Development costing $60,000 or more does not qualify as a Minor Coastal
Development Permit. The Planning Director shall make the final determination
regarding a project's cost of development.
The primary basis for determining cost of development will be the application of
dollar costs per square foot for different types of residential construction. These
costs are set by the International Conference of Building Officials (ICBO) and
are applied throughout San Diego County.

PROJECT DESCRIPTION/EXPLANATION
PROJECT NAME: Vigilucci's Seafood & Steakhouse
APPLICANT NAME: Roberto Vigilucci
Please describe fully the proposed project. Include any details necessary to adequately
explain the scope and/or operation of the proposed project. You may also include any
background information and supporting statements regarding the reasons for, or
appropriateness of, the application. Use an addendum sheet if necessary.
Description/Explanation:
The proposed project consists of a Conditional Use Permit and Coastal Development Permit for
the purposes of remodeling the existing restaurant at the northeast corner of Tamarack Avenue
and Carlsbad Boulevard. The property is approximately 0.318 acre and will be accessed from
Tamarack Avenue by the existing driveway. The purpose of the enclosed applications is to satisfy
the conditions of the agreement between Roberto Vigilucci, the owner of the property, and the
City of Carlsbad that was entered into on April 3, 2002. Per the agreement, Mr. \'igilucci must
submit a complete application for a Conditional Use Permit and a Coastal Development Permit
within five months of the date of the agreement.
The proposed remodel includes interior improvements, such as replacement of windows/doors,
adding new walls, expanding the kitchen and food preparation areas, and changing the customer
seating areas. The remodel also includes exterior improvements, per the addendum to the
previous agreement on June 6, 2002, which consists of stuccoing or painting the building exterior,
installing new signs and awnings, and performing front planter landscape changes. The above
items are currently under construction at the site per the building permit issued by the City of
Carlsbad in conjunction with the aforementioned agreement.
Included as a part of the attached application for review by the City is a request for an awning
and outdoor dining area on the existing patio along the west side of the building.

Request for Reconveyance be surrendered prior to close of escrow. To avoid potential delays, please
forward said document at least one week prior to close.
NOTE B: Section 12413.1, California Insurance Code, commonly known as Assembly Bill 512, became
effective January 1, 1990. This legislation deals with disbursement of funds deposited with any title
entity acting in an escrow or subescrow capacity. The law requires that all funds deposited and collected
by the title entity's escrow and/or subescrow account prior to disbursement of any funds. Some methods
of funding may subject funds to a holding period which must expire before any funds may be disbursed,
In order to avoid any such delays, all funding should be done through wire transfer, certified check or
checks drawn on California financial institutions.
NOTE C: On July 1, 1985, Assembly Bill 3132 became effective. Assembly Bill 3132 adds and repeals
portions of Sections 480.3 and 480.4 of the Revenue and Taxation Code of the State of California.
The act requires the County Assessor and/or Recorder to make available a statutorily prescribed form
entitled "Preliminary Change of Ownership Report". Said report must be completed by the buyer and
filed concurrently with the recordation of the documents evidencing the change of ownership. Failure to
present the Change of Ownership Report at the time of recordation will cause the County Recorder to
charge an additional S20.00 penalty recording fee. The fee cannot be charged if the transfer document is
accompanied by the affidavit stating that the buyer/transferee is not a resident of the State of California.
