VALIDITY OF CONDITIONAL USE PERMIT 103 FOR LAS FLORES CHURCH OF
THE NAZARENE
Dear Mr. Worley:
Last month, you and other Las Flores Church representatives met with the Mayor and
city staff. The meeting focused on the church’s concerns regarding the Planning
Department position, as noted in a preliminary review letter on a proposed church
expansion, that the church’s conditional use permit was null and void. To clarify the
question of validity, the Mayor requested at the meeting that staff consult with the city
attorney.
As directed, staff requested and received legal advice from the city attorney. The city
attorney has determined the following about the status of the Church’s conditional use
permit:
Conditional Use Permit (CUP) 103 is valid as to the existing church
As to the phases of the church for which construction was not commenced
sanctuary and is not subject to abatement.
within the time frames specified in condition 14 of CUP 103, the CUP has
automatically expired. Therefore, the church must make a new application
to proceed with construction of additional phases.
Based on the city attorney’s determination, a proposed expansion of Las Flores Church
will require filing of an application to amend CUP 103 instead of filing an application for
a new CUP. Should you have questions on the filing of a CUP amendment, please
contact the planning counter at (760) 602-4610. Furthermore, other than the position
that CUP 103 is invalid, all comments contained in the December 22, 2000, preliminary
review letter on the church expansion (case number PRE 00-82) still apply.
