SUBJECT: CUP-213 - BUFFY'S - Request for a Conditional Use
Permit for the on-premise sale of beer and wine at
the existing Buffy's Restaurant located on the north-
east corner of Interstate 5 and Tamarack Avenue in
the C-1 Zone.
I. PROJECT DESCRIPTION
The applicant is requesting approval of a Conditional Use Permit
to allow the on-premise sale of beer and wine at the existing
Buffy's Restaurant located as described above. The applicant
does not propose to alter the interior floor plans to set up a
bar or lounge, but simply to serve beer and wine from their
existing counter and as part of the restaurant service.
II. ANALYSIS
Discussion
The use is located near the interchange of 1-5 and Tamarack
Avenue and, as such, primarily caters to people traveling north
and south on 1-5. Surrounding land uses include a gas station on
the same parcel immediately to the south, Safeway Center further
south across Tamarack Avenue, the St. Patrick's Church and School
to the east and north, and the freeway to the west. No residen-
tial land uses are located in close proximity to the restaurant.
Staff does not believe any adverse impacts to surrounding proper-
ties would be created by this use
Since the interior of the restaurant is not being altered, and no
lounge or bar is being established, staff believes no significant
local traffic would be generated and that the existing parking
lot is adequate in size to handle any additional traffic that
would be generated by the use. Staff has found that approval of
this request will not create any adverse parking or traffic
impacts.
In addition, staff has found that the use is essentially in har-
mony with the General Plan designation of Tourist Commercial on
the property and that the site is adequate in size and shape to
accomodate the proposed use. Staff is therefore recommending
approval of this conditional use permit.
III. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project is cate-
gorically exempt from environmental review pursuant to Section
19.04.070(12) of the Carlsbad Municipal Code.
IV. RECOMMENDATION
It is recommended that the Planning Commission adopt Resolution
No. 1942 , APPROVING CUP-213, based on the findings and subject
to the conditions contained therein.
