Re: Lot 1, Tentative Tract 71-2
Gentlemen:
. Since our meeting of September 12, 1974, and your letter
dated September 13, 1974, we have reviewed the various resolutions
beginning November 25, 1969 adopted by the City of Carlsbad'relative
to the development of the property located in Tentative Tract 71-2
through the City's most recent action in e,xtending Tentative Tract 71-2
in the spring of this year.
Use Permit granted originally to H. B. Development Company for the
construction of mobile home parks located on Lots 1, 5 and 6 of Tentative
Tract 71-2, also known as Site Plans A-1 and A-2.
Included in our review was the Conditional
. Based on our review of this information and City Attorney Lewis :
A. Moe's letter of March 23, 1971, and extensive discussions with several
of the parties who were involved in the original hearings on the H. B.
Development Company projects, it is still our firm conclusion that the intent
was that the property under Conditional Use Permit Resolution No. 646
dated November 25, 1969, be developed in phases. This is further sub-
stantiated by the fact that Resolution No. 646 contains 17 conditions relative
to the construction of the mobile home parks which are, by their very nature,
a part of the total spccific plan which was approved for M. B. Development
Company on January 6, 1970, In addition, we have been informed that the
City has extended the Conditional Use Permit on two separate occasions at
the request of Sequoia Pacific Rcalco. We would also like to point out that
said Conditional Use Permit specifically includes all of the property located

in Lots 1, 5 and 6 (Site Plans A-1 and A-2).
Therefore, in accordance with your letter of Septembkr
13, 1974, that Sequoia Pacific's development program for their
portions of the mobile home parks could be established in phases
because time is a factor in completion, there seems to be no valid
reason why this should not equally apply to the entire mobile home
park property. If, in fact, Sequoia Pacific's property was phased
due to time being a factor in completion of their mobile home park
pursuant to Resolution No. 646, this would remain true in regards to
our property as both properties are covered by said Resolution No. 646.
Therefore, we.can see no reason why the City of Carlsbad
would withhold the issuance of the necessary permits to enable us to
proceed with the development of our mobile home pzrk.
the above, you do not feel that you can au"chorize the members of your
staff to issue those permits necessary to enable us to proceed with the
development, we respectfully request this matter be referred to the
City Council for clarification at which time we would be prepared to
introauce any and all testimony necessary to support our position as
contained her e in.
