Sprint Nextel is requesting approval of a conditional use permit application to allow the
maintenance, upgrading and continued operation of an unmanned wireless telecommunications
facility on property already authorized for wireless telecommunication use (CUP 0 1-24) in the
City of Carlsbad and presents the following project information for your consideration.

Project Description
Proposed is the removal of two CDMA antennas located with a radome of an existing monopalm
and the reinstallation of one new 4G antenna per sector and the placement of one RRU unit per
new antenna behind existing pipe mounts on the Nextel antenna array arm. One existing radio
equipment cabinet will be removed and replaced with a new 4G equipment cabinet within the
existing equipment enclosure. The cabinets will be placed within an existing ground mounted
equipment enclosure. No change to the number of antennas from the original CUP entitlement
will occur with this project.

Project Objectives
The proposed site maintenance and technology upgrade is intended to provide the residents of
Carlsbad who are served by this facility, the latest in wireless technology by improving call
quality, data transmission and speed.
Alternative Site Analysis
The following locations were evaluated for possible locations for the facility:
NA. Proposed is the modification and maintenance upgrade to an existing Sprint installation
Findings/Burden of Proof
The project site is located in an area containing numerous live palm trees which allows the
subject mono palm to blend with the existing public viewshed. In the over ten years of this sites
existence, Sprint is unaware of any negative visual impact generated by this installation. The
proposed site maintenance will not significantly change the appearance of this facility and
consequently no visual impact is anticipated with project approval.
Wireless telecommunication is now an indispensable part of everyday life and wireless
customers expect to be provided nearly flawless radio coverage at all locations and at all times.
The subject project will provide improved radio coverage, improved data reception and
transmission and improved data download speeds within the surrounding area to the benefit of
the general health, safety, welfare and convenience of the public in the vicinity of this facility. In
addition all the antennas will be screened to match the building architecture.
The proposed project is in conformance with all city General Plan goals by furthering the health,
safety, welfare and convenience of city residents with the improvement and continued operation
of a wireless telecommunication facility in an area of the city currently experiencing diminished
wireless service. The proposed project is in conformance with all Federal Communications
Commission (FCC) regulations and standards for wireless telecommunication facilities as
documented in the attached FCC RF Certification form. All height, site and screening
requirements have been met by this project. The installation is emergency 911 compatible with
all wireless carriers.
Sprint is authorized and regulated by the Federal Communications Commission (FCC) to operate
their wireless systems in the Southern California market area. Transmit power is typically
between 100 to 500 watts per antenna sector, transmitting and receiving at a frequency of 1850.0
-1865.0, and 1930.0-1945.0 MHz. These levels are well below the safety standards established
by the FCC and no health impacts are anticipated with this project in conformance with city
goals for telecommunication uses. In addition, Sprint does not oppose co-location on the subject
building or project site and has left space for additional wireless carriers. This project design
will provide mitigation of future wireless development in the area by allowing for the
concentration of additional facilities at one location, thereby minimizing the spread of these

facilities throughout the community and providing mitigation of the potential visual impact in
more view sensitive locations.
The proposed facility will be unmanned requiring approximately one maintenance visit
per month and will not have any significant impact to existing roadways and on and off
site circulation nor have any impact on the character of existing development in the
neighborhood
Sprint Nextel Company Information
Sprint Nextel is one of the fastest growing nationwide service providers offering all digital voice,
messaging and high-speed data services to nearly 30 million customers in the United States.
Sprint Nextel is a "telephone corporation", licensed by the Federal Communications Commission
(FCC) to operate in the 1850.0 -1865.0, and 1930.0-1945.0 MHz frequencies, and a state-
regulated Public Utility subject to the California Public Utilities Commission (CPUC). The
CPUC has established that the term "telephone corporation" can be extended to wireless carriers,
even though they transmit signals without the use of telephone lines.
Sprint Nextel will continue to operate this facility in full compliance with the regulations and
licensing requirements of the FCC, Federal Aviation Administration (FAA) and the CPUC, as
governed by the Telecommunications Act of 1996, and subsequent modifications, the Middle
Class Tax Relief and Job Creation Act of2012 (Section 6409) and other applicable laws.
The enclosed application is presented for your consideration. Sprint Nextel requests a favorable
determination and approval of a substantial conformance to modify its existing base station.

STORM WATER STANDARDS QUESTIONNAIRE

I INSTRUCTIONS:
This questionnaire must be completed by the applicant in advance of submitting for0af~ele~{rfm~t application
(subdivision and land use planning approvals and construction permits). The re~maf¥~ itilfl~A<ie~rmine
the level of storm water pollution prevention standards applied to a propose e 1t:bl~reJ:>ment
project. Many aspects of project site design are dependent upon the storm wa e !ki>~lStandards
applied to a project.
Applicant responses to the questionnaire represent an initial assessment of the proposed project conditions and
impacts. City staff has responsibility for making the final assessment after submission of the development
application. A staff determination that the development application is subject to more stringent storm water
standards, than initially assessed by the applicant, will result in the return of the development application as
incomplete.
If applicants are unsure about the meaning of a question or need help in determining how to respond to one or
more of the questions, they are advised to seek assistance from Engineering Department Development Services
staff.
A separate completed and signed questionnaire must be submitted for each new development application
submission. Only one completed and signed questionnaire is required when multiple development applications for
the same project are submitted concurrently. In addition to this questionnaire, applicants for construction permits
must also complete, sign and submit a Construction Activity Storm Water Standards Questionnaire.
To address pollutants that may be generated from new development, the City requires that new development and
significant redevelopment priority projects incorporate Permanent Storm Water Best Management Practices
(BMPs) into the project design, which are described in Chapter 2 of the City's Storm Water Standards Manual This
questionnaire should be used to categorize new development and significant redevelopment projects as priority or
non-priority, to determine what level of storm water standards are required or if the project is exempt.
I 1. Is your project a significant redevelopment?
Definition:
Significant redevelopment is defined as the creation, addition or replacement of at least 5, 000 square feet of
impervious surface on an already existing developed site.
Significant redevelopment includes, but is not limited to: the expansion of a building footprint; addition to or
replacement of a structure; structural development including an increase in gross floor area and/or exterior
construction remodeling; replacement of an impervious surface that is not part of a routine maintenance activity;
and land disturbing activities related with structural or impervious surfaces. Replacement of impervious surfaces
includes any activity that is not part of a routine maintenance activity where impervious material(s) are removed,
exposing underlying soil during construction.
Note: If the Significant Redevelopment results in an increase of less than fifty percent of the impervious surfaces of
a previously existing development, and the existing development was not subject to SUSMP requirements, the
numeric sizing criteria discussed in Table 3 of 2.3.3.4 applies only to the addition, and not to the entire
development.

located on Nextel's monopalm approved under CUP 00-32.
Dear Mr. Godwin:
ProjectDesign Consultants (PDC), on behalf of Sprint PCS, is submitting this application
requesting a CUP, SUP and a CDP to modify an existing telecommunications site located
at 4901 El Camino Real, Carlsbad, CA. Sprint PCS currently operates a
telecommunications facility at this location pursuant to CUP 96-05/HDP 96-07/SUP 96-05
which was issued to Cox Communications PCS who is now a subsidiary of Sprint PCS.
The permits for the existing facility expire on December 4, 2001. In discussions with City
staff about obtaining an extension of the existing permits, PDC was informed that the City
would require Sprint to modify its existing facility to become a stealth facility. Pursuant to
the City's direction, Sprint will be removing the existing 6 poles and collocating on
Nextel's monopalm which was approved under CUP 00-32/SUP 00-11/CDP 00-58.
Sprint's existing equipment will remain in the same location. However, the shelter will be
modified to comply with City code and to match the existing building and Nextel's
equipment enclosure.

APPLICATION NARRATIVE FOR
CONDITIONAL USE PERMIT, SPECIAL PERMIT, and COASTAL PERMIT
I. INTRODUCTION
This application is a request for a Conditional Use Permit, Special Use Permit, and
Coastal Development Permit to allow the relocation of an existing unmanned,
telecommunications facility. The new facility will consist of co-locating four panel
antennas within the trunk of a Nextel's recently approved 30 foot monopalm (CUP 00-
32/SUP 00-11/CDP 00-58). Minor modifications are proposed to the existing equipment
enclosure.
II. SITE DESCRIPTION
The project site is located at 4901 El Camino Real, at the top of the slope behind the
Marja Acres Country Store. The site consists of two parcels--5.2 acres zoned C-2 and
16.4 acres zoned R-A-10--a small portion of which will be the lease area. The Mruja
Acres commercial center is located on the commercial site. The residential parcel
consists of a single family home and undeveloped residential/agricultural lands on the
hillside just south of the commercial property. The project site is surrounded by
agricultural fields to the south, a palm nursery to the west and a mobile home park to the
east. El Camino Real is located approximately 300 feet north of the site. The property
currently supports sites for two unmanned telecommunications facilities, Pac Bell and
Sprint. A third carrier, Nextel, was recently approved to construct a monopalm on the
site.
III. PROJECT DESCRIPTION AND BACKGROUND
Sprint PCS operates a telecommunications facility on this site under CUP 96-05/HDP 96-
07/SUP 96-05, which was approved December 4, 1996 and expires December 4, 2001.
Sprint's existing facility consists of six panel antennas mounted on individual poles, one
global positioning antenna, and six ground-mounted equipment cabinets. Also located on
this site is a Pac Bell monopole. A third facility was recently approved for Nextel.
Sprint, in its desire to extend CUP 96-05 beyond its December 2001 expiration date, is
required to modify the facility making it a more stealth design. In order to reduce the
visual impact of multiple carriers on the site, the City required Nextel to design its
monopalm to accommodate a second carrier. Sprint will relocate its antennas onto the
new monopalm and co-locate with Nextel. Additionally, the existing Sprint equipment
cabinet straddles a zoning line and has been redesigned to conform to City code.
The proposed telecommunication facility consists of four panel antennas mounted within
the trunk, or of a 30 foot faux palm tree/monopalm. Four 56" antennas will be
completely concealed inside the monopalm trunk. The base transceiver station (BTS)

equipment is currently located in an equipment enclosure at the base of the slope,
adjacent to the commercial parking area. The existing equipment cabinet was
constructed across a zoning line and has been redesigned to locate the equipment
enclosure entirely within the commercial parcel. In addition, the existing equipment
cabinet will be modified to include a trash enclosure for the existing commercial building
located on the parcel and the facade will be modified to match the existing commercial
building and the proposed Nextel equipment enclosure.

Development Coordinating Committee (DCC) meeting which will be held on April 27, 2009. A twenty

This is in response to your request regarding the Sprint Nextel wireless
telecommunications facility (Sprint Nextel Site No. SD25XC154) located at 4901 El
Camino Real, Carlsbad, CA 92008.
Sprint Nextel designs, constructs and operates its wireless telecommunications
facilities to comply with the Federal Communications Commission ("FCC") rules and
regulations governing human exposure to radiofrequency ("RF") emissions.
For your information, on February 19, 2009, Sprint Nextel hired a third party
vendor to perform a RF emission survey at the above mentioned address, the maximum
reading of RF emissions encountered on the ground near our monopalm, was less than
1% of the "General Population (Uncontrolled) Standard." A wireless
telecommunications facility is considered "compliant" with the FCC's maximum
permissible exposure regulations if the readings are equal to or less than 1 00% of the
standard.

1. On a recent site inspection, it was observed that the approved mono-palm and
landscaping have not been maintained consistent with Performance Guideline No. 2 of
the City Council Policy 64. Therefore, to remain in compliance with this policy, please
perform the following:
a. Remove all weeds and debris around the equipment building.
b. Replace all damaged or decaying plants. Replaceme-nt landscaping that
provides facility screening should be as much as possible, of similar size
(including height), type and screening capability as the same type of planting of
the plant(s) being replaced.
c. Trim all vines and bushes to keep landscaping in good condition.

second list is issues of concern to staff. When all required materials are submitted the City has 30
days to make a determination of completeness. If the application is determined to be complete,
processing for a_decision on the application will be initiated. In addition, please note that you have
six months from the date the application was initially filed, May 13, 2008, to either resubmit the
application or submit the required information. Failure to resubmit the application or to submit the
materials necessary to determine your application complete shall be deemed to constitute
withdrawal of the application. If an application is withdrawn or deemed withdrawn, a new application
must be submitted.

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION
Planning:
1. Please submit five (5) copies of an updated site plan, landscaping plan and building
elevations and floor plans (see attached form for more information).
2. Please submit an updated description or map of the applicant's existing and other proposed
sites within the City of Carlsbad.
3. Please submit an updated description of the existing wireless system and its consumer
features (e.g., voice, video, and data transmissions).
4. Please submit verification that the WCF is in compliance with FCC Guidelines. With each
time extension or amendment request, the developer/operator shall submit to the Planning
Director either verification that the WCF is categorically excluded from having to determine
compliance with the guidelines per 47 CFR Section 1.1307(b)(1) or a project implementation
report that provides cumulative field measurements of radio frequency (RF) electromagnetic
fields of all antennas installed at the subject site. The report should quantify the RF
emissions and compare the results with currently accepted ANSI/IEEE standards as
specified by the FCC. The Planning Director should review the report for consistency with
the project's preliminary proposal report submitted with the initial project application and the
accepted ANSI/IEEE standards. ff, on review, the Planning Director finds the project does
not meet ANSI/IEEE standards, the city may revoke or modify the conditional use permit.
Engineering:
5. Submit a completed Stormwater Standard Questionnaire. The form can be printed from
http://www.carlsbadca.gov/engineering/chklstpdf/stormwater:..qstnn.pdf.

ISSUES OF CONCERN
Planning:
1. The approved Coastal Development Permit (COP 01-33) and the Special Use Permit (SUP
01-07) do not require extensions as the Wireless Communications Facility (WCF) already
exists. Please submit a. letter of withdraw for COP 01-33x1 and SUP 01-07x1 to your project
planner at your earliest convenience. Once the letter is submitted, the applications will be
withdrawn and the associated fees shall be refunded and mailed to the payee within 3-4
weeks.
2. The proposed Wireless Communication Facility is located in a discouraged location as listed
in Location Guidelines for Placement of WCFs (See Guideline A.2.b) of the City's WCF
Policy (Policy 64). For WCFs proposed in a zone or area that is a discouraged WCF
location, the applicant must provide evidence that no location in a preferred zone or area
(See Guideline A.1) can accommodate the applicant's proposed facility (See Guideline 0.2).
Evidence should document that preferred zone or area locations still do not meet
engineering, coverage, location, or height requirements, or have other unsuitable limitations.
Please provide the appropriate documents so that the City has sufficient information to

review and make a decision on the proposed extension. As a reminder, the City may require
that the submitted "evidence" supporting the proposed location be reviewed by a Third Party.
If so, the application will remain incomplete until the Third Party review has been completed
and the applicant will be responsible for paying the costs of the Third Party review. Please
submit a feasibility analysis of alternative locations within the general area of the existing
WCF including the following locations: The commercially zoned property owned by Mr.
and Mrs. Hofman, east of the wireless facility and west of El Camino Real and the
closest cell site within a preferred location for collocation. With this analysis please
include the following:
a. Written justification for not proposing the cell site at these locations.
b. A coverage exhibit showing the existing coverage at the Yglesia Residence and
surrounding cell sites. The exhibit shall include a legend indicating excellent, good,
poor, and no coverage.
c. A coverage exhibit for each alternative site showing coverage at the cell site and
surrounding existing cell sites. The exhibit shall include a legend indicating excellent,
good, poor, and no coverage as well as the height and elevation of the alternative
cell site.
d. A photo exhibit of the existing telecommunications site. The mono-palm, live palm
trees, and the equipment shelters should be called out on this photo exhibit.
e. Any other exhibits providing justification for the cell site being located in a
discouraged area.

Dear Ms. Johns:
The above referenced project was approved by the City of Carlsbad on April 3, 2002.
Condition number 15 of Planning Commission Resolution No. 5163 requires submittal of
an RF study within 6 months of project installation. Specifically:
Developer/Operator shall comply with the Federal Communication Commission's
guidelines on limits for human exposure to radio frequency (RF) electromagnetic
fields. Within six (6) months after the issuance of occupancy, and with any time
extension or amendment request, the Developer/Operator shall submit to the
Planning Director either (1) verification that the project is categorically excluded
from having to determine compliance with the RF exposure guidelines per 47
CFR §1.1307(b)(l); or (2) a project implementation report which provides
cumulative field measurements of RF emissions of all antennas installed at the
subject site. The report shall quantify the RF emissions and compare the results
with the exposure limits established by the FCC guidelines. Said report shall be
subject to review and approval by the Planning Director for consistency with the
Project's preliminary report on RF exposure submitted with the initial project
application and for consistency with the FCC guidelines. If on review, the City
finds that the Project does not meet the FCC guidelines, the City may revoke or
modify this conditional use permit.
Our records indicate that this study has not yet been provided. Please submit this study
as soon as possible to avoid violating the conditions of approval for the project. If you

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Department has
reviewed your Conditional Use Permit, Special Use Permit, and Coastal Development Permit,
application no. CUP 01-24/SUP 01-07/CDP 01-32, as to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information
which must be submitted to complete your application. This list of items must be submitted directly
to your staff planner by appointment. All list items must be submitted simultaneously and a copy of
this list must be included with your submittals. No processing of your application can occur until
the application is determined to be complete. The second list is issues of concern to staff. When
all required materials are submitted the City has 30 days to make a determination of completeness.
If the application is determined to be complete, processing for a decision on the application will be
initiated. In addition, please note that you have six months from the date the application was
initially filed, August 31, 2001, to either resubmit the application or submit the required information.
Failure to resubmit the application or to submit the materials necessary to determine your
application complete shall be deemed to constitute withdrawal of the application. If an application
is withdrawn or deemed withdrawn, a new application must be submitted.

Planning:
1. The plans need to show the location/configuration of the Nextel equipment building as
approved by the building permits. The original plans were slightly revised to allow for
ground-mounted ac units between your enclosure and Nextel's enclosure. The location of
your proposed concrete swale will need to be modified so that it does not drain into the ac
equipment area.
2. Please ~ubmit a letter which discusses the cumulative RF impacts from the multiple cellular
facilities at the site. Indicate what the actual levels are and what the acceptable threshold
is.
3. Please submit a current preliminary title report for the property.
Engineering:
1 . Please submit an application to Quit Claim the open space easement around the existing
Sprint antennas.
ISSUES OF CONCERN
Planning:
1 . My original direction to you was to design the enclosure so that it would match the Nextel
enclosure. The enclosure needs to be designed with siding, roofing and an overall height to
match Nextel's enclosure. The difference would be that there would not be a rear wall on
your enclosure. I don't believe that the trash enclosure will add to the desired look of the
building. Therefore, it is suggested that you move the trash enclosure to the south. The
trash enclosure should be designed to meet the City standard drawing (see attached).
Landscaping will need to be added around the building to match the landscape around the
Nextel enclosure.
2. Dimension the width of the drive aisle between the wall of the trash enclosure and the
Marja Acres building. Please dimension the length of the enclosure.
3. Please note on the plans that the Sprint poles will be removed.
4. Delete the reference to chainlink gates on page A-3.
Engineering:
Engineering staff did not have any comments to add to the project. However, please note that the
following conditions will be incorporated into the approving resolution.
1 . Prior to the issuance of building permit(s), the applicant shall submit with building plans an
erosion control plan for City Engineer approval.
2. The facilities or appurtenance shall not be constructed on any easement without the
easement holder's permission.
3. The satellite antenna or appurtenance shall not be constructed in any drainage area or over
any drainage structure.

SUBJECT: Submittal of Required EMF (ElectroMagnetic Fields) Report on
CUP 96-05-Marja Acres PCS Facility
Dear Mr. Holzmiller:
ProjectDesign Consultants, on behalf of Sprint PCS, is submitting an ElectroMagnetic
Fields (EMF) report as required under Conditional Use Permit (CUP) 96-05, issued on
December 4, 1996 for the approval of a wireless communication facility at 4901 El
Camino Real, Carlsbad. CUP 96-05 was issued to Cox California PCS, Inc., who is now a
subsidiary of Sprint PCS. A copy of CUP 96-05 is attached for your reference.
Condition 11 of CUP 96-05 required Sprint, as the developer/operator of this facility, to
"comply with ANSI/IEEE standards for EMF emissions," and to, "within six (6) months
after the issuance of occupancy, and annually thereafter, ... submit a project
implementation report which provides cumulative field measurements of radio frequency
(EMF) power densities of all antennas installed at the subject site." The condition further
required that the report "be subject to review and approval by the Planning Director for
consistency with the Project's preliminary proposal report and the accepted ANSI/IEEE
standards."
Sprint PCS recently realized that the EMF report had not been completed as required. They
immediately retained the services of a consulting engineer to complete the report, Hammett
& Edison, Inc., who evaluated the existing PCS base station at this site on May 23, 2001.
Based on information and analysis described in this report, Hammett & Edison has
determined "that the base station installed by Sprint PCS at 4901 El Camino Real in
Carlsbad, California, complies with the FCC guidelines limiting public exposure to radio
frequency energy."

Statement of Hammett & Edison, Inc., Consulting Engineers
The firm of Hammett & Edison, Inc., Consulting Engineers, has been retained on behalf of Sprint
PCS, a personal wireless telecommunications carrier, to evaluate the existing PCS base station
located on a hillside at 4901 El Camino Real in Carlsbad, California (Site No. SD03xcl54), for
compliance with appropriate guidelines limiting human exposure to radio frequency electromagnetic
fields.
Prevailing Exposure Standards
The U.S. Congress requires that the Federal Communications Commission ("FCC") evaluate its
actions for possible significant impact on the environment. In Docket 93-62, effective October 15,
1997, the FCC adopted the human exposure limits for field strength and power density
recommended in Report No. 86, "Biological Effects and Exposure Criteria for Radiofrequency
Electromagnetic Fields," published in 1986 by the Congressionally chartered National Council on
Radiation Protection and Measurements ("NCRP"). A summary of the exposure limits contained
in NCRP-86 is shown in Figure 1. Separate limits apply for occupational and public exposure
conditions, with the latter limits generally five times more restrictive. The more recent Institute of
Electrical and Electronics Engineers ("IEEE") Standard C95.1-1999, "Safety Levels with Respect
to Human Exposure to Radio Frequency Electromagnetic Fields, 3 kHz to 300 GHz," includes
nearly identical exposure limits. These limits apply for continuous exposures and are intended to
provide a prudent margin of safety for all persons, regardless of age, gender, size, or health.
The most restrictive threshold for exposures of unlimited duration to radio frequency ("RF")
energy from PCS transmissions near 1,900 MHz is 1.0 m.W/cm2, applying in areas for which access
by the general public is uncontrolled.
General Facility Requirements
Antennas for base station use are designed to concentrate their energy toward the horizon, with
very little energy wasted toward the sky or the ground. Along with the low power of such
facilities, this means that it is generally not possible for exposure conditions to approach the FCC
limits without being physically very near the antennas.
Site Description
The site was visited by the undersigned engineer on May 23, 2001. Sprint (formerly Cox
Communications) had installed at the top of approximately 23-foot poles two sets of directional

panel antennas (6 antennas total, mounted atop 6 poles). Another personal wireless carrier has
installed base station antennas atop a single monopole, located about 500 feet distant.
Measurement Results
The measurement equipment used was a Wandel & Goltermann Model EMR-300 Radiation Meter
(Serial No. P-0008) with a Type 8 Isotropic Electric Field Probe (Serial No. P-0036). Both meter
and probe were under current calibration by the manufacturer. Access to the areas surrounding the
poles, including their bases, is controlled by a locked gate. The maximum observed power density
level measured at any publicly accessible location was in the parking lot behind Marja Acres gift
shop, which was 0.017% of the applicable public limit (i.e., over 5,800 times below).
The bases of the poles are fenced and cannot be easily climbed. Power density measurements
were not conducted at the antennas themselves, since it can be assumed that such access is likely
only for Sprint employees, for whom it is presumed that adequate training has been provided.
Conclusion
Based on the information and analysis above, it is the undersigned's professional opinion that the
base station installed by Sprint PCS at 4901 El Camino Real in Carlsbad, California, complies with
the FCC guidelines limiting public exposure to radio frequency energy and, therefore, does not for
this reason cause a significant impact on the environment.
