Dear Property Owner:
In a recent audit of our records, we found that CUP No. 237 expired on November 9,
1988.
If you would like an extension of this permit, please send us your request and a check for
$375.00 ($100.00 for non-profit organizations), to City of Carlsbad, 2075 Las Palmas Drive,
Carlsbad, CA 92009.
Your request for an extension must be received no later than March 31, 1990 to allow
adequate time to process your application and schedule a hearing before the Planning
Commission.
If you do not request an extension by this date, the permit will be considered invalid and
to continue operating, you will have to submit an application for a new permit, along with
a check for $2,000.00 ($100.00 for non-profit organizations).
If you have any questions, please do not hesitate to contact me in the Planning

SUBJECT: CUP-237 - RANCHO LA COSTA CABLE TV - Request for a
conditional use permit to construct and operate a cable
TV earth station approximately 1,000 feet east of the
intersection of El Fuerte Street and Luciernaga Avenue
in the P-C zone.
This item was previously approved by the Planning Commission
Resolution No. 2217 approving this project stated:
"This approval shall become null and void of building
permits within two years from the date of project
approval."
On November 13, 1985, a one year extension was granted and
building permits were subsequently issued. In the meantime,
assets of the company were sold to Daniels Cablevision. Mr.
Morey is presently requesting an additional six month extension
to permit the Daniels company sufficient time to review and
possibly modify the plans for the site.
Since, the applicant is proposing no changes to the project,
staff recommends that this conditional use permit be extended
for six months. For details of the proposed project see the
attached Staff Report, dated November 9, 1983.

On November 9, 1983 the Planning Commission approved a conditional use
permit to construct and operate a cable antenna building and earth
station approximately 1,000 ft. east of the intersection of El Fuerte
Street and Luciernaga Avenue.
One of the conditions of the permit was that building permits be issued
within two years or the approval would be null and void.
On November 13, 1985 the planning commission extended for one year (or to
November 13, 1986) the time required to obtain building permits. After
that plans were completed and building permits issued. Conduit is in
place from the site to El Fuerte St. We have been ready to proceed
with construction.
In the meantime we have been proceeding with the sale of our assets (in-
cluding the site) to Daniels Cablevision. We have delayed construction
to give Daniels an opportunity to examine and possibly modify the con-
struction plans (thus necessitating further review by both building and
planning departments).
We request that you take whatever action you deem appropriate to allow
theDanielscompanysufficient time to review and possibly modifythe plans

Rancho La Costa Cable TV is currently processing plans for the
construction of this facility but, for reasons beyond their
control have been unable to comply with the November 9, 1985
deadline. (Please see the attached letter dated, October 28,
1985.) Mr. Morey of Rancho La Costa Cable TV has indicated that
they plan to obtain a building permit by the end of this year.
Since, the applicant is proposing no changes to the project,
staff recomends that this conditional use permit be extended for

Dear Lynn:
Rancho La Costa Cable Television currently has a Conditional Use
Permit to construct and operate a television earth station near
El Fuerte Street in the La Costa area (CUP-237 Planning Resolution
2217) .
Condition four of the resolution requires that building permits be
issued by November 9, 1985. We are currently processing landscaping
plans, a building permit requirement, and will soon be submitting the
architectural plans for building plan check; however, will be unable
to adhere to the November 9, 1985 deadline.
There are several reasons for the delay in this project, the primary
cause being the delay in the construction of Costa Real Municipal
Water District's water tank, directly adjacent to our site. Because
of this ongoing construction, we have not been able to access our site.
Additionally, the considerable amount of blasting that was required
for the water tank site, precluded us from placing our facilities at
that time.
Our current schedule calls for us to obtain permits by the end of this
year, with construction planned for early next year. Therefore, we
request that condition four be extended to allow for this schedule.
Additionally, our Conditional Use Permit exhibits show the grading
of pads for the facilities. Because of the existence of rock and
the proximity of the new water tank, we plan only minor grading for
the maintenance building with none of the other proposed grading to
be performed.

Costa Real Municipal Water District
Dear Mr. Howes:
Thank you for this opportunity to comment upon the proposed conditional
use permit for the earth satellite station that will be located immediately
adjacent to the Costa Real Municipal Water District's new "Hi Reservoir."
The Water District, property owners and the Cable TV organization have
been working together in earnest for several years on this joint project
and we are pleased to report that we are nearing conclusion of our negoti-
ations for site acquisition, road access and actual construction.
The Water District has completed its engineering construction design of
the reservoir and we have mutually agreed with the Cable TV organization
that we will utilize a common driveway and there will be complete coordina-
tion for the appropriate landscaping of the areas. We welcome this public
utility organization as our neighbor and we would recommend that the
Planning Commission and City Council grant a favorable approval of the
conditional use permit request.
