This is a courtesy notice to inform you that the Conditional Use Permit (CUP) for CUP 05-04-Biltmore, located on
the south side of Palomar Airport Road between Aviara Parkway and Palomar Oaks Road, will expire on May 3,
2015. Should you, the property owner, wish to extend this permit, you will need to submit a complete application
(applications and forms may be obtained at
http://www.carlsbadca.gov/services/departments/planning/Pages/applications.aspx or our front counter)
consisting of the following:
./ Written request for an extension;
v' Completed Disclosure Statement;
v' Land Use Review Application;
v' Development Permits form;
v' A check in the amount of totaling all application fees; and
v' One complete set of plans (may be copies of those already approved).
Once we receive and review your application, we may request more information to complete the application.

event your permit expires and you subsequently apply for a new permit, the application would again be subject to
the full discretionary review process of the designated decision-making authority (Planning Commission and/or
City Council). This means the application may be approved, approved with conditions, or denied based on the
review process and findings of the decision-making authority.

Dear Mr. Singh, I am with the Planning Department at the City of Carlsbad. The City issued a Conditional Use Permit
(attached CUP 05-04) for the 24 Hr fitness facility in May of 2005. The City conducts annual reviews of Conditional Use
Permits as per condition Number 8 of the CUP. Part of the annual review is to gather contact information to keep our
records up to date. The City will send notices when the CUP is about to expire (May 2015) and needs accurate
information for proper noticing. The property owner will also be noticed and it appears as though the 24 Hr owns the
property, in the past I have contacted Nina Reay with Fancher Development. She has not responded to my emails. If
you are not the appropriate contact, please let me know who may be better suited to be the contact entity. The City
understands there is a parking arrangement with the adjacent property owner for overflow parking. The City has
requested in the past information or plans on how the adequacy of parking will be managed in the future and this has
not been addressed at this time. Otherwise, the City does not have any issues with the faciiity at this time.

Nina: Thanks for the reply. The City of Carlsbad monitors the issuance of Conditional Use Pennits for the project's
compliance with their conditions of approval on an annual basis. The 24 Hour facility on Carlsbad was reviewed and it
is noted that there is overflow parking occurring on the adjacent lot. Our concem is that when the adjacent lot develops,
where or how is 24 Hour going to address their parking demand. Presently we also understand that the Corporate
office employees may be parking off site and shuttling in employees to free up parking for patrons. 24 Hour has also
approached the City with security concerns and the desire to add lighting on the overflow area. The City is not
supportive of allowing off site improvement, even if temporary, to further facilitate their parking issues.
What the City is looking for is the acknowledgment of a parking concem and the ability to identify and implement a plan
to address parking in the fiiture. There were pervious discussions regarding adding a new parking lot southwesterly of
the site, but I have not heard anj^hing for sometime.

Dear Mr. McPhail:
The City is in receipt of your request to administratively extend the Conditional Use Permit (CUP
05-04) for the operation of the 24 Hour Fitness facility located at 1265 Laurel Tree Lane,
Carlsbad.
The Municipal Code does allow for the Planning Director to administratively approval GUP
extensions, however the fitness facility is very new and does not have a history as to how the
facility will operate within the parameters of the Use Permit. The City does not automatically
extend permits until they have reached their expiration date or have shown to be compatible
with and do not have any impacts on surrounding uses. At the time of the extension, the CUP
would be extended in perpetuity if there have been no operational issues with the facility.
The City understands that the 24 Hour Fitness facility is very popular as shown by the large
attendance. As a result, parking for the site is rather tight and there is a potential for parking
issues. The City has been working with 24 Hour Fitness to resolve the short term parking
demands and that 24 Hour Fitness/Biltmore are exploring parking alternatives. It is issues such
as the parking which are the reason that the City would be hesitant to prematurely extend the
Use Permit in perpetuity at this time. The City would request that the 10 year permit run the full
period of time prior to an extension.
The administrative extension of Use Permits is to preclude the project from having to go through
the formal Planning Commission hearing process for an extension. The Planning Director
reserves the right to determine which Use Permits qualify for extensions in perpetuity after a
review of the project's performance.

Dear Mr. Neu:
24 Hour Fitness USA, Inc., a Califomia corporation ("24 Hour Fitness") and Ascent-
Biltmore Carlsbad, LLC, a Delaware limited liability company ("Landlord") have entered a
lease, dated May 3, 2005 (the "Lease"), for the operation of a 24 Hour Fitness health club facility
at 1265 Laurel Tree Lane, Carlsbad (the "Club"). The initial Lease term is 15 years, and
24 Hour Fitness has four (4) options to extend the Lease, each for a period of five years. The
Lease term commenced in 2007. In order to allow 24 Hour Fitness to operate the Club for the
uses permitted under the Lease, Landlord applied for and, pursuant to Planning Commission
Resolution No. 5883, obtained a ten year conditional use permit, dated May 4, 2005 (the
"CUP").
In January 2006, the City of Carlsbad revised its zoning code to provide that existing
conditional use pennits that are subject to expiration unless extended pursuant to a hearing
before the planning commission "may be hereby approved administratively by the planning
director in perpetuity without the requirement to extend the conditional use permit." (See
Carlsbad Municipal Code ("CMC") 21.42.110(D).) Pursuant to this code section,
24 Hour Fitness and Landlord hereby request that the Planning Department administratively
approve the extension of the CUP in perpetuity.
The adoption of CMC 21.42.110(D) was intended to allow the Planning Director to
provide assurances and stability to property owners and users, which is exactly what
24 Hour Fitness and Landlord are seeking. 24 Hour Fitness and Landlord have made a large
commitment to the Carlsbad community, and certainly want this commitment to be long term.
