Your attention is called to Section 707.2, 707.3, 707.4, and 804.2 of the Zoning Ordinance (Ordinance No. 1402 [New Series], as amended) relating to the right to appeal to the Board of Supemisors. In substance these sections provide that the only persons that may appeal are the applicant or the persons shown by the attached Decision to have protested at the hearing before the Planning Commission. The Decision of the Planning Commission becomes final on unless prior to that date you or a protestant files in the office of the Planning Cornmission a wrirten appeal to the Board of Supervisors accompanied by a fee of $25.00. Tourism, one of the County's largest industries, will be aitlcd by the larger facility. There are golf and tennis tournaments at La Costa and horse races at Del Mar. Transient parking facilities as they now exist approach rnaxinum capacity during these seasonal activities. The economic benefit of the aiqort to the region is approximately $4 million annually. and applying a standard 2.5 multiplier. Sased upon t!ie general aviation facilities in the County, the expected annual contribution from the expansion will be an additional q3.6 million. P77-73 - 3- Pursuant to Section 710 of The Zoning Ordinance, the following findings in support of the eranting of the special use permit are made: (1) The granting of such special use permit will not be materially detrimental to the public health, safety of welfare, or injurious to the property or improve- ments in such vicinity anti zone in which the property is located. The fact supporting Finding (1) is as follows: The development of Palomar Airport will he subject to strict land uses and development standards which should assure that no such detrimental impacts will occur. (2) The granting of such special use permit will not adversely affect any master or precise plan adopted pursuant to law. The fact supporting Finding (2) is as follows: The land uses allowed by the Palomar Airport blaster Plan conform to the Heavy Industrial land use designation of the General Plan. It has been determined that the existzing Ehviironmental Impact: Report for the Palomar -art: Master Plan, E;1D Log No. 75-7-13 certified December 4, 1975 and revised May 3, 1976 does address the environmental impacts associated with the above Special Use Fedt. The Environmental Review Board concluded at that time that t!! project have significant environmental impact in terms of noise, air quality and growth inducement. Therefare, it has been determined that in accordance with Section 15067 of the State EIR Guidelines, the approved Environmental lrrrpact Report remains adequate and in ccmpliance with (CEOA) California Environmental Quality Act; and no additional environmental analysis wiU ha required at this time. (LIJEEI) . - No. 60 ’ UESDAY, MARCR 13, 1979 RESOLUTION REVISING RULES AND REGULATIONS FOR COUNTY AIRPORTS I On motion of Supervisor Eckert , seconded by supervisor Hedgecock , the following resolution is adopted : WHEREAS, this Board has determined that training flights at County airports by alrcraft types that exceed acceptable noise levels should be prohibited; and WHEREAS, there is presented to this Board a letter from the Director of Transportation transmitting and recommending approval and adoption of revised rules and regulations for all County airports; and WHEREAS, Part IV, Noise Abatement has been added to said revised rules and regulations to prohibit aircraft with FAA measured or estimated sideline noise levels exceeding an Effective Perceived Noise Level (EPNdb) of 9Odb from conduct- 1 ing training flights at Gillespie Field, Palomar Airport, Ramona Airport, and Borrego Valley airports and said rules have been generally updated; NOW THEREFORE IT IS RESOLVED AND ORDERED that said revised rules and regulations for all County airports be ‘and they are hereby approved and adopted. IT IS FURTHER RESOLVED AND ORDERED that said revised rules and regulations supersede and replace any and all pre- existing rules and regulations for County airports. APPLICABILITY, These rules and regulations apply to each and every person and to each and every activity or opera- tion of any kind whatsoever on, in or about each and every County airport, except to the extent superseded by agreement or other written document executed by a duly authorized representative of the County. ascribed to them in this section unless otherwise apparent from Sec . 1.2. DEFINITIONS. The following words have the meaning the context: (a) , "Airport" and"County Airport'' mean each and all of the following airports in the County of San Diego: Borrego Valley Airport, Caliente Springs Airport, Fallbrook Community Airpark, Gillespie Field, Jacumba Airport, Ocotillo Airport, Palomar Airport, and Ramona Airport. "Airport Manager" means the County Airports Director, the manager of any of the County airports, or their duly authorized representatives. "County" means the County of San Diego. body, or any business, financial, social, recreational or athletic association of any form whatsoever, and includes any member, trustee, agent, employee, officer, receiver, assignee or other representative of any of these. Person" means any individual, estate, political 11 Sec. 1.3. CONSTRUCTION, These rules and regulations shall be construed so as to promote the objectives thereof and to protect and further the public health, safety, and welfare. Sec. 1.4. INDEPENDENT VALIDITY OF SECTIONS. If any section, subsection, sentence, clause, phrase or portion of these rules and regulations is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of these rules and regulations; the Board of Supervisors of the County of San Diego hereby declaring that it would have adopted these rules and regulations, and each of them, irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstiturional. - 4 Sec . 1.5. APPLICABILITY OF PREVIOUS RULES. These rules and regulations supersede and replace all previous airport rules and regulations; provided, that to the extent that these rules and regulations are unchanged from such previous rules and regulations, they shall be deemed a continuation thereof. Sec. 1.6. VIOLATION OF RULES FORBIDDEN - SANCTIONS. Non- compliance with or violation of these rules and regulations is forbidden. Any person operating or handling any aircraft, operat- ing any vehicle, equipment or apparatus, or using the airport or any of its facilities in violation of these rules and regulations, or any person who refuses to comply with these rules and regula- tions after being duly ordered to do so, or any person who enters or remains upon an airport without complying with each and every section and provision of these rules and regulations is in viola- tion of these rules and regulations. of these rules and regulations does not have, and is acting without, the permission of the County to remain on or to conduct any activity on an airport. Any person who is in violation of these rules and regulations shall be promptly ejected and removed from the airport, upon the order of the County's Director of Transportation, by the airport manager or by a law enforcement officer acting pursuant to the request of the airport manager; provided, however, that if the airport manager deems it necessary for the immediate protection of the public health, safety or welfare, or for the protection of property, or for the protection of the health, safety or welfare of any person lawfully utilizing the airport facilities, he may eject and remove, or request an appropriate law enforcement officer to eject and remove, any person who is in violation of these rules and regulations without first obtaining the order of the County's Director of Transportation to do so. Any person who is so ejected and removed from the airport may be deprived of and refused the future use of the airport and of the airport facilities for such time as the County's Board of Supervisors may determine and order, and until such time as such person may accomplish to said Board's satisfaction such remedial actions as said Board may order, not- withstanding any rights such person may otherwise have by virtue of any lease, permit or other written document. penalties are cumulative and supplemental to any penalties or remedies cognizable at law. and its agents, officers and employees, assume no liability or responsibility, and shall not be liable or responsible other than as required by law, for any loss, damage, destruction, injury or death to any person or persons or to any property by reason of any accident, incident, occurrence or mishap of any nature whatsoever or from any cause whatsoever. Any person entering an airport, or using or seeking or preparing to use an airport or any airport facility, does so at his own risk. -2- A person who is in violation The foregoing Sec. 1.7. NONASSUMPTION OF LIABILITY. The County of San Diego, PART I1 GENERAL RULES AND REGULATIONS Sec. 2.1. RESTRICTED AREAS. No person shall enter any area which is posted with signs reading "restricted," "closed to the public, or the like, except: It (a) Persons assigned to duty in such area. (b) Persons authorized by the airport manager. (c) Passengers, under appropriate supervision, entering such areas for the purpose of embarkation or debarkation. Sec. 2.2. CONDUCT OF BUSINESS. No person shall use the airport or any part thereof, or any airport facilities, for revenue-producing or commercial activities without first securing an appropriate permit, lease or other such document from the County and, after having obtained such document, without complying .fully and completely with all of the terms and conditions thereof , including the payment of rates and charges. Sec. 2.3. VEHICLES FOR HIRE. No person shall operate any vehicle for hire on the airport unless the provisions of Section 2.2 above have been complied with. Sec. 2.4. COMMERCIAL PHOTOGRAPHY. No person shall take still, motion or sound pictures or photographs for commercial purposes without the written permission of the airport manager. Sec. 2.5. ADVERTISEMENTS. No person shall post, distribute, circulate or display any signs, posters, advertisements, circulars, or any other such printed, painted or written materials without first obtaining the approval of the airport manager. Sec. 2.6. SOLICITING. No person shall solicit funds, goods, donations or pledges on the airport without first securing the written permission of the airport manager. Sec. 2.7. USE OF ROADS AND WALKS. No person shall travel on the airport property other than on the roads, walks and places appropriate to the type of travel, nor shall any person use said roads, walks or other places in such a manner so as to hinder or obstruct the proper usage thereof by others. Sec. 2.8. ANIMALS. No person shall enter the terminal build- ing or landing awthe airport with a dog or other animal, except a seeing-eye dog, unless such dogs or other animals are restrained by a leash and kept under complete control. Dogs and -3- other animals are permitted in other areas of the airport if they are restrained by a leash or otherwise confined so as to be under the complete control of the person accompanying such animal. PART I11 AIRCRAFT OPERATION Sec. 3.1. OPERATION OF AIRCRAFT. No person shall navigate, land, takeoff or fly any aircratt, or service, maintain or repair any aircraft, or conduct any aircraft operations or activities on, from or about the airport other than in conformity with current Federal Aviation Administration (FAA) Federal Air Regulations (FAR), and Civil Aeronautics Board (CAB) rules and regulations and with applicable laws of the State of California. Sec. 3.2. RATES AND CHARGES. Aircraft and business opera- tions on the airport shall be subject to Schedule of Rates and Charges and Use Control Policy for County Airports, as adopted by the Board of Supervisors. Sec. 3.3. AIRCRAFT TAKEOFFS AND LANDINGS. All takeoffs and landings at airports without control towers, or when control towers are inoperative, shall be made at safe distances from other aircraft, and from all buildings, automobile parking areas and similar areas and obstructions. highways and roads on or adjacent to the airport by a vertical distance of no less than fifty (5Q) feet. ~ Aircraft shall clear all Sec. 3.4. RESTRICTION OF MOVEMENT, The airport manager may delay or restrict any ground movement or other operation or activity on the airport, and may refuse departure of aircraft from parking areas on the airport, for any reason the airport manager deems necessary in the public interest or to protect public health, safety or welfare. Sec. 3.5. AEROBATICS PROHIBITED. No aircraft shall be flown within the airport traffic area in any aerobatic maneuver or maneuvers other than those required in normal and routine operation unless specifically approved by the County Airports Director. Sec. 3.6. AIRCRAFT STORAGE AND REPAIRS----AREA. No aircraft shall be stored or repaired in any area or space other than those areas and spaces designated for such purposes by the airport manager. Sec. 3.7. SECURING OF UNATTENDED AIRCRAFT. Securing of un- attended aircraft shall be the responsibility of the pilot of the aircraft Sec. 3.8. aircraft, or of SAFE HANDLING 0% AIRCRAFT. The pilot of moving an aircraft preparing or waiting to move, shall .. . take all due is no danger care to avoid, and shall assure himself that there of & collision with any other aircraft, whether ._ moving or stationary, or with any building or obstruction. Air- craft shall at all times be taxied, landed or taken-off at reasonable speeds and while under the full control of the pilot. Sec. 3.9. TAXIING. Aircraft shall not be taxied into or out of hangars. Sec. 3.10. NIGHT FLYING. No person shall land at, taxi on or take off from an unlighted runway after dusk or before dawn, except in the event of an emergency. Sec. 3.11. STARTING AND RUNNING ENGINE - LOCATION. Air- Aircraft craft engines shall be started and warmed up only in those places designated for such purposes by the airport manager. shall be so placed and orientated while an engine is running that no hangar, building or person is in the path of the propeller slip- stream, and so that no dust cloud or other hazard to aircraft is created. Sec. 3.12. RUNNING OF AIRCRAFT ENGINES. No aircraft engine shall be started or run unless a licensed pilot or mechanic is attending the controls. Blocks equipped with ropes, or other suitable equipment for blocking an aircraft, shall always be placed in front of the main landing wheels prior to starting an engine of the aircraft unless the aircraft is equipped with adequate locking brakes. Sec. 3.13. RUNNING OF ENGINE IN HANGAR. No aircraft engine shall be started or run in a hangar at any time. Sec. 3.14. PLANT QUARANTINE INSPECTION, Federal and California Any person bringing plants, fruits, vegetables, nuts, seeds, plant quarantine laws, as may be currently in effect, shall be en- forced. cotton bolls, raw cotton, cottonseed, or unprocessed plant products from any state or territory, including Hawaii, or from any foreign country, shall report to the airport manager who will arrange for inspection by the proper plant quarantine officials. All aircraft carrying such plants or plant products, including aircraft having come directly from Hawaii, which are not certified as inspected and released by the United States Department of Agriculture, shall remain unloaded of such plants and plant products until inspected or otherwise cleared by the proper authorities. Sec. 3.15. DAMAGE TO AIRPORT PROPERTY. Any and all airport property damaged, injured or destroyed, by accident or otherwise, shall immediately be paid for the person or persons responsible for such damage, injury or destruction; provided, that the County Director of Transportation may, in his discretion, authorize deferred payment . -5- See. 3.16. DISPOSITION OF DISABLED AIRCRAFT. In the event an aircraft becomes disabled. the owner. or if he is absent the pilot or other person in confrol or in possession of such air- craft, shall be responsible for the disposal or removal of the disabled aircraft and any parts thereof. Such disposition shall be made promptly unless ihe owner or his agent is required by law, or is directed by the airport manager, to delay making such . disposition pending an accident or other appropriate investigation. Sec. 3.17. ACCIDENT REPORTS. Persons involved in or wit- nessing an aircratt accident on the airport shall report such accident to the airport manager's office or to the nearest guard as soon as it is reasonably possible to do so. Such persons shall make written reports as requested by the airport manager. Sec. 3.18. PRESENT HOURS OF OPERATION. Hours of operation effective as of 3/13/79 shall remain in effect unless changed by the Board of Supervisors. PART IV NOISE ABATEMENT Sec. 4.1. NOISE ABATEMENT PROCEDURES. All persons operating aircraft from County airports shall comply with all noise abate- by County and acceptable to FAA. measured or estimated sideline noise levels exceeding an Effective .ment procedures, traffic patterns and policies as may be established , Sec. 4.2. TRAINING FLIGHT RESTRICTIONS No aircraft with FAA Perceived Noise Level (EPNdb) of 9Odb shall be permitted to conduct training flights at Gillespie FierPalomar Airport, Ramona Air- port and Borrego Valley Airport. For purposes of this part the FAA measured or estimated EPNdb sideline noise levels shall be as defined and established in FAA Advisory Circular 36-1B, dated 12-5-77 and in FAA Advisory Circular 36-2A dated 2-6-78, or as these circulars may subsequently be revised, reissued or amended. Said circulars are hereby incorporated herein by reference. any instrument or visual approach to the airport conducted for the purpose of student instruction, pilot proficiency training, or pilot evaluation check rides, whether or not a landing touchdown is accomplished. For the purposes of this part "training flight" shall mean PART V MITOR VEHICLE REGULATIONS Sec. 5.1. GENERAL. Motor vehicles shall be operated on the airport in strict compliance with the applicable provisions of the California Motor Vehicle Code, the San Diego County Code, and with these rules and regulations. -6- See . 5.2 . RESTRICTED AREAS a No motorized equipment or vehicles shall be operated on the aircraft aprons of the field or on the taxiway and aircraft landing area, except by persons assigned to duty in those areas or by persons so authorized by the airport manager. Sec. 5.3. SPEED. Motor vehicles shall be operated in strict compliance with the speed limits prescribed by the airport manager and indicated by posted traffic signs. In no event shall any Gotor vehicle, excebt- emergency vehicles in an emergency situation, exceed a speed of twenty-five (25) miles per hour. Sec. 5.4. PARKING. Vehicles shall be parked on the airport in the manner and at the locations indicated by posted traffic signs. Sec. 5.5, COMMON CARRIERS . No bus, truck, taxi or other common carrier or vehicle for hire shall load or unload passengers or personal property at any place on the airport other than that place or those places designated by the airport manager. Sec. 5.6. ACCIDENT REPORTS, Persons involved in or wit- nessing a motor vehicle accident on the airport, shall report such accident to the airport manager's office or to the nearest guard as soon as it is reasonably possible to do so. Such persons shall make written reports as requested by the airport manager. PART VI <* OTHER REGULATIONS -J In addition to the provisions of these Rules and Regulations all activities on County Airports shall conform to Federal, State and local laws, ordinances, regulations, policies or other pub- lications applicable to aircraft operations, land use, construction, safety, or any other activities conducted on a County Airport.
