Subject: National University Conditional Use Permit Application
Dear Project Planner:
A preliminary review, PRE 01-63, was conducted for the above-referenced project on
October 31, 2001. Per Staffs direction, a Conditional Use Permit and Minor Coastal
Development Permit applications have been prepared for the proposed operation of a
branch of National University at 705 Palomar Airport Road. To further address the
issues and concerns raised in the preliminary review letter, an acoustical compliance
survey and a traffic impact analysis were conducted for the proposed use. Copies of both
reports are included with the application and their findings summarized below.
The 1994 Comprehensive Land Use Plan for the McClellan-Palomar Airport establishes
45 dBA as the interior noise limit for schools, preschools, and libraries, and 50 dBA for
office buildings housing business, educational, professional, and personal services.
Although National University is an adult learning facility closer in nature to an
educational service than a school in the same category as a preschool and library, the
acoustical study has determined that the interior noise levels do not exceed 45dBA for
those portions of the building proposed to be occupied by National University.
The traffic impact analysis evaluated the evening peak period at the project site and on-
site parking. The report concluded that there is sufficient storage capacity to
accommodate the forecast northbound left turn movement at Avenida Encinas and
Palomar Airport Road intersection for buildout conditions. However, an additional 125
feet of storage capacity is required to accommodate the southbound left-turn movement
into the project site. Although the tendency of motorists will he to seek out the least
congested route with the fewest traffic signals, in this case, Poinsettia Lane to Avenida
Encinas northbound with a right turn into the project site, an extension of the
southbound left turn pocket is recommended by the traffic consultant based on the
observed p.m. peak hour demand.
In the preliminary review comments, Staff determined that there was a surplus of one
I parking space available during the regular (daytime) business hours for the Phase III
portion of the Carlsbad Pacific Center, if the 50% nighttime use reduction was applied to
the parking requirement for National University. Staff was uncertain as to the availability
or status of a joint use parking agreement for the entire Carlsbad Pacific Center (Phases 1,
IL and III), and evaluated the parking based on only that portion of the parking area
specifically associated with the SDP approving the Phase III portion of the complex. Staff
recommended that the subject application include a draft agreement.
The Covenants, Conditions, and Restrictions (CC&Rs) for the Carlsbad Pacific Center
are included with the application submittal. The CC&Rs include provisions for
reciprocal easements over the parking area shared by 701, 703, and 705 Palomar Airport
Road. Sections 2.03 (a) (p. 13) and (c) (p. 15) and section 2.10 (p. 17) of the CC&Rs
permit any tenant to park vehicles associated with his or her use anywhere within the on-
site lot. The purpose of a joint use parking agreement is therefore achieved through the
CC&Rs.
In addition, the parking component of the traffic study determined that during the period
of time when National University and the existing office uses would overlap, there is a
maximum Utilization of 30% of the parking available to the Carlsbad Pacific Center,
which includes 701, 703, and 705 Palomar Airport Road. Consequently, between 4:45
and 5:30pm, there are approximately 330 to 390 empty spaces in the shared parking lot.
The total parking demand for National University during its regular business hours of
5:30pm to 10:30pm is 134 spaces. Given the surplus parking situation during the overlap
period and the existing reciprocal easements, a parking conflict appears to he unlikely.
All other concerns and issues raised in the preliminary review have been addressed the
standard sections of the Conditional Use Permit application. If you have any questions

PROJECT DESCRIPTION
The project under consideration is a Conditional Use Permit for the operation of a branch
of National University within a portion of the building located at 705 Palomar Airport
Road in Carlsbad. A Conditional Use Permit is required for the operation of a private
school within the M zone. The structure wherein National University proposes to locate
was approved as Phase III of the Carlsbad Pacific Center under SDP 98-23 and CDP 98-
89. The Carlsbad Pacific Center is owned and managed by Prentiss Properties.
National University is a non-profit accredited institution of higher education with
facilities throughout California, offering both undergraduate and graduate program
opportunities to a diverse population of adult learners. It is anticipated that the enrolled
students attending the Carlsbad facility will be adults, many with full-time 9-5 jobs,
seeking career or personal advancement through the pursuit of a college degree.
The Carlsbad branch of National University will occupy approximately 18,000 square
feet of the 41,000 square foot Phase III building, utilizing approximately 4,555 square
feet on the first floor and the entire 13,445 square feet of the second floor. The remaining
space on the first floor and the entire third floor of the building will remain available for
other uses.
The proposed facility is anticipated to serve approximate 320 students each evening,
Monday through Thursday, from 5:30pm to 10:30pm, and Saturdays from 8:30am to
5:30pm. Fields of study taught by National University and proposed for the Carlsbad
facility include business, technology (computer systems and software), education, liberal
arts, human behavior, and public administration. Instruction will take place within
classrooms constructed pursuant to tenant improvement plans approved by the City of
Carlsbad Building Department.
Approximately 25 to 27 National University personnel will be present during class times
to serve as instructors and clerical support. A lesser number of personnel will be present
in the building during the day, on an as-needed basis, to attend to support activities and
scheduling. Daytime classes for National University are proposed for Saturday only, as
this is the most convenient time for daytime attendance by the typical National University
student.
National University students and staff will use the existing on-site parking lot during the
facility's hours of operation. Based on the Carlsbad Zoning Ordinance's parking
standards for a college and the nighttime use reduction, the total parking demand for both
National University and the future use within the Phase III building is 163 spaces. The
parking lot associated with Phase II! includes 164 spaces, and the entire Carlsbad Pacific
Center parking lot, including the Phase III portion, contains 486 spaces. Existing
reciprocal parking agreements contained in the attached Covenants, Conditions, and
Restrictions (CC&Rs) for the Carlsbad Pacific Center allow joint use of the entire
parking lot by all tenants in the complex.

The Conditional Use Permit sought is necessary for the operation of a private school
within the M zone. Staff has determined that the proposed use also represents an
intensification of use at the site, which is currently occupied by office uses, including
professional and administrative services. (A list of existing tenants in the 701 and 703
building is attached.) A request for a minor Coastal Development Permit is included in
the application as a companion to the CUP application.
