APPLICANT: CITY OF CARLSBAD
REQUEST: APPROVAL OF A CONDITIONAL USE PERMIT FOR A PUBLIC BUILDING, AS AUTHORIZED BY SECTION 21.42.010 (21) OF THE MUNICIPAL CODE. THE BUILDING WILL BE USED FOR MEETINGS AND ASSEMBLY PURPOSES.
BACKGROUND REPORT
LOCATION AND DESCRIPTION OF PROPERTY: The 2.1-acre site is located north of Beech Avenue between Garfield Street and Carlsbad Blvd. The site is flat, with a handful of old trees scattered over the site. The Magee House and three out- buildings are located on the site.

PAST HISTORY AND RELATED CASES:
The Magee House and its grounds were offered to the City in the Last Will and Testament of Mrs. Florence Magee. City Council accepted the bequest May 21, 1974 (Res. 3423), for use as a meeting place and a park. Council retained the archi- tectural firm of Environment Design and Graphics to prepare renovation plans for the building. These plans have been completed and approved by 'Council. Exhibits B and C are part of those plans.
ENVIRONMENTAL IMPACT INFORMATION: A negative Declaration of -€nvironmental Impact was prepared by the County in connection
with its administration of the Community Development Block Grant Program. Restoration of Magee House will be funded
through that Program. The Negative Declaration was granted for
the following reasons:
1) This project proposes no grading or alteration of the
existing topography; therefore, no adverse impacts on the physical environment are foreseen.
2) No new construction is proposed; therefore, there will be
no significant growth-inducing impacts.
3) The majority of the potential patrons of this center are in
lower socio-economic brackets and many are handicapped.
Because most of these individuals are located in the
Center City area and do not possess automobiles, this
project will not indirectly generate significant amounts
of motor vehicle emissions.
GENERAL PLAN INFORMATION: The Parks and Recreation Element

PUBLIC FACILITIES: Water and sewer service are the responsi- bility of the City of Carlsbad.
DISCUSSION
The Zoning Ordinance does not require a CUP for public parks;
therefore, the DCC should keep in mind the distinction between
Magee House and the Park. As a Dractical matter, the DCC
should discuss to what extent the Park should be considered as a part of this application.

Magee Park
This is a legal lot in the City of Carlsbad, being the major
portion of Lot No. 3, City of Carlsbad subdivision, Map No.
775. The rest of the subdivision lot being an 80' pie shaped
piece split off by a lot split filed with the City Engineer in 1960. This lot is bounded on the east by Carlsbad Boule-
vard, on the south by Beech Avenue, on the west by Garfield
Street and on the north by privately owned property. A 20'
alley from Cypress Avenue, the 40' street to the north, dead
ends at the northerly property line of the lot. All streets and the alley are unimproved except for paving - (the alley
is not paved).
1. Sewer service is available in Carlsbad Boulevard at the north east corner of the property.
2. Water service: an existing 13" service line to the pro- perty from a 4" main in Beech Avenue.
A 6" main is located in Carlsbad Boulevard.
3. The alley to the northerly property line is used by the adjacent property owners for access to, both off street parking, and a couple of garages serving a two story apart- ment building. The lot adjacent to Cypress Avenue is a two story motel and the lot next to the Magee property is several apartments and an answering service office.
