PATRICK PARISH SCHOOL 3820 Pio Pico Drive Carlsbad, CA 92008 WHITE CURB It has been brought to our attention by the Carlsbad Police Department that a section of white curb exists between the driveways of your school on Pio Pico Drive and time limits are routinely violated for that type of curb marking. Section 21458 of the California Vehicle Code states that a curb painted white indicates stopping only for loading or unloading of passengers for such time as may be specified by local ordinance. Our local ordinance, Section 10.40.090 of the Carlsbad Municipal Code, specifies a time period not to exceed three minutes. Field observations conducted on many different occasions at various times indicated as many as ten vehicles parked adjacent to the white curb'. The vehicles observed were unoccupied and not in the process of loading or unloading passengers. We believe this to be reflective of most times during the day when the vehicles are parked adjacent to the white curb. CUP 204D SAINT PATRICK'S MODULAR CLASSROOM ENGINEERING CONDITIONS OF APPROVAL ENGINEERING CONDITIONS Note: Unless specifically stated in the condition, all of the following conditions, upon the approval of this proposed Conditional Use Permit, must be met prior to issuance of a Building Permit. General 1.(7) Prior to hauling dirt or construction materials to or from any proposed construction site within this project, Developer shall apply for and obtain approval from the City Engineer, for the proposed haul route. 2.(24) Prior to the issuance of a building permit, Developer shall submit to the City Engineer proof that a Notice of Intention for the start of work has been submitted to the State Water Resources Control Board. Dedications/Improvements 17.(40) Prior to the issuance of a building permit, the developer shall submit for City approval a "Storm Water Pollution Prevention Plan (SWPPP)." The SWPPP shall be in compliance with current requirements and provisions established by the San Diego Region of the California Regional Water Quality Control Board. The SWPPP shall address measures to reduce to the maximum extent possible storm water pollutant runoff at both construction and post-construction phases of the project. At a minimum, the Plan shall: a) Identify existing and post-development on-site pollutants; b) Recommend source control Best Management Practices (BMPs) to filter said pollutants; c) Establish specific procedures for handling spills and routine clean up. Special considerations and effort shall be applied to employee education on the proper procedures for handling clean up and disposal of pollutants; d) Ensure long-term maintenance of all post construct BMP's in perpetuity; Water, Sewer, Recycled Water Conditions 1. Developer shall meet with the Fire Marshal to determine if fire protection measures (fire flows, fire hydrant locations and building sprinklers) are required to serve the project. We would like you to consider waiving this requirement for the following reasons: The Q zone overlays only a portion of the site at St. Patrick Parish and School. The findings for the CUP amendment are similar to those required for the SDP amendment. Both require that the proposed development be in harmony with the surrounding area. Our building is adjoining existing structures, similar in height, shape and appearance. It is compatible with the adjacent property, First Baptist Church and Preschool. Our proposal includes adding one classroom, relocating unbuilt bathrooms already approved under current CUP, and a new layout of parking in the school yard area only. The new classroom and new bathroom location will not be visible from any street. The staff will review the same things for the CUP and SDP amendments. The CUP amendment process requires that this project be heard at public hearing, the objective of the SDP will be met in this same hearing. St Patrick School has a very tight budget. As a parochial school the tuition is kept as low as possible so that as many in the community as possible may attend. The fee of $5050 is a hardship.
