I. RECOMMENDATION It is recommended that the Planning Commission APPROVE the Negative Declaration issued by the Land Use Planning Manager and ADOPT Resolution No. 2217 APPROVING CUP-237 based on the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION The applicant is requesting a Conditional Use Permit for the construction and operation of a cable TV earth station located as described above. As shown by Exhibit "A", this project will be located within the previously approved Rancheros subdivision. Access to the site will be provided by the private street that will be constructed to provide access to future residences in this area. The proposed earth station will be located adjacent to a future Costa Real Water District Reservoir as shown by Exhibit "B". Both of these facilities will be constructed prior to the grading and construction of homes on adjacent lots. Temporary access to these facilities will be provided by a dirt road. The site will consist of several earth station and other antennas, a microwave antenna and an equipment building. The earth station antennas will be directed skyward and located in a 6 foot - 10 foot deep excavation. The microwave antenna will be comparable in height to the proposed water reservoir. Landscaping will surround the entire site. III. ANALYSIS Planning Issues 1) Can the four findings required for approvval of a Conditional Use Permit, be made? Specifically: (a) That the requested use is necessary or desirable for the development of the community; is essentially in harmony with various elements and objectives of general plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed uses is to be located; (b) That the site for the intended use is adequate in size and shape to accommodate the use; (c) That all of the yards, setbacks, walls, fences, landscaping and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained; (d) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. Discussion As proposed, this project meets all of the requirements necessary for granting a Conditional Use Permit. The site of the proposed earth station is one of the highest in La Costa and is ideal for communication reception. Staff feels this project will be a desirable public service and will not adversely effect future residential uses in the area. The proposed earth station will share a common access with the future water reservoir. Heavy landscaping around the perimeter of the site will screen the equipment building and antennas from future residences. The proposed private street system of the Rancheros project will be adequate to provide access to the earth station since this facility should generate almost no traffic once it is constructed and in operation. As conditioned, this project will provide a needed service to the City of Carlsbad and not adversely impact future adjacent residences. Overall, staff is satisfied that all required findings for a Conditional Use Permit can be made. IV. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this project will not have a significant impact on the environment and, therefore, has issued a Negative Declaration on October 19, 1983.
