSIS
A. The drive-thru prescription drug window continues to be consistent with all applicable
plans, policies and regulations described below:
1. Carlsbad General Plan
2. Local Facilities Management Plan 11
3. La Costa Master Plan/Qualified Overlay Zone
4. Title 21 of the Carlsbad Municipal Code including:
1. Chapter 21.42 (Conditional Use Permits)
B. The adopted project findings for CUP 00-22, which are contained in Plarming
Commission Resolution No. 4811 still apply to this project (CUP 00-22x1).
C. The adopted project conditions for CUP 00-22, which are contained in Plaiming
Commission Resolufion No. 4811 sfill apply to this project (CUP 00-22x1) with the
exception of Condition No. 2 which is amended by Condition No. 4 in Planning
Commission Resolution No. 5929 to extend CUP 00-22 for 5 years from August 2, 2005
through August 1, 2010.
D. No formal written complaints regarding CUP 00-22 have been submitted to the City.
E. Armual reviews have been conducted for CUP 00-22 and the project is in compliance
with all conditions of approval.
F. The extended CUP should be exempted from environmental review per Section 15301 of
CEQA.
V. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project is exempt from the requirements of the
Califomia Envirormiental Quality Act (CEQA) per Secfion 15301, Existing Facilities, of the
State CEQA Guidelines and will not have any adverse significant impact on the environment.
