Dear Mr. Chriss:
The Planning Department has reviewed the request to build an elevator addition at
1003 Chinquapin Avenue. It has been determined that the improvements will not
require an amendment to Conditional Use Permit 220. Please submit a copy of this
letter along with the building plancheck set to facilitate processing.
Please be aware that the project site is within the California Coastal Zone and a coastal
development permit will be required. The Calif. Coastal Commission is the permitting
agency and should be contacted for a permit.

Dear Mr. Beauchamp:
This letter is in response to your request for the City of Carlsbad to change the deed
restriction, related to the minimum age requirement for senior citizen housing, for property
located at 1003-1011 Chinquapin Avenue. Since the age restriction for senior housing
was changed to meet state and federal regulations, the City's prior conditions of minimum
age limits on senior projects has now been preempted by the state and federal
regulations. The City will no longer enforce the 62 year old minimum age requirement for
senior projects, as stared in condition number 12(a) of Conditional Use Permit 220,
Planning Commission Resolution Number 7079.
The City has decided not to change all of the deed restrictions of senior facilities because
the state and federal regulations preempt the old conditions. If you still want to change
the deed restriction, the City will be a party to the change, but will not initiate the change
to the deed restriction.

Because of the recent change in the age requirement for senior
housing per the above stated ordinance, I, as trustee of the
Beauchamp 1983 Revocable Family Trust, owner of the above stated
apartment complex, deed recorded in the official records of San
Diego County, Doc.No. 86-591055 & 86-591056, Dec. 17. 1986,
respectfully request the following action be taken.
1. The filing of the necessary papers to correct item 12)a of
the Recorded Document; Case No: CUP-220, recorded in the
official records of San Diego County, Pages 1711-1717,
No: 82-378649.
Legal description: Portion of TRACT 238 OF THUM LANDS,
MAP NO. 001681.
2. The filing of the necessary Document referring to
Ordinance No. NS-234 to reflect this change in age
requirements on the above listed property.

installed on the trash receptacle area. I spoke with
Mr. Van Lynch a couple of weeks ago and assured him that I would
comply with the request.
I stopped in the Planning Office this afternoon, but Mr. Lynch
was in a meeting, so I left a note with one of the charming
ladies, and mentioned that I would follow up with a letter.

SUBJECT: CUP 220 - CARLSBAD SUNSET
Dear Mr. and Mrs. Beauchamp:
As you may recall, a review of the Conditional Use Permit for Carlsbad Sunset was
conducted on January 24, 1991. The site was found to be in violation of a condition that
required the trash receptacle to be in an enclosure with gates. I recall talking to you about
the gate and understood that you would work towards replacing the missing gate. I drove
by on the week of April 29, 1991, and saw that there was no gate on the enclosure. Please
let me know what you plan to do about this situation. I would like to take care of this
before having to take the Conditional Use Permit back to the Planning Commission to
revoke or modify the permit.

Dear Ms. Beauchamp:
On January 24, 1991, Condilional Use Permit No. 220 was reviewed for compliance with the
conditions contained therein. As a result of this review it has been determined that you are in
violation of Condition No. 9 in Planning Commission Resolution No. 7079. Condition No. 9 states
that:
Trash receptacle areas shall be enclosed by a six foot high masonry wall with gates
pursuant to City standards.
Please be advised that a public hearing before the Planning Commission will be scheduled if
compliance with the conditions of approval of your permit cannot be documented within 30 days of
the date of this letter.
The Planning Commission may, after a public hearing held in the manner prescribed in Chapter 21.50
of the City's Municipal Code governing Conditional Use Permits, "revoke or modify any permit if the
permit granted is being, or recently has been, exercised contrary to the terms or conditions of such
approval."

Sirs: The maintenance of the grounds for the proposed Senior Housing
Project, will be done on a contract basis. The terms have yet to
be determined. A timed irrigation system will be guaranteed for
the first year. Thereafter, said system will be part of the main-
tenance contract.

RE: Senior Housing Conversion Plan, 98? Chinquapin
The plan submitted, indicates seventeen units would remain after
conversion. This would exceed the normally allowed density on this
.71 Acre property. However, this conversion plan allows for a
density bonus for affordable housing. If the city indicates there
is no longer such a need, these additional units could be used for
a manager's office, or recreation room, or even be removed as has
been approved on another senior housing conversion plan.

Dear Council Members,
I currently have in process an application for a conditional use
permit for Senior Housing units at 98? Chinquapin in Carlsbad. I
have been informed that, as part of this process, the Carlsbad Unified
School District will require their normal fee. I am of the opinion,
that senior housing will have no impact on schools and the school ..
district is "out of line" in their request.
I ask; that the council waive the requirement of a letter from the
school district when senior housing is concerned.

Our district 'has reviewed the proposed 15 condominium units generally
located at 987 Chinquapin Avenue, as referenced above, and has evaluated
the Impac.t of that project on the facilities of this district.
The governing board wishes to advise the city officials and the
residents of Carlsbad that as residential units are added to the community,
it 1s likely that many classes 1n the,district will be crowded, resulting
in possible impairment to the educational and transportational services
offered to the students. It is also likely that school schedules may have
to be changed, resulting in an Increase in the year-round program, or double
sessions, or both. However, the district is able to assure you that school
physical facilities will be avallable,,concurrent with need for this develop-
ment as it is presently proposed.
