I recently spoke with Bill Hofman who conveyed to me your
request to sell shrirp, etc. on the east side of Carlsbad Boulevard, south of the public fishing area. This proposal was discussed at our Friday staff meeting and the consensus was that this type of use would not be permitted by the General Plan in
an area, such as yours, which has an Open Space designation.
The present use of the property as an auiiaculture site was previously approved under conditional use permit 194 (A). Commercial distribution of shellfish was also part of this
approval, Staff felt that your present expanded use of the lagoon as a growing site is consistent with the original
conditional use permit approval; however, the proposed commercial use is not. Neither the Zoning Ordinance nor the General Plan would permit a commercial retail use in an Open
Space zone.
