I. RECOMMENDATION It is recommended that the Planning Commission APPROVE the Negative Declaration issued by the Land Use Planning Manager and ADOPT Resolution No. 2225 APPROVING CUP-238, based on the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION The applicant proposes to install a radio antenna in the rear yard of a house at 4134 Skyline Drive. This antenna would allow him to conduct amateur radio broadcasting and receiving, subject to FCC regulations. The proposed antenna is retractable and could reach a maximum 55 feet in height. The antenna is proposed to be located amongst pine trees, near the rear lot line of the property. The property to the rear is presently being graded for the Carlsbad Palisades (CT 76-15) subdivision, which will result in the construction of single- family tract homes, terracing down the hillside to El Camino Real. Lots immediately behind the proposed antenna are proposed 15 feet lower than the subject property. III. ANALYSIS Planning Issues 1) Will the proposed antenna significantly contribute to aesthetic degradation of the neighborhood? 2) Will the proposed project cause television and radio reception interference in the neighborhood? DISCUSSION The Carlsbad Municipal Code contains no guidelines as to how amateur radio antennas should be handled, or when and where they could be allowed. In the absence of city standards, staff contacted various city departments to identify any problems associated with these antennas in the past. Aside from the fact that the antenna structure must be reviewed by the building inspectors (to make sure it is structurally sound), the aesthetic and reception interference issues were the only ones to surface. Staff believes that any aesthetic impacts associated with the visibility of the aluminum antenna will be mitigated by its camouflage amongst several mature pine trees. In addition, staff has contacted a communications expert to discuss potential reception interference. After reviewing the antenna information supplied by the applicant, it was noted that the specific antenna proposed is one of the more sophisticated antennas available, which should result in little potential interference. The applicant has also supplied information that such amateur radio operators are of great value to the country in times of emergency, if communication lines are interrupted. As a result, staff is recommending approval of the permit. IV. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this project will not have a significant impact on the environment and, as a result, has issued a Negative Declaration on November 22, 1983.
