of CUP213xl to allow the continued on-premise sale of alcoholic beverages at an
existing restaurant located at 950 Tamarack Avenue in Local Facilities
Management Zone 1.
RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 3970
APPROVING CUP 213x2 allowing a five year extension based upon the findings and subject to
the conditions contained therein.
II.INTRODUCTION
This proposed five year extension of the subject conditional use permit will allow the continued
on-premise sale of alcoholic beverages at the Village Kitchen & Pie Shoppe at 950 Tamarack
Avenue. A five year extension would extend the conditional use permit through April 28, 2000.
III.PROJECT DESCRIPTION AND BACKGROUND

On April 28, 1985T the Planning Commission approved CUP 213 allowing the on-premise sale of
alcoholic beverages at an existing restaurant located at the corner of Tamarack and Pio Pico in
the C-l zone. CUP 213x1, approved on June 20, 1990, extended the permit for five years
through April 28, 1995. Condition No. 2 of the approving CUP Resolution No. 3057 specifies
that CUP 213x1 may be extended for a period not to exceed five years upon written application
of the permittee (Forest Fisher). The applicant is requesting a 5 year extension of CUP 213x1 to
allow the continued on-premise sale of alcoholic beverages at this site.
IV. ANALYSIS
A. The on-premise sale of alcoholic beverages at the Village Kitchen and Pie Shop continues
to be consistent with all applicable plans, policies and regulations described below:
1. Carlsbad General Plan; and
2. Title 21 of the Carlsbad Municipal Code.
B. The adopted project findings for CUP 213x1 which are contained in Planning
Commission Resolutions No. 1942 and 3057 still apply to this project (CUP 213x2)

Commission Resolutions No. 1942 and 3057 still apply to this project (CUP 213x2)
Restaurants serving alcoholic beverages in the Neighborhood Commercial (C-l) zone
require approval of a conditional use permit to ensure compatibility with surrounding
residential uses. The Village Kitchen and Pie Shop restaurant is located within a freeway
service facility which is separated from surrounding residential development by roadways
and St. Patrick's School and Church. The family restaurant, which includes no separate
bar facility, is compatible with surrounding uses and has no direct impact on residential
use in the area.
C. The adopted project conditions for CUP 213x1, which are contained in Planning
Commission Resolution No. 3057 still apply to this project (CUP 213x2) with the
exception of Condition No. 2 which is amended by Condition No. 2 in Planning
Commission Resolution No. 3970 to extend CUP 213x2 for five years through April 28,
2000.
D. No formal written complaints regarding CUP 213x1 have been submitted to the City.
E. Annual reviews have been conducted for CUP 213x1 and the project is in compliance
with all conditions of approval.
F. The extended CUP should be exempted from environmental review per Section 15301,
Class l,ofCEQA.
V. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the
State CEQA Guidelines and will not have any significant adverse impact on the environment.

Your application has been tentatively scheduled for a hearing by the Planning
Commission on August 7, 1996. However, for this to occur, you must submit the
additional items listed below. If the required items are not received by July 1 6,

2. As required by Section 65091 of the California Government Code, please
submit the following information needed for noticing and sign the enclosed

A) Owners List - a typewritten list of names and addresses of all property
owners within a 600 foot radius of the subject property, including the
applicant and/or owner. The list shall include the San Diego County
Assessor's parcel number from the latest equalized assessment rolls.
B) Mailing Labels - two (2) separate sets of mailing labels of the property
owners within a 600 foot radius of the subject property. The list must
be typed in all CAPITAL LETTERS, left justified and void of all
punctuation. For any address other than a single family residence, an
apartment or suite number must be included but the Apt. #, Suite #
