The City of Carlsbad has conducted an environmental review of the above described project
pursuant to the Guidelines for Implementation of the California Environmental Quality Act and
the Environmental Protection Ordinance of the City of Carlsbad. As a result of said review, the
initial study (EIA Part 2) identified potentially significant effects on the environment, but (1)
revisions in the project plans or proposals made by, or agreed to by, the applicant before the
proposed negative declaration and initial study are released for public review would avoid the
effects or mitigate the effects to a point where clearly no significant effect on the environment
would occur, and (2) there is no substantial evidence in light of the whole record before the City
that the project "as revised" may have a significant effect on the environment. Therefore, a
Mitigated Negative Declaration is hereby issued for the subject project. Justification for this
action is on file in the Planning Department.
A copy of the Mitigated Negative Declaration with supportive documents is on file in the

ENVIRONMENTAL IMPACTS
STATE CEQA GUIDELINES, Chapter 3, Article 5, Section 15063 requires that the City
conduct an Environmental Impact Assessment to determine if a project may have a significant
effect on the environment. The Environmental Impact Assessment appears in the following
pages in the form of a checklist. This checklist identifies any physical, biological and human
factors that might be impacted by the proposed project and provides the City with information to
use as the basis for deciding whether to prepare an Environmental Impact Report (EIR),
Negative Declaration, or to rely on a previously approved EIR or Negative Declaration.
A brief explanation is required for all answers except "No Impact" answers that are
adequately supported by an information source cited in the parentheses following each
question. A "No Impact" answer is adequately supported if the referenced information
sources show that the impact simply does not apply to projects like the one involved. A
"No Impact" answer should be explained when there is no source document to refer to, or
it is based on project-specific factors as well as general standards.
"Less Than Significant Impact" applies where there is supporting evidence that the
potential impact is not adversely significant, and the impact does not exceed adopted
general standards and policies.
"Potentially Significant Unless Mitigation Incorporated" applies where the incorporation
of mitigation measures has reduced an effect from "Potentially Significant Impact" to a
"Less Than Significant Impact." The developer must agree to the mitigation, and the
City must describe the mitigation measures, and briefly explain how they reduce the
effect to a less than significant level.
"Potentially Significant Impact" is appropriate if there is substantial evidence that an
effect is significant.
Based on an "EIA-Part 11", if a proposed project could have a potentially significant
effect on the environment, but &l potentially significant effects (a) have been analyzed
adequately in an earlier EIR or Mitigated Negative Declaration pursuant to applicable
standards and (b) have been avoided or mitigated pursuant to that earlier EIR or
Mitigated Negative Declaration, including revisions or mitigation measures that are
imposed upon the proposed project, and none of the circumstances requiring a
supplement to or supplemental EIR are present and all the mitigation measures required
by the prior environmental document have been incorporated into this project, then no
additional environmental document is required (Prior Compliance).
When "Potentially Significant Impact" is checked the project is not necessarily required
to prepare an EIR if the significant effect has been analyzed adequately in an earlier EIR
pursuant to applicable standards and the effect will be mitigated, or a "Statement of
Overriding Considerations" has been made pursuant to that earlier EIR.
A Negative Declaration may be prepared if the City perceives no substantial evidence
that the project or any of its aspects may cause a significant effect on the environment.

there are mitigation measures to clearly reduce impacts to less than significant, and those
mitigation measures are agreed to by the developer prior to public review. In this case, the

a Mitigated Negative Declaration may be prepared.
An EIR must be prepared if "Potentially Significant Impact" is checked, and including

ENVIRONMENTAL SETTING
The site is a triangular shaped lot located west of the intersection of Camino de 10s Coches and
Via Calendo and north of the Stagecoach Community Park. The site covers approximately 6.82
acres and is bounded on the west by a drainage channel designated as open space and on the east
by Camino de 10s Coches. The property is abutted by multi-family residential development to
the west, Stagecoach Park to the south, and single family development above Camino de 10s
Coches to the east. Although no approved grading permit has been issued by the City of
Carlsbad, the site has been previously disturbed by grading. Topographically, the site is terraced
with two relatively flat pads. An elevation differential of approximately 11 feet exists between
the southern and northern pads within the area to be developed. A descending slope to the level
portion exists adjacent to Camino de 10s Coches. The site descends toward the drainage channel
to the south and west of the level portion. Drainage is accomplished via sheetflow toward a
north-south drainage channel. Vegetation is comprised of disturbed habitat, except in the onsite
drainages, which support approximately .5 acre of Southern Willow Scrub and Freshwater March
vegetation.

DISCUSSION OF ENVIRONMENTAL EVALUATION
I. Land Use and Planning
The project includes a General Plan Amendment to adjust the open space designation to coincide
with the drainage area on the site. The General Plan Map, which shows generalized boundaries
of constrained lands and presently designated open space, identifies an approximate 200' wide
open space area along the drainage channel. The project's storm drainage study and biological
analysis delineates the drainage channel and associated wetland vegetation. The proposed open
space boundary includes a habitat buffer on each side of the channel 70 wide drainage easement.
Therefore, the actual open space exists within a drainage corridor that includes the creek and
adjacent wetland habitat. This adjustment to reflect the boundaries of the sensitive biological
resources as open space is consistent with the provisions of the General Plan Land Use and Open
Space Elements.
Chapter 21.42 of the Zoning Ordinance permits churches in residentially designated areas upon
approval of a conditional use permit (CUP). The CUP requires compatibility findings with the
surrounding neighborhood. The project is consistent with and not detrimental to surrounding
development in that the proposed site abuts another community facility, Stagecoach Community
Park, to the south, is separated from multi-family residences to the west by a drainage channel,
and is separated from single family residential development to the east by Camino de Los
Coches, a secondary arterial roadway and a significant grade separation. Additionally, direct
access to the site is provided from the north and south by circulation arterial roadways (Camino
de Los Coches and La Costa Avenue via Rancho Santa Fe Road) thereby avoiding the use of
local residential streets for access. The proposed 16,842 square foot church is single story with
a 60' high steeple which results in minimal (5.67%) building coverage. An 193 space parking lot
to serve the project is proposed to satisfy the projects parking demand and avoid on-street
parking, and with the exception of Sundays or dayslnights of assembly, the church would
generate approximately the same number of average daily trips (ADT) that a multi-family
residential development would generate. The proposed small scale, traditional architectural style
is consistent with surrounding residential development. Landscaping to screen the parking lot
and a required lighting plan to avoid light spillage onto adjacent sites will reduce visual impacts.
The 60' high steeple is an architectural protrusion typically associated with churches and
permitted by the zoning ordinance. The steeple height is consistent with the height of adjacent
single family development to the east due to the higher pad elevations of single family
residences.
11. GEOLOGY
According to the "Report of Geotechnical Investigation" prepared for the project by Southern
California Soil & Testing, Inc., "the main geotechnical conditions encountered that will affect
the development of the site are the presence of non-uniform, potentially compressible and
expansive fill and colluvial soils extending to significant depths beneath planned final grades.
l3gh groundwater levels, particularly along the drainage channel, also are a concern. The
undocumented fill soils that extend to depths of 5 to more than 15 feet below the ground surface
are highly variable in consistency and compressibility. Some of the colluvial soils underlying
the fill soils are also compressible and most of the colluvial and some of the fill soils are highly
expansive. These materials are not suitable in their existing condition for support of structures
and other settlement-sensitive improvements. The report concludes that removal and
replacement of the compressible soils with suitable materials will be needed if structures are to
be supported on shallow foundations. As an alternative, deep foundations can be used for

support of structures.

The current plan calls for 107,023 cubic yards of import to construct the proposed development
due to the necessary remedial work which would necessitate over 5,000 truck loads of soil to be
imported to the site via the existing roadways.
Mitigation
Due to the site's proximity to existing residential development, the deep foundation alternative
shall be used along with all other recommendations of the preliminary geotechnical investigation
report as mitigation to avoid to the maximum extent possible the necessity for excessive import
andlor export of soil. The deep foundation alternative would reduce the amount of remedial
grading necessary thereby reducing the grading quantities to approximately 42,000 cubic yards
of import Additionally, mitigation to reduce noise impacts resulting from the import of soil
shall include a restriction on the hours of operation to between 9:00 a.m. to 3:00 p.m. Monday
through Friday.
IV. Water
Stormwater from the site currently drains directly into the creek (unnamed tributary of Encinitas
Creek) located along the property's western boundary. The site has been previously disturbed by
unauthorized grading and there is no existing storm water management system. The proposed
LDS Church project will result in 3.23 acres or 47.4% of the site being developed with
impervious surfaces. The development of the site will create an increase in pollutants discharged
in storm water. These include oxygen demand, sediment, nutrients, heavy metals, and oil and
grease. Many of these pollutants collect on roof and pavement surfaces, and are transported in
the "first flush" of rainfall.
The project proposes that runoff from controlled drainage areas will drain into five catch basins
and be discharged into the creek through underground storm sewers. A 24" RCP storm drain
will be installed by connecting to the existing 24" RCP to divert drainage into the creek. The
preliminary Storm Water Pollution Prevention Plan (SWPP) prepared for the project by BSW
International indicates that sediment, the primary contaminant resulting from the grading
operation, will be controlled by numerous structural and non-structural devices as well as Best
Management Practices (BMPs) for construction activities. Specifically, during construction,
some of the BMP measures that will be implemented include the installation of stormceptors to
remove pollutants and sediments, directing runoff through vegetated areas, developing and
enhancing vegetation and wildlife habitat areas along the existing drainage channel, protecting
the drainage channel from erosion by seeding, vegetation and rip-rap, and controlling storm
water discharge velocities by using energy dissipators. Compliance with the City's Grading and
Erosion Control Ordinance through the implementation of erosion control measures specified in
the SWPP will avoid excessive sedimentation from the site being released into the creek.
Mitigation
Compliance with the SWPP for Construction Activity and installation of pollution control
devices as identified on the project Grading and Drainage Plan.
V. Air Quality
In 1994 the City prepared and certified an EIR which analyzed the impacts which will result

from the build-out of the City under an updated General Plan. That document concludes that
continued development to build-out as proposed in the updated General Plan will have
cumulative significant impacts in the form of increased gas and electric power consumption and
vehicle miles traveled. These subsequently result in increases in the emission of carbon
monoxide, reactive organic gases, oxides of nitrogen and sulfur, and suspended particulates.
These aerosols are the major contributors to air pollution in the City as well as in the San Diego
Air Basin. Since the San Diego Air Basin is a "non-attainment basin", any additional air
emissions are considered cumulatively significant: therefore, continued development to build-out
as proposed in the updated General Plan will have cumulative significant impacts on the air
quality of the region.
To lessen or minimize the impact on air quality associated with General Plan build-out, a variety
of mitigation measures are recommended in the Final Master EIR. These include: 1) provisions
for roadway and intersection improvements prior to or concurrent with development; 2)
measures to reduce vehicle trips through the implementation of Congestion and Transportation
Demand Management; 3) provisions to encourage alternative modes of transportation including
mass transit services; 4) conditions to promote energy efficient building and site design; and 5)
participation in regional growth management strategies when adopted. The applicable and
appropriate General Plan air quality mitigation measures have either been incorporated into the
design of the project or are included as conditions of project approval.
Operation-related emissions are considered cumulatively significant because the project is
located within a "non-attainment basin", therefore, the "Initial Study" checklist is marked
"Potentially Significant Impact". This project is consistent with the General Plan, therefore, the
preparation of an EIR is not required because the certification of Final Master EIR 93-01, by
City Council Resolution No. 94-246, included a "Statement Of Overriding Considerations" for
air quality impacts. This "Statement Of Overriding Considerations" applies to all projects
covered by the General Plan's Final Master EIR. This project is within the scope of that MEIR.

VI. Circulation
In 1994 the City prepared and certified a Master EIR which analyzed the impacts which would
result from the build-out of the City under an updated General Plan. That document concluded
that continued development to build-out as proposed in the updated General Plan will result in
increased traffic volumes. Roadway segments will be adequate to accommodate build-out
traffic; however, 12 full and 2 partial intersections will be severely impacted by regional
through-traffic over which the City has no jurisdictional control. These generally include all
freeway interchange areas and major intersections along Carlsbad Boulevard. Even with the
implementation of roadway improvements, a number of intersections are projected to fail the
City's adopted Growth Management performance standards at build-out.
To lessen or minimize the impact on circulation associated with General Plan build-out,
numerous mitigation measures have been recommended in the Final Master EIR. These include:
1) measures to ensure the provision of circulation facilities concurrent with need; 2) provisions to
develop alternative modes of transportation such as trails, bicycle routes, additional sidewalks,
pedestrian linkages, and commuter rail systems; and 3) participation in regional circulation
strategies when adopted. The diversion of regional through-traffic from a failing Interstate or
State Highway onto City streets creates impacts that are not within the jurisdiction of the City to
control. The applicable and appropriate General Plan circulation mitigation measures have either
been incorporated into the design of the project or are included as conditions of project approval.

Regional related circulation impacts are considered cumulatively significant because of the
failure of intersections at build-out of the General Plan due to regional through-traffic, therefore,
the "Initial Study" checklist is marked "Potentially Significant Impact". This project is
consistent with the General Plan, therefore, the preparation of an EIR is not required because the
recent certification of Final Master EIR 93-01, by City Council Resolution No. 94-246, included
a "Statement Of Overriding Considerations" for circulation impacts. This "Statement Of
Overriding Considerations" applies to all projects covered by the General Plan's Master EIR.
This project is within the scope of that MEIR. This document is available at the Planning
Department.
A MEIR may not be used to review projects if it was certified more than five years prior to the
filing of an application for a later project. The City is currently reviewing the 1994 MEIR to
determine whether it is still adequate to review subsequent projects. Although the MEIR was
certified more than five years ago, the City's preliminary review of its adequacy finds that no
substantial changes have occurred with respect to the circumstances under which the MEIR was
certified. The only potential changed circumstance, the intersection failure at Palomar Airport
Rd. and El Camino Real, is in the process of being mitigated to below a level of significance.
Additionally, there is no new available information, which was not known and could not have
been known at the time the MEIR was certified. Therefore, the MEIR remains adequate to
review later projects.
VII. Biological Resources
The majority of the site (6.05) acres is highly disturbed and virtually devoid of native vegetation.
The site does contain jurisdictional wetland and riparian habitat consisting of about .5 acre of
Southern Willow Scrub and Freshwater Marsh vegetation with some isolated Coast Live Oaks
and Willow trees within two drainages that flow off-site to the south. These areas have defined
channels, to which the obligate and facultative wetland vegetation is restricted. In some
instances, willows occur high on the banks of the north-south channel, outside the area of
hydrologic influence and hydric soils. The limit of the U.S. Army Corp of Engineers (Corps)
jurisdiction is the upper edge of channel banks of both drainages. Lengths of these features are
380 feet of the shorter, east west channel and 840 feet of the longer, north-south channel. The
jurisdictional areas of these are 4,560 square feet and 10,080 square feet, respectively. This
results in a total of 0.34 acre (14,640 square feet) of wetland habitat. The associated Willows
outside the Corps jurisdictional area constitute an additional jurisdiction area under the
California Department of Fish and Game, adding an additional 0.16 acre. This results in a total
habitat area of riparian vegetation of 0.5 acre. The on-site drainage course continues offsite to
the west, however, the habitats on the site are virtually landlocked by Camino de Los Coches on
the south and surrounding existing development.
A small isolated patch (approximately 25 individuals) of Southwestern Spiny Rush is located on
the site, however, due to its small size and isolation, it is not considered significant and
mitigation is not recommended.
As designed, the project would impact approximately .13 acre of Southern Willow Scrub
vegetation (300 feet of channel) and 4.95 acres of disturbed habitat. The loss of disturbed habitat
is not considered significant because of the low habitat value. However, the loss of 0.13 acre of
Southern Willow Scrub is considered significant unless mitigated.
A minor change in the original grading plan was made to widen the existing stream course on the
northwestern and southwestern portions of the site that allows the creation of treatment and

mitigation wetlands to expand wetland area for filtering and capture of the first flush runoff from
the site.
Mitigation for impacts to the jurisdictional drainages would involve excavation of upland areas
adjacent to the north-south channel to allow for a widening of the floodway and increase in
wetland habitat. In concert with the new habitat areas, the discharge sites from the parking lot
would be directed so that low flows are treated by the associated wetland vegetation.
The impacts to jurisdictional areas are as follows:
Permits andlor agreements for disturbance of jurisdictional areas will be obtained prior to
grading from the Corps and the California Department of Fish and Game.

XIV. Cultural Resources
The project is located within the southeastern portion of the La Costa Master Plan area. Previous
archaeological studies have been performed over the entire area. Although several
archaeological sites in the vicinity of the project are recorded, none have been identified at the
proposed project location. Cultural resource surveys were not required due the previous
archaeological studies performed in the area, the relatively small area of the site proposed for
development (approximately 5 acres), and the previous disturbance of the site by undocumented
grading.

Geological Mitigation -
Due to the site's proximity to existing residential development, the deep foundation alternative
shall be used along with all other recommendations of the preliminary geotechnical investigation
report as mitigation to avoid to the maximum extent possible the necessity for excessive import
andlor export of soil. The deep foundation alternative would reduce the amount of remedial
grading necessary thereby reducing the grading quantities to approximately 42,000 cubic yards
of import. Additionally, mitigation to reduce nuisance impacts resulting from the import of soil
shall include a restriction on the hours of operation to between 9:00 a.m. to 3:00 p.m. Monday
through Friday.

This Environmental Impact Assessment (EIA) Form - Part I will be used to determine what type
of environmental documentation (i.e., Environmental Impact Report, Mitigated Negative
Declaration, Negative Declaration or Exemption) will be required to be prepared for your
application, per the California Environmental Quality Act (CEQA) and Title 19 of Carlsbad's
Municipal Code. The clarity and accuracy of the information you provide is critical for purposes
of quickly determining the specific environmental effects of your project.
Recent judicial decisions have held that a "naked checklist," that is checklist that is merely
checked "yes" or "no," is insufficient to comply with the requirements of the California
Environmental Quality act. Each "yes" or "no" answer must be accompanied by a written
explanation justifying the "yes" or "no" answer. This is especially important when a Negative
Declaration is being sought. The more information provided in this form, the easier and quicker

ENVIRONMENTAL IMPACTS
STATE CEQA GUIDELINES, Chapter 3, Article 5, Section 15063 requires that the City
conduct an Environmental Impact Assessment to determine if a project may have a significant
effect on the environment. The Environmental Impact Assessment appears in the following
pages in the form of a checklist. This checklist identifies any physical, biological and human
factors that might be impacted by the proposed project and provides the City with information to
use as the basis for deciding whether to prepare an Environmental Impact Report (EIR), Negative
Declaration, or to rely on a previously approved EIR or Negative Declaration.
A brief explanation is required for all answers except "No Impact" answers that are
adequately supported by an information source cited in the parentheses following each
question. A "No Impact" answer is adequately supported if the referenced information
sources show that the impact simply does not apply to projects like the one involved. A
"No Impact" answer should be explained when there is no source document to refer to, or
it is based on project-specific factors as well as general standards.
"Less Than Significant Impact" applies where there is supporting evidence that the
potential impact is not adversely significant, and the impact does not exceed adopted
general standards and policies.
"Potentially Significant Unless Mitigation Incorporated" applies where the incorporation
of mitigation measures has reduced an effect from "Potentially Significant Impact" to a
"Less Than Significant Impact." The developer must agree to the mitigation, and the
City must describe the mitigation measures, and briefly explain how they reduce the
effect to a less than significant level.
"Potentially Significant Impact" is appropriate if there is substantial evidence that an
effect is significant.
Based on an "EIA-Part 11", if a proposed project could have a potentially significant
effect on the environment, but potentially significant effects (a) have been analyzed
adequately in an earlier EIR or Mitigated Negative Declaration pursuant to applicable
standards and (b) have been avoided or mitigated pursuant to that earlier EIR or Mitigated
Negative Declaration, including revisions or mitigation measures that are imposed upon
the proposed project, and none of the circumstances requiring a supplement to or
supplemental EIR are present and all the mitigation measures required by the prior
environmental document have been incorporated into this project, then no additional
environmental document is required (Prior Compliance).
When "Potentially Significant Impact" is checked the project is not necessarily required
to prepare an EIR if the significant effect has been analyzed adequately in an earlier EIR
pursuant to applicable standards and the effect will be mitigated, or a "Statement of
Overriding Considerations" has been made pursuant to that earlier EIR.
A Negative Declaration may be prepared if the City perceives no substantial evidence that
the project or any of its aspects may cause a significant effect on the environment.

If there are one or more potentially significant effects, the City may avoid preparing an
EIR if there are mitigation measures to clearly reduce impacts to less than significant, and
those mitigation measures are agreed to by the developer prior to public review. In this
case, the appropriate "Potentially Significant Impact Unless Mitigation Incorporated"
may be checked and a Mitigated Negative Declaration may be prepared.
An EIR must be prepared if "Potentially Significant Impact" is checked, and including
but not limited to the following circumstances: (1) the potentially significant effect has
not been discussed or mitigated in an Earlier EIR pursuant to applicable standards, and
the developer does not agree to mitigation measures that reduce the impact to less than
significant; (2) a "Statement of Overriding Considerations" for the significant impact has
not been made pursuant to an earlier EIR; (3) proposed mitigation measures do not reduce
the impact to less than significant, or; (4) through the EIA-Part I1 analysis it is not

DISCUSSION OF ENVIRONMENTAL EVALUATION
Please use this area to discuss any of the environmental factors that were checked "No impact"
yet lack any information citations and any factors that were checked "Potentially Significant
Impact" or "Potentially Significant Impact Unless Mitigation Incorporated." The City has
adopted a "Statement of Overriding Consideration" with regard to air quality and circulation
impacts resulting from the normal buildout according to the General Plan. The following sample
text is intended to guide your discussion of the impacts to these environmental factors.
AIR OUALITY:
The implementation of subsequent projects that are consistent with and included in the updated
1994 General Plan will result in increased gas and electric power consumption and vehicle miles
traveled. These subsequently result in increases in the emission of carbon monoxide, reactive
organic gases, oxides of nitrogen and sulfur, and suspended particulates. These aerosols are the
major contributors to air pollution in the City as well as in the San Diego Air Basin. Since the
San Diego Air Basin is a "non-attainment basin", any additional air emissions are considered
cumulatively significant: therefore, continued development to buildout as proposed in the
updated General Plan will have cumulative significant impacts on the air quality of the region.
To lessen or minimize the impact on air quality associated with General Plan buildout, a variety
of mitigation measures are recommended in the Final Master EIR. These include: 1) provisions
for roadway and intersection improvements prior to or concurrent with development; 2) measures
to reduce vehicle trips through the implementation of Congestion and Transportation Demand
Management; 3) provisions to encourage alternative modes of transportation including mass
transit services; 4) conditions to promote energy efficient building and site design; and 5)
participation in regional growth management strategies when adopted. The applicable and
appropriate General Plan air quality mitigation measures have either been incorporated into the
design of the project or are included as conditions of project approval.
Operation-related emissions are considered cumulatively significant because the project is
located within a "non-attainment basin", therefore, the "Initial Study" checklist is marked
"Potentially Significant Impact". This project is consistent with the General Plan, therefore, the
preparation of an EIR is not required because the certification of Final Master EIR 93-01, by City
Council Resolution No. 94-246, included a "Statement Of Overriding Considerations" for air
quality impacts. This "Statement Of Overriding Considerations" applies to all subsequent
projects covered by the General Plan's Final Master EIR, including this project, therefore, no
further environmental review of air quality impacts is required. This document is available at the
Planning Department.
CIRCULATION:
The implementation of subsequent projects that are consistent with and included in the updated
1994 General Plan will result in increased traffic volumes. Roadway segments will be adequate
to accommodate buildout traffic; however, 12 full and 2 partial intersections will be severely
impacted by regional through-traffic over which the City has no jurisdictional control. These
generally include all freeway interchange areas and major intersections along Carlsbad
Boulevard. Even with the implementation of roadway improvements, a number of intersections
are projected to fail the City's adopted Growth Management performance standards at buildout.

To lessen or minimize the impact on circulation associated with General Plan buildout, numerous
mitigation measures have been recommended in the Final Master EIR. These include 1)
measures to ensure the provision of circulation facilities concurrent with need; 2) provisions to
develop alternative modes of transportation such as trails, bicycle routes, additional sidewalks,
pedestrian linkages, and commuter rail systems; and 3) participation in regional circulation
strategies when adopted. The diversion of regional through-traffic from a failing Interstate or
State Highway onto City streets creates impacts that are not within the jurisdiction of the City to
control. The applicable and appropriate General Plan circulation mitigation measures have either
been incorporated into the design of the project or are included as conditions of project approval.
Regional related circulation impacts are considered cumulatively significant because of the
failure of intersections at buildout of the General Plan due to regional through-traffic, therefore,
the "Initial Study" checklist is marked "Potentially Significant Impact". This project is
consistent with the General Plan, therefore, the preparation of an EIR is not required because the
recent certification of Final Master EIR 93-01, by City Council Resolution No. 94-246, included
a "Statement Of Overriding Considerations" for circulation impacts. This "Statement Of
Overriding Considerations" applies to all subsequent projects covered by the General Plan's
Master EIR, including this project, therefore, no further environmental review of circulation

Comment: Because the proposed project is a church, traffic impacts were analyzed for both weekdays,
which is a standard peak-hour traffic analysis procedure, and Sundays. To analyze traffic
impacts at a worst-case scenario, in accordance with SANDAG guidelines, the weekday
ADT was multiplied by a factor of 3. Both weekday and Sunday peak-hour capacity
analysis indicated that both roadway segments and intersections operate at a level of service
B or better. Because the surrounding street segments and intersections operate at
acceptable levels of service, the project is not required to implement any roadway
improvements.

compressible soils must occur and suitable soil must be imported and properly
compacted to be able to support the proposed structure. However, to limit
remedial grading, a deep foundation for the proposed structure, consisting of
driven piles, or drilled cast-in-place concrete piers, could be utilized as a suitable
alternative system for foundation support. Driven piles or cast-in-place piers
would minimize any remedial grading and thereby negate excessive quantities of
soil export from the site.
Section's 4 and 5 of the project soils report discuss these various options for site
grading.
DRAINAGE & EROSION CONTROL:

Comment: There are no major drainage issues associated with the proposed project.
A preliminary Storm Water Pollution Prevention Plan was prepared to show how surficial
runoff erosion and pollutants will be mitigated in accordance with National Pollutant
Discharge Elimination System (NPDES) and San Diego Regional Water Quality Control
Board (SDRWQCB) criteria. To meet construction pollutant mitigation criteria, Best
Management Practices (BMP's) shall be utilized. BMP's will consist of controlling the
site perimeter and internal erosion; protecting slopes and the existing channel; runoff
diversion measures; sediment traps and desiltation basins; and, installation of sandlgravel
bags, hay bales and silt fencing.
Post construction pollutant mitigation measures shall include structural BMP's including,
directing runoff through vegetated swales and two (2) pollutant mitigation "stormceptors"
before discharging the runoff into the adjacent existing drainage channel. Additionally,
the owner shall educate future on-site personnel and patrons on impacts of improper solid
waste practices and littering and proper use and management of fertilizers, herbicides, and
other harmful chemicals.

ENGINEERING CONDITIONS OF APPROVAL
ENGINEERING CONDITIONS
Note: Unless specifically stated in the condition, all of the following conditions, upon the approval of
this Conditional Use Permit, must be met prior to approval of a grading permit.
General
1 .(7) Prior to hauling dirt or construction materials to or from any proposed construction site within this
project, Developer shall apply for and obtain approval from the City Engineer, for the proposed
haul route.
2.(8) Prior to issuance of any building permit, Developer shall comply with the requirements of the
City's anti-graffiti program for wall treatments if and when such a program is formally established
by the City.
3.(16) Developer shall install sight distance corridors at all streets/driveways/intersections in accordance
with Engineering Standards and Caltrans requirements and shall record the following statement
on the project's final grading and landscape plans:
"No structure, fence, wall, tree, shrub, sign, or other object over 30 inches above the street
level may be placed or permitted to encroach within the area identified as a sight distance
corridor in accordance with City Standard Public Street-Design Criteria, Section 8.B.3.
The underlying property owner shall maintain this condition."
Additionally, the limits of the sight distance corridors shall be reflected on any improvement,
grading, or landscape plan prepared in association with this project.
4.(17) Developer shall cause property owner to execute and submit to the City Engineer for recordation,
the City's standard form - Geologic Failure Hold Harmless Agreement.
5.(18) Developer shall cause property owner to execute and submit to the City Engineer for recordation
the City's standard form - Drainage Hold Harmless Agreement.
6.(53) The Average Daily Trips (ADT) and floor area contained in the staff report and shown on the site
plan are for planning purposes only. Developer shall pay traffic impact fees based on Section
18.42 of the City of Carlsbad Municipal Code.
7. A City standard encroachment agreement shall be executed by the owner of the property for
the on-site parking median encroachment on the proposed 24" RCP public storm drain, as
shown on the site plan.
Grading
8.(24) Prior to the issuance of a grading permit or building permit, whichever occurs first, Developer
shall submit to the City Engineer proof that a Notice of Intention for the start of work has been
submitted to the State Water Resources Control Board.
9.(25) Upon completion of grading, Developer shall file an "as-graded" geologic plan with the City
Engineer. The plan shall clearly show all the geology as exposed by the grading operation, all
geologic corrective measures as actually constructed and must be based on a contour map which
represents both the pre and post site grading. The plan shall be signed by both the soils engineer
and the engineering geologist, and shall be submitted on a 24" x 36" mylar or similar drafting film
format suitable for a permanent record.
10.(26) This project may require off site grading. No grading for private improvements shall occur
outside the limits of this approval unless Developer obtains, records and submits a recorded copy
to the City Engineer, a grading or slope easement or agreement from the owners of the affected
properties. If Developer is unable to obtain the grading or slope easement, or agreement, no
grading permit will be issued. In that case Developer must either apply for and obtain an
amendment of this approval or modify the plans so grading will not occur outside the project and
apply for and obtain a finding of substantial conformance from both the City Engineer and
Planning Director.
1 1 .(27) Based upon a review of the proposed grading and the grading quantities shown on the site plan, a
grading permit for this project is required. Developer shall apply for and obtain a grading permit
from the City Engineer prior to issuance of a building permit for the project. .
12.(31) Developer shall cause Owner to dedicate to the City andlor other appropriate public entities all
public easements shown on the site plan. The offer shall be made by a separate recorded
document. All land so offered shall be offered free and clear of all liens and encumbrances and
without cost to the City andlor other appropriate public entities.
13.(32) Additional drainage easements may be required. Developer shall dedicate and provide or install
drainage structures, as may be required by the City Engineer, prior to or concurrent with any
grading or building permit.
14.(33) Developer shall provide the design of all drainage systems to the satisfaction of the City Engineer.
All drainage systems shall be inspected by the City. Developer shall pay the standard
improvement plan check and inspection fees.
15.(34) Developer shall execute and record a City standard Development Improvement Agreement to
install and secure with appropriate security as provided by law, public improvements shown on the
site plan, to City Standards to the satisfaction of the City Engineer, which include, but are not
limited to:
a. 24" RCP Storm Drain with Water Tight Joints;
b. Storm drains shall be added in front of the proposed stormceptors, or the
stormceptor inlet shall be reconfigured so that surface runoff into the stormceptor
flows into the stormceptor treatment chamber (see CSR Stormceptor technical
manual Section's 1.2 and 2.1, "Inlet configuration");
c. Root Barriers for the Landscaping within the proposed on-site Parking Median that
Encroaches on the proposed 24" RCP Storm Drain;
d. Relocation of Utilities; and,
e. Roadway Striping and Signing.
Drainage improvements listed above shall be constructed concurrently with site grading.
Other Improvements listed above shall be constructed within 18 months of approval of the
Development Improvement Agreement or such other time as provided in said agreement.
16.(40) Prior to issuance of the grading permit, the applicant shall submit for City approval a final "Storm
Water Pollution Prevention Plan (SWPPP)." The SWPPP shall be in compliance with current
requirements and provisions established by the San Diego Region of the California Regional
Water Quality Control Board. The SWPPP shall address measures to reduce to the maximum
extent possible storm water pollutant runoff at both construction and post-construction phases of
the project. At a minimum, the SWPPP shall:
a. Identify existing and post-development on-site pollutants;
b. Recommend source control Best Management Practices (BMPs) to filter said pollutants;
c. Establish specific procedures for handling spills and routine clean up. Special
considerations and effort shall be applied to employee education on the proper procedures
for handling clean up and disposal of pollutants; and,
d. Ensure long-term maintenance of all post construction BMPs in perpetuity.
17.(43) Developer shall install wheelchair ramps at the project driveways along Camino De Los Coches
in conformance with City of Carlsbad Standards.
18.(44) Prior to building permit issuance, Developer shall design, apply for and obtain, approval of the
City Engineer for the structural section for the access aisles, in accordance with City Standards,
due to access through the parking area andlor aisles with an ADT greater than 500. The structural
pavement design of the aisle ways shall be submitted together with required R-value soil test
information and approved by the City Engineer as part of the grading plan review.
19.(45) Developer shall incorporate into the gradinglimprovement plans the design for the project drainage
outfall end treatments for any drainage outlets where a direct access road for maintenance purposes
is not practical. These end treatments shall be designed so as to prevent vegetation growth from
obstructing the pipe outfall. Designs could consist of a modified outlet headwall consisting of an
extended concrete spillway section with longitudinal curbing andlor radially designed rip-rap, or
other means deemed appropriate (e.g., SDRSD D-41), to the satisfaction of the City Engineer.
Code Reminder
The project is subject to all applicable provisions of local ordinances, including but not limited to the
following:
1.(49) Developer shall exercise special care during the construction phase of this project to prevent
offsite siltation. Planting and erosion control shall be provided in accordance with Carlsbad
Municipal Code Chapter 15.16 (the Grading Ordinance) to the satisfaction of the City Engineer.
Water, Sewer, Recvcled Water Conditions
1. This project is approved upon the expressed condition that building permits will not be issued for
the development of the subject property, unless the Leucadia and Olivenhain Municipal Water
District, District Engineers have determined that adequate water and sewer facilities are available
at the time of occupancy. It is incumbent upon Developer to process improvement drawings
and obtain approvals from these agencies.
2. Prior to issuance of grading permit, the recycled water system shall be evaluated in detail to
ensure that adequate capacity, pressure, and flow demands can be met to the satisfaction of the
Olivenhain Municipal Water District, District Engineer.

3. Prior to approval of improvement plans, Developer shall meet with the Fire Marshal to determine
if fire protection measures (fire flows and building sprinklers) are required to serve the project. If
on-site fire hydrants are required, they shall be considered a public improvement and shall be
served by public water mains, within 20' public easements to the satisfaction of the Olivenhain
and Carlsbad District Engineer's. The 15' easement currently shown on the site plan shall be
revised to a 20' easement. The revised 20' easement shall be shown on the project
conforming mylars.
4. Prior to issuance of building permit, any trenching done within public streets, which have
been pavedlcapped within the previous five (5) years, to install any utilities shall be repaired
by completely resurfacing the street from the curb line to the edge of the adjacent lane at a
minimum 11' width, to the satisfaction of the City Engineer.

Engineering Department staff have completed a review of the above-referenced project for
application completeness and have determined that the application and plans submitted for the
project are incomplete and unsuitable for continued review due to the following
incomplete items:
INCOMPLETE ITEMS
1. Please add a Vicinity map to the site plan.
2. As previously requested, please submit a current Preliminary Title Report (PR). The PR
that was submitted is dated December 15, 1993.
3. The property boundary bearings and distances do not match recorded Minor Subdivision
No. 650 (Parcel Map 13524). Please verify and revise.
4. Thank you for implementing some of staff's suggestions for mitigating surface runoff
pollutants (i.e. curb opening with drainage through vegetated areas). However, as
previously indicated, meeting National Pollutant Discharge Elimination System (NPDES)
and San Diego regional Water Quality Control Board (SDRWQCB) criteria is a major
staff issue of concern. Since the preliminary review for the project, the SDRWQCB
enacted Order 2001-01, on February 21, 2001. The Order includes provisions that
development throughout the County must adhere to, to meet water quality standards.
Attached for your use are applicable provisions of the SDRWQCB Order. Please review
this information and implement additional pollution mitigation measures, as contained
therein. For example, in addition to directing surface runoff through vegetated swales
prior to discharge into the creek area, constructing de-pollutant basins, or installing other
structural pollutant mitigation measures (vortex type inlets, or pollutant/runoff separation
inletslchambers, etc.) must be investigated and implemented.
Additionally, the project Drainage Report must address any proposed structural pollutant
mitigation measures under the Best management Practices (BMP) section of the report.
5. Are there any monument signs being proposed for the project? If so, please show them
out of any sight distance sight lines.
6. Please show PR Schedule 'B' easement item No. 5, and please provide recorded copies
of document items 9, 11 and 12. Also, as previously requested, please indicate the
future disposition of easements and encumbrances.

With two proposed driveways, the project does not meet City intersection spacing
standards. The northerly driveway should be deleted. Additionally, the project Traffic
Report did not analyze two driveways. If the northerly driveway is still going to be
proposed, impacts must be addressed and justification must be provided in the project
Traffic Report. Additionally, the since the Traffic Report only analyzed one driveway
access to the site, the Traffic Report must be revised to include this second driveway and
must reanalyze traffic distribution and resulting roadway and intersection impacts, if this
second driveway access is still going to be proposed.
8. As previously indicated, a project SoilsIGeo-technical Report must be submitted.
9. As previously indicated, the County Assessor's Parcel Book for this Assessor's Parcel
Number (APN: 223-060-50) indicates that this lot is in "Open Space1' and has "No
Access." Preliminary Title Report (PR), Schedule 'B' Item No. 5, indicates that an
easement exists for "Open Space and Pedestrians." Please research this issue and
submit documentation that the site is developable and has legal access.
Additionally, staff has conducted a review of the project for engineering issues of concern.
Engineering issues which must be resolved or adequately addressed prior to staff making a
determination on the proposed project are as follows:

1. Pease submit a Traffic Signal Warrant Analysis for the project entrance.
2. As previously requested, please show vertical curve profiles for the driveway grade
breaks.

4. Please add proposed preliminary striping to the site plan for CDLC. For example, the
existing two-way-left-turn-lane should probably be revised to show a dedicated left-turn-

5. Please correctly show typical street sections for all streets on the site plan. For example,
Section C-C, on sheet C5 for CDLC shows one side of the roadway substantially sloping
greater then the other side. Is this correct? Also, should Section D-D, Via Callendo, have
existing sidewalk shown?

transitions, and any impacted striping will have to be reapplied.
3. Please add CUP 01-04 to the site plan. Also, create a site plan, plan set, which shall
include C1, C2, C3, C5 and LC-1. Number than consecutively as a comprehensive site
plan, plan set.
4. Please make sure that any revisions that are made on one plan set are made on all
applicable plan sets.
5. Attached for the applicant's use for making the requested revisions are red-lined check
prints of the project. These check prints must be returned with the revised plans to
facilitate continued staff review.

Dear Mr. Dunn:
In accordance with the request of Bill Jenson, Southern California Soil & Testing, Inc., is
presenting this report to summarize conclusions and recommendations regarding major
geotechnical aspects of construction of the new Church of Jesus Christ of Latter Day Saints
Meeting House at 3450 Camino de 10s Coches in Carlsbad, California (Grading Permit No.
CB022186).
1) Grading, base course placement and compaction, and asphalt concrete surface course
placement and compaction for the parking lot has been completed. Observations and tests
during construction indicate that the subgrade preparation was completed satisfactorily,
and that base course and asphalt concrete surface courses have been placed and
compacted in accordance with City of Carlsbad Specifications and Church Standard
Specifications. A report summarizing our observations and test results for the parking lot
currently is being prepared.
2) Based on SCS&T9s observations and tests during grading, the fill soils placed within 5 feet
of finish grade in the parking lot area are non-detrimentally expansive.
3) Based on our field observations and the in-place density test results, the earthwork in the
meeting house building pad area was performed in substantial accordance with the
recommendations contained in SCS&T9s letter dated May 27, 2003, the City of Carlsbad
\ Grading Ordinance, the approved grading plans, and the Church Standard and
Specifications.

4) A total of 55 drilled piers were completed for the meeting house. The piers were drilled by
Peter Drilling and D.J. Sheffler Drilling between July 21 and August 4, 2003, with a solid
stem flight auger drill rig. Observations indicated that:
Th-e subsurface conditions encountered did not significantly differ from the conditions
anticipated in the referenced reports. The cuttings from all of the drilled holes were
observed as drilling progressed.
The drilled piers have the required formational embedment and comply with
SCS&T's recommendations and the project structural plans.
Water was encountered in most of the drilled holes at various depths.
The loose soils in the bottoms of the excavations were removed using a cleaning
bucket attached to the drill rig.
5) Site retaining walls have been constructed and backfilled in accordance with final project
plans and SCS&T9s recommendations.

THIS AGREEMENT, entered into between the State of California, Department of Fish
and Game, hereinafter called the Department, and Leo Garcia, representing the
Corporation of the Presidina Bishop of the Church of Jesus Christ of Latter Dav Saints,

hereinafter called the Operator, is as follows:
WHEREAS, pursuant to Section 1603 of California Fish and Game Code, the Operator,
on the 14th day of March, 2002, notified the Department that they intend to divert or
obstruct the natural flow of, or change the bed, channel, or bank of, or use material from
the streambed(s) of, the following water(s): an unnamed drainage. tributary to
Encinitas Creek, San Diego County, California, Section&Township 13s Range 3W .
WHEREAS, the Department (represented by Tamara Spear through a site visit on
the @ day of March, 2002) has determined that such operations may substantially
adversely affect those existing fish and wildlife resources within the streambed of=
unnamed drainane, tributarv to Encinitas Creek,lspecifTcally identified as follows:-
Birds: moumina dove (Zenaida macroura). AmeiiGn crow (Corvus brachvrhvnchos),
Anna's humminabird (Calv~te anna), black phoebe (Savornis nigricans), Bewick's wren
(Thn/omanes bewickiil. Cassin's kinabird (Tvrannus vociferous): Amphibians: Pacific
tree froa (Hvla reailla). house finch (Camodacus mexicanus): Reptiles: western fence
lizard (S6elo~orous occidentalis), side-blotched lizard (Uta stansburiana), gopher snake
(Pituo~his melanoleucus); Mammals: covote (Canis latrans). California ground sauirrel
[SR~I-~OR~~/US beechevil. Botta's pocket cropher (Thomomvs botfae): Plants:
southwestern s~inv rush (Juncus acutus); including the freshwater marsh and southern
willow scrub which provide habitat for such s~ecies in the area.
THEREFORE, the Department hereby proposes measures to protect fish and
wildlife resources during the Operator's work. The Operator hereby agrees to accept the
following measures/conditions as part of the proposed work.
If the Operator's work changes from that stated in the notification specified above,
this Agreement is no longer valid and a new notification shall be submitted to the
Department of Fish and Game. Failure to comply with the provisions of this Agreement
and with other pertinent code sections, including but not limited to Fish and Game Code
Sections 5650, 5652, 5937, and 5948, may result in prosecution.
Nothing in this Agreement authorizes the Operator to trespass on any land or
property, nor does it relieve the Operator of responsibility for compliance with applicable
federal, state, or local laws or ordinances. A consummated Agreement does not
constitute Department of Fish and Game endorsement of the proposed operation, or
assure the Department's concurrence with permits required from other agencies.

STREAMBED ALTERATION AGREEMENT #R5-2002-0184
This Aareement becomes effective the date of Department's signature and terminates
December 31, 2003 for proiect construction onlv. This Aqreement shall remain in effect
for that time necessarv to satisfv the termslconditions of this Aqreement.
1. The following provisions constitute the limit of activities agreed to and resolved by this
Agreement. The signing of this Agreement does not imply that the Operator is precluded
from doing other activities at the site. However, activities not specifically agreed to and
resolved by this Agreement shall be subject to separate notification pursuant to Fish and
Game Code Sections 1600 et seq.
2. The Operator proposes to alter the streambed of an unnamed drainage, tributary to
Encinitas Creek to accommodate the construction of the LDS Meeting House. Project
activity includes construction of a church building with retaining walls, parking facilities, as
well as an on-site wetland mitigation area. The project site is located east of Interstate 5
on LaCosta Avenue past Rancho Santa Fe Road, then south on Camino de Los Coches,
north of the Stagecoach Park playing fields in the city of Carlsbad, San Diego County
impacting 0.1 3 acre of streambed. -
3. The agreed work includes activities associated with No. 2 above. The project area is
located within the streambed of an unnamed drainage, tributary to Encinitas Creek,
San Diego County. Specific work areas and mitigation measures are described onlin the
plans and documents submitted by the Operator, including a "LDS Meetina House-Cardiff
1 & 2 Site, Carlsbad. CA Biotic Resource Assessment", prepared bv PSBS. Inc, dated
Julv 20, 2001 : a "Water Quality Marsh and Wetland Habitat Mitigation Plan". prepared by
PSBS, Inc.. dated April 17, 2002; a "Mitiqated Negative Declaration", dated January 23,
2002 ; and shall be implemented as proposed - unless directed differently by this
agreement.
4. The Operator shall not permanently impact more than 0.13 acre of jurisdictional
streambed comprised of 0.13 acre southern willow scrub. Impacts from the project shall
be mitigated in-kind at a 3:l ratio. A minimum of 0.39 acresouthern willow scrub creation
is required. Mitigation shall occur on-site, and 0.41 acre of southern willow scrub
creation has been planned.
5. The Operator shall submit a Final Revegetation, Mitigation and Monitoring Plan for the
0.41 acre of wetland habitat restoration and enhancement area on-site. The plan shall
include a description of the proposed numbers, container sizes and planting location by
species, monitoring activities (locations, techniques, scheduling, etc.), maintenance
operations with emphasis on watering methods and schedules; the removal of invasive
plant species, area treated, techniques to be used, and schedule and success criteria for
controlling invasive plants; and anylall other references to revegetation and restoration
activities specified by this agreement. The Operator shall receive Department approval
of the plan prior to project initiationlimpacts.
All revegetation shall be installed no later than March 31. 2003.
6. The Operator shall not remove vegetation within the stream from February 15 to
September 15 to avoid impacts to nesting birds. However, the Operator may remove
vegetation during this time if a qualified biologist conducts a survey for nesting birds within
24 hours of the vegetation removal, and ensures no nesting birds shall be impacted by the
project. If nesting birds are present, the Operator shall immediately notify the

Department and no work shall occur until the young have fledged and will no longer
be impacted by the project.
7. The Operator shall have a qualified biologist onsite daily during any impacts to wetland
vegetation for the purpose of monitoring and enforcing conditions of this agreement.
8. No equipment shall be operated in ponded or flowing areas.
9. Disturbance or removal of vegetation shall not exceed the limits approved by the
Department. The disturbed portions of any stream channel shall be restored. Restoration
shall include the revegetation of stripped or exposed areas with vegetation native to the
area.
10. Installation of bridges, culverts, or other structures shall be such that water flow is not
impaired. Bottoms of temporary culverts shall be placed at stream channel grade;
bottoms of permanent culverts shall be placed at or below stream channel grade.
11. Preparation shall be made so that runoff from steep, erodible surfaces will be diverted
into stable areas with little erosion potential. Frequent water checks shall be placed on
dirt roads, cat tracks, or other work trails to control erosion. . .
12. Water containing mud, silt or other pollutants from aggregate washing or other -
activities shall not be allowed to enter a lake or flowing stream or placed in locations that
may be subjected to high storm flows.
13. Structures and associated materials not designed to withstand high seasonal flows
shall be removed to areas above the high water mark before such flows occur.
14. The perimeter of the work site shall be adequately flagged to-prevent damage to- -
adjacent riparian habitat.
15. Staginglstorage areas for equipment and materials shall be located outside of the
. .. - . .. stream. - . ..
16. The Operator shall comply with all litter and polrution laws. All eontractors,
subcontractors and employees shall also obey these laws and it shall be the responsibility
of the operator to ensure compliance.
17. If a stream's low flow channel, bed or banks have been altered, these shall be
returned as nearly as possible to their original configuration and width, without creating
future erosion problems, excepting the 0.13 acre of permanent streambed impacts
associated with condition No. 2 above.
18. Access to the work site shall be via existing roads and access ramps.
19. All mitigation planting shall have a minimum of 100% survival the first year and 80%
survival thereafter andlor shall attain 75% cover after 3 years and 90% cover after 5 years
for the life of the project. If the survival and cover requirements have not been met, the
Operator is responsible for replacement planting to achieve these requirements.
Replacement plants shall be monitored with the same survival and growth requirements.
20. All mitigation planting shall be done between October 1 and April 30 to take
advantage of the winter rainy season.
21. An annual report shall be submitted to the Department by January 1 (following the

first growing season) of each year for 5 years after planting. This report shall include the
survival, percent cover, and height of both tree and shrub species. The number by
species of plants replaced, an overview of the revegetation effort, and the method used to
assess these parameters shall also be included. Photos from designated photo stations
shall be included.
22. Spoil sites shall not be located within a stream, where spoil could be washed back
into a streamllake, or where it could cover aquatic or riparian vegetation.
23. Raw cementlconcrete or washings thereof, asphalt, paint or other coating material, oil
or other petroleum products, or any other substances which could be hazardous to aquatic
life, resulting from project related activities, shall be prevented from contaminating the soil
and/or entering the waters of the state. These materials, placed within or where they may
enter a stream/lake, by Operator or any party working under contract, or with the
permission of the Operator, shall be removed immediately.
24. No debris, soil, silt, sand, bark, slash, sawdust, rubbish, cement or concrete or
washings thereof, oil or petroleum products or other organic or earthen material from any
construction, or associated activity of whatever nature shall be allowed to enter into or
placed where it may be washed by rainfall oi runoff into, waters of the State. When
operations are completed, any excess materials or debris shall be removed from the work
area. No rubbish shall be deposited within 150 feet of the high water mark of any stream
or lake.
25. No equipment maintenance shall be done within or near any stream channel where
petroleum products or other pollutants from the equipment may enter these areas under
any flow.
26. The Operator shall provide a copy of this Agreement to all contractors,
subcontractors, and the Operator's project supervisors. Copies of the Agreement
shall be readily available at work sites at all times during periods of active work and
must be presented to any Department personnel, or personnel from another agency upon
demand.
27. The Department reserves the right to enter the project site at any time to ensure
compliance with terms/conditions of this Agreement.
28. The Operator shall notify the Depaytment, in writing, at least five (5) days prior to
initiation of construction (project) activities and at least five (5) days prior to
completion of construction (project) activities. Notification shall be sent to the
Department at 4949 Viewridge Avenue, San Diego, CA 92123 Attn: Tamara A. Spear
29. It is understood the Department has entered into this Streambed Alteration
Agreement for purposes of establishing protective features for fish and wildlife. The
decision to proceed with the project is the sole responsibility of the Operator, and is not
required by this agreement. It is further agreed all liability andlor incurred cost
related to or arising out of the Operator's project and the fish and wildlife protective
conditions of this agreement, remain the sole responsibility of the Operator. The
Operator agrees to hold harmless the State of California and the Department of Fish and
Game against any related claim made by any party or parties for personal injury or any
other damages.
30. The Operator shall request an extension of this agreement prior to its termination.
Extensions may be granted for up to 12 months from the date of termination of the
agreement and are subject to Departmental approval. The extension request and fees

shall be submitted to the Department's Region 5 office at the above address. If the
Operator fails to request the extension prior to the agreement's termination, then the
Operator shall submit a new notification with fees and required information to the
Department. Any activities conducted under an expired agreement are a violation of Fish
and Game Code Section 1600 et. seq.
31. The Department reserves the right to suspend or cancel this Agreement for other
reasons, including but not limited to the following:
a. The Department determines that the information provided by the Operator in support
of the NotificationIAgreement is incomplete or inaccurate;
b. The Department obtains new information that was not known to it in preparing the
terms and conditions of the Agreement;
c. The project or project activities as described in the NotificationIAgreement have
changed;
d. The conditions affecting fish and wildlife resources change or the Department
determines that project activities will result in a substantial adverse effect on the
environment.
32. Before any suspension or cancellation of the Agreement, the Department will notify
the Operator in writing of the circumstances which the Department believes warrant
suspension or cancellation. The Operator will have seven (7) working days from the date
of receipt of this notification to respond in writing to the circumstances described in the
Department's notification. During the seven (7) day response period, the Operator shall
immediately cease any project activities which the Department specified in its notification.
The Operator shall not continue the specified activities until that time when the
Department notifies the Operator in writing that adequate methods andlor measures have
been identified and agreed upon to mitigate or eliminate the significant adverse effect.

ISSUES OF CONCERN
Planning:
1. Please revise the proposed open space map so that the western open space
boundary is the parcel's western property line. The eastern open space boundary
should incorporate all of the proposed wetland augmentation as shown on the
proposed grading plan and should not extend beyond the top of slope or retaining
wall proposed as part of the development. See the attached redlined exhibit.
2. The site plan and grading plan should delineate the proposed open space. Please
clearly identify the open space boundary which includes the 70' drainagelopen
space easement.
3. Please revise the note on Sheet C1 - Site Development Plan indicating that the
keystone wall varies up to a height of 10'. The maximum height of the wall may
not exceed 6'; it appears that that is what you have proposed, however, if the wall
exceeds 6' in height at any location, please revise the plan to lower the wall.
4. Please add the RMH General Plan land use designation to the General Site
Information on Sheet C1. Also, please correct site acreage to 6.817 acres from
6,817 acres.
5. Please sign the attached Environmental Impact Assessment agreeing to the required
mitigation measures and return so that I can publicly notice the Mitigated Negative
Declaration for 21 days as required by CEQA.
Engineering:
1. Please make the minor typographical error revisions on page's 1 and 3 of the
"Storm Drainage Study Report."
2. Please more thoroughly discuss the annual soil loss of approximately 195 tons on
page 5 of the report. What impact does this loss have? Is the impact negligible or
substantial?
3. Please number the pages of the report.
4. Please add a detail of the proposed "stormceptor" to the Grading and Drainage Plan,

5. Since the project proposes to extend the existing public 24" RCP storm drain,

Attached is the third engineering issues review for the LDS Church. You'll see
that most of the issues are items that were not addressed from my previous issue's
memo; or were addressed incorrectly; and, are basically minor issues. The only
exception is Hydrology ReporVNPDES Issue No. 1. This issue still needs to be
addressed. Just deleting it from the report is insufficient.
As we discussed on the telephone today, I will still prepare the engineering report
and engineering conditions of approval for Planning Commission so as not to slow the
project up any further. However, I need all of the attached issues resolved and a
corrected set of plans/documents in my office by Friday, February 8, 2002.

ISSUES OF CONCERN
Planning:
1. The project is proposed on a parcel identified in the La Costa Master Plan as
Neighborhood SE 10. The Master Plan designates SElO for multi-family
development and requires the processing of a Site Development Plan in accordance
with Chapter 21.06 (Qualified Overlay Zone) of the Zoning Ordinance. The
proposed church is permitted in residentially zoned areas by Chapter 21.42
(Conditional Uses) of the Zoning Ordinance, upon approval of a conditional use
permit. Therefore, the Conditional Use Permit application you are processing will
satisfy the La Costa Master Plan site plan requirement for Neighborhood SE 10.
/ 2. The 10' high retaining wall is unnecessary. Please reduce the keystone wall to no
higher than 6' in height at any location.
J 3. Revise the landscape plan to identify proposed landscape cover and drip irrigation
on and along the keystone wall.
4. The provision of adequate parking is a major project issue since the City's
requirement is that sufficient parking be provided on site to supply the project's
parking demand. Since you are basing your educational public assembly on the
number of seats in meeting rooms, could you please provide a breakdown of uses
for the numerous rooms you are proposing. My calculation is that there is
approximately 4,000 square feet of meeting room space while the plan identifies
1,538 square feet with 222 persons. The additional 2,500 square feet of meeting
room area could accommodate more seating that you have identified. Please
provide justification.
5. To better understand the proposed biological mitigation recommendation proposed
by the biologist, Mitchell Beauchamp, please submit a revised grading plan
illustrating the proposed mitigation. Please include verification from Mr. Beauchamp
that the revision is consistent with his recommendation.

The Engineering Department has completed its review of the subject application and determined that the
application and plans submitted for the project are incomplete and unsuitable for continued review.
Following is a list of incomplete items that must be submitted to complete the application and a list of
issues that must be resolved or adequately addressed prior to staff making a determination on the
proposed project:
INCOMPLETE ITEMS
1. Please add a Vicinity map to the site plan.
2. As previously requested, please submit a current Preliminary Title Report (PR). The PR that
was submitted is dated December 15,1993.
3. The property boundary bearings and distances do not match recorded Minor Subdivision No.
650 (Parcel Map 13524). Please verify and revise.
4. Thank you for implementing some of staffs suggestions for mitigating surface runoff
pollutants (i.e. curb opening with drainage through vegetated areas). However, as previously
indicated, meeting National Pollutant Discharge Elimination System (NPDES) and San Diego
regional Water Quality Control Board (SDRWQCB) criteria is a major staff issue of concern.
Since the preliminary review for the project, the SDRWQCB enacted Order 2001-01, on
February 2 1, 200 1. The Order includes provisions that development throughout the County
must adhere to, to meet water quality standards. Attached for your use are applicable
provisions of the SDRWQCB Order. Please review this information and implement
additional pollution mitigation measures, as contained therein. For example, in addition to
directing surface runoff through vegetated swales prior to discharge into the creek area,
constructing de-pollutant basins, or installing other structural pollutant mitigation measures
(vortex type inlets, or pollutantfrunoff separation inletslchambers, etc.) must be investigated
and implemented.
Additionally, the project Drainage Report must address any proposed structural pollutant
mitigation measures under the Best management Practices (BMP) section of the report.
5. Are there any monument signs being proposed for the project? If so, please show them out of
any sight distance sight lines.
6. Please show PR Schedule 'B' easement item No. 5, and please provide recorded copies of
document items 9, 11 and 12. Also, as previously requested, please indicate the future
disposition of easements and encumbrances.

analyze two driveways. If the northerly driveway is still going to be proposed, impacts must

2. As previously requested, please show vertical curve profiles for the dnveway grade breaks.
3. Please show pedestrian access to the site that meets ADA requirements (i.e., concrete sidewalk
fiom CDLC to structure).
4. Please add proposed preliminary stnping to the site plan for CDLC. For example, the existing
two-way-left-turn-lane should probably be revised to show a dedicated left-turn-pocket into
the site.
5. Please correctly show typical street sections for all streets on the site plan. For example,
Section C-C, on sheet C5 for CDLC shows one side of the roadway substantially sloping
greater then the other side. Is this correct? Also, should Section D-D, Via Callendo, have
existing sidewalk shown?

2. Please be advised, the 26" trench to install the proposed waterline cannot be repaired with a
standard "T" patch. The entire lanes will have to be overlaid to create smooth transitions, and
any impacted striping will have to be reapplied.
3. Please add CUP 01-04 to the site plan. Also, create a site plan, plan set, which shall include
C1, C2, C3, C5 and LC-1. Number than consecutively as a comprehensive site plan, plan set.
4. Please make sure that any revisions that are made on one plan set are made on all applicable
plan sets.
5. Attached for the applicant's use for making the requested revisions are red-lined check prints
of the project. These check prints must be returned with the revised plans to facilitate
continued staff review.

Sewer Availability for Church of Jesus Christ of Latter Day Saints, Carlsbad
Dear Mr. Jennings:
This is a letter of sewer availability from Leucadia County Water District for the proposed project located
at the intersection of Camino De Los Coches and Via Callendo, APN #223-060-50. Annexation of the
property listed above will not be necessary for sewer service to be provided by the Leucadia County
Water District (LCWD).
Grading Plans and Improvement Plans must be submitted to the District for review. Private development
plan checking and other applicable fees shall be paid to the LCWD. Following plan check, the developer
must enter into a development agreement with the District and make deposits for field and television
inspection of the newly constructed sewer. Actual LCWD costs may vary depending on the issues
encountered during the design and construction process.
Connection fees must be paid after acceptance of sewer construction and prior to house connection. The
District assesses connection fees of $3,950 for each Equivalent Dwelling Unit (EDU) within the
development. A single family house, condominium, or apartment is one EDU. Equivalent commercial
EDU's are specified in the LCWD Standard Specifications and District Resolutions. The District also
assesses an annual sewer service fee last adjusted (reduced) on July 1, 1999 to $155 per EDU per year.

A preliminary review of your project was conducted on August 31, 2000. Listed
below are the issues raised by staff. Please note that the purpose of a preliminary
review is to provide you with direction and comments on the overall concept of your
project. The preliminarv review does not represent an in-depth analvsis of vour
proiect. Additional issues of concern mav be raised after your application is submitted
and processed for a more specific and detailed review.
Planning:
1. The General Plan designation for the drainage easement existing on the property
is open space. The drainage proposed from the parking lot into this area will be
subject to environmental review to ensure avoidance of water quality
environmental impacts.
2. The proposed grading scheme in which a 20' high wall is required to create an
adequate building pad is unacceptable. The parcel contains ample buildable area
without the need to construct retaining walls. Please revise the sitelgrading
plan so that the church is proposed within the developable areas of the site.
3. The proposed project would require applications for a Conditional Use Permit
and Hillside Development Permit. A biological analysis and hydrology analysis
will be required to be submitted with the application to enable environmental
review.
4. Please identify through what approval, if any, the site has been previously
graded. Staff has been unable to locate an approved grading plan.
5. Please submit a parking analysis with the formal application identifying the use
of each room and seating capacity to determine the actual parking requirement.
The parking requirement presented with this preliminary review application
appears to only consider the sanctuary seating; however, use of the entire
facility should be considered in determining the parking requirement. The parking
requirement will ultimately be determined based on the demand generated by
the number of seats or total square footage, whichever is greater.

6. The proposed 60' high steeple, which is 25' above the maximum height
permitted for structures is unacceptable. The parcel is subject to 35' maximum
building height regulations for residential development. The zoning provision for
architectural projections would allow the steeple to project 10' feet above
building height.
Engineering:
Engineering Department staff have completed a preliminary review of the above-
referenced project. Prior to formal application submittal the following items must be
adequately resolvedladdressed:
1. A 12" PVC sewer main is being proposed for the project. Is this being done
at the request of Leucadia County Water District (LCWD)? Additionally, is
access required andlor being provided to reach the existing and proposed
manholes?
2. The "Plan North" and "True North" is a little unorthodox. Why not just
rotate the plan and use "True North," especially since the bearings are being
shown around the property boundary (which must be shown)? Also, please
provide a "Legend" on the site plan.
3. At the "True North" northerly proposed driveway, please create a
levellperpendicular queuing area of a minimum of 24' at 90° to Camino De
Los Coches. Also, at both proposed driveways, please show minimum
vertical curves for the grade breaks. Please show these vertical curves in
profile.
4. Clear Caltrans "corner" sight distance of a minimum of 440' must be met at
all driveway intersections. Also, show that vertical sight distance will be
met at all intersections.
5. Proposing curb returns at the driveways rather than standard driveway "X's"
is acceptable. However, the radius for these curb returns must be increased
from the proposed 15' to 20' at the property line; or, a City Standard Alley
Return (GS-20) can be used as an alternative.
6. The County Assessor's Parcel Book for this Assessor's Parcel Number (APN:
223-060-50) indicates that this lot is in "Open Space" and has "No
Access." Please submit mappingleasementlencumbrance documents, in
accordance with a Preliminary Title Report (PR) referencing this information.
7. A recent PR, issued within six months of formal application submittal, will be
required for the proposed project.
8. All easements and encumbrances, as identified in Schedule 'B' of the PR,
must be indicated on the site plan. The future disposition of all easements
and encumbrances must also be identified.
9. Please indicate all existing and proposed improvements in plan view.

10. Please show typical street sections for all streets on the site plan. lndicate
existing and proposed improvements on the typical sections and whether the
street is public or private.
1 1. Please indicate existing facilities that will have to be relocated. For example,
at the "True North" northerly proposed driveway, there is an existing street
light standard and telephone box that must be relocated to install the
proposed driveway curb returns.
12. Please show any existing streetsldriveways on the other side of Camino De
Los Coches across from the site (i.e., Via Callendo and Terraza Disoma).
13. Please show the existing striping on Cami.no De Los Coches.
14. lndicate how National Pollutant Discharge Elimination System (NPDES)
criteria will be met. The current design of draining surface runoff directly
into inlets without de-pollution treatment is unacceptable. NPDES criteria
could include, but is not limited to, doing one or a combination of the
following: directing surface run-off through vegetated swales prior to
discharge to a storm drain or the public right of way; constructing a
gravel/sand/filter system; constructing de-pollutant basins, etc. For example,
tilt the "True North" southerly half of the parking lot so that surface runoff
drains through a vegetated swale directly south of the parking lot curb line
and then into an inlet. Three foot openings in this curb line could facilitate
drainage into a vegetated swale. It seems that most of the parking area
surface runoff can be directed through vegetated swales. Please be advised,
this is a maior staff issue of concern.
15. Please be advised, at formal application submittal, the following reports will
be required for the proposed project: Traffic, Hydrology, Soils.
In the Traffic Report, specifically address Levels of Service (LOS) for any
intersection that will receive 20% of the proposed project traffic, and,
discuss the "triple rates for Sunday" statement and what impact that has on
local street segments and intersections.
In the Hydrology Report, specifically address the "drainage course
inundation" for a 100-Year storm event. Also, indicate pre and post 10-Year
surface runoff flow (0 in cfs) and velocity (V in fps).
16. Please indicate the project's proposed grading quantities in cubic yards (cy)
of cutlfill and importlexport, and any required remedial grading. Also,
indicate the cylacre of grading for the project.
17. Please be advised, a grading plan and permit will be required for the
proposed project.
18. Please supply documentation from LCWD and Olivenhain Municipal Water
District (OMWD) that they are aware of the proposed project.
19. Please indicate a 42' (Caltrans 407-E) truck turning radius on the site plan
circulating to and from the proposed trash enclosure.

20. Please provide 5' offsets at proposed parking stalls which are located at 90'
adjacent to each other.
21. Please be advised, this property may be located in various Fee Districts.
Depending on the District, the applicant may be required to sign a consent
and waiver agreement for payment of a facilities fee, as well as, pay the
facilities fee, prior to any building permits being issued on the property. The
project's PR should indicate if the property is located. in any applicable Fee
Districts.
22. Please be advised, this preliminary review does not constitute a complete
review of the proposed project, additional items of concern may be identified
upon formal project application submittal.
23. A red-lined check print is enclosed for the applicants use in making the
requested revisions. This check print should be returned with the formal
application submittal to facilitate continued staff review.
