Thank you for your assistance in expediting administrative
approval of our small parking lot project. Upon completion, this
project will provide much needed, additional secure, safe parking
for the residents of Tyler Court Senior Complex, 3363 Tyler
Street, in Carlsbad.
The above conditional use permit provided a reduction in parking
spaces from 115 spaces to 25 spaces. (See page two, section 7).
The new parking facility will raise the total on-site parking to
a total of 51 parking spaces. The total of 51 spaces will exceed
the requirements of Parking Ordinance #9804, page 4, section 9,
which requires "one space per every two units". The Tyler Court
Senior Complex has 75 units which would require 38 spaces.
We currently are in the process of refinancing our Tyler property
to take advantage of a more attractive interest rate. The lender
requires lifting the parking space requirement in the conditional
use permit before final approval of the loan. We expected loan
approval no later than August 18, 1987.
Would you please determine if it is possible to lift the current
parking requirement in CUP-217 by administrative action, instead
of submitting this as an Information Item, to the Planning
Commission? A six week delay, to get on the agenda for the next
meeting of the Planning Commission, could be very costly should
the lender increase the quoted interest rate.
Please give me a call as soon as you determine how we must
proceed to meet this unexpected requirement placed on us by the
lender.

Enclosed please find the proposed lease agreement
for Tyler Properties, Ltd. (CUP 217). Please note that the
limitations contained in paragraph 15 in Resolution 6985 are
contained in the Addendum to the lease. We believe that
paragraph 6 of the lease agreement satisfies most of the
requirements of 15B and C of the Resolution, and when com-
bined with paragragh 2 of the Addendum, covers the City's
concerns in that regard. Also it is our interpretation that
submitting this lease and addendum takes care of requirement
15E thereby eliminating the necessity for that reference in
the lease.
Please advise if you have any problem with the
lease form.

This Addendum is to that Month-To-Month Rental

1. Minimum Age. At all times during the term of
the lease, at least one occupant of the apartment will be
over 62 years of age.
2. No Additional Persons. No persons other than
those shown in paragraph 6 of the Month-To-Month Rental
Agreement shall occupy the apartment. Furthermore, if the
apartment is a two bedroom apartment, Tenant agrees that no
more than three people may reside in the apartment at any
time, two of the three must be over the age of 62, and the
third person is over the age of 35; provided, however, that
the third person may be under the age of 35, the third
person is a live-in nurse or a tenant required for medical
reasons;
3. Status of Automobiles. Those persons shown
in paragraph 6 on the Month-To-Month Rental Agreement do
, or do not have an automobile. It is understood
by the Tenant that those tenants indicating they do not have
any automobile may not require an automobile during the term
of the occupancy and that the acquisition of any such auto-
mobile shall be grounds for Owner to terminate the Agreement.

1. Normally, a driveway length of more than 150 ft. would
require a turn-around. However, due to the configura-
tion of the driveway and parking area past the building
and the location of an on-site fire hydrant at the rear
of the building, I feel that the requirement for a turn-
around can be waived in this case.
2. Two additional fire hydrants will be required for the
project. One will be located at the street front,
adjacent to the driveway. The second will be located
at the rear of the building in the landscaped area
along the southerly property line (assuming the length
of the property runs east-west).
