Any- thing contained in this chapter to the contrary notwith- standing, the placement of benches with advertising messages on them may be conditionally allowed by the plan- ning commission, and in the event of a dispute by the city council. W—11.04 .070 I GENERALLY 11.0 4.010 Sidewalks to be installed contiguous to curb—Exception. All sidewalks shall be installed con- tiguous to the curb unless the city engineer, for good cause shown, shall allow its placement at another loca- tion. (Ord. 8042 §1) . 11.0 4.0 20 Sidewalk width requirements. (a)- In R-A, R-1, R-2, R-3L and R-3 zones sidewalks shall be at least five feet in width. (b) In all R-P and R-T zones sidewalks shall be at' least eight feet in width. (c) In all C, C-M and M zones sidewalks shall be at least eight feet in width and shall extend from the property line to the curb line. (Ord. 8042 §§4, 5). 11.04.030 Street tree wells. For good cause shown, the city engineer may require the placement of street tree wells in sidewalks of eight feet or greater in width. (Ord. 8042 §2). 11.0 4.0 40 Appeal of city engineer's determinations. In the event of a dispute regarding the city engineer's decision regarding the location of the sidewalk or the placing of street tree wells as stated, any person aggrieved thereby may present the matter to the city council which shall hear and finally decide the matter. (Ord. 8042 §3). II ENCROACHMENTS 11.0 4.0 50 Granting of permission for public utilities. Upon application therefor, and when it is determined that it will not be detrimental to the interests of the city, and that public convenience and necessity require it, the city engineer may grant conditional permission to public utilities to install and maintain encroachments, both above and below ground level, in public rights-of-way within the city. (Ord. 8041 §1). « 11.0 4.0 60 Underground encroachments. Upon applica- tion therefor, and when it is determined that it will not be detrimental to the interests of the city, the city en- gineer may grant conditional permission to builders other than public utilities to install and maintain encroachments below ground level in public rights-of-way within the city. (Ord. 8041 §2). 11.0 4.0 70 Aboveground encroachments. Upon application therefor, and when it is determined that it will not be detrimental to the interests of the city, the city council 183 11. 04. 5PF--11. 04.120 may grant conditional permission to builders other than public utilities to install and maintain encroachments above ground level in public rights-of-way within the city. (Ord. 8041 §3). 11.04.080 Prerequisites to grant of permission. No- thing contained in this chapter shall require the granting of permission to encroach by either the city engineer or the city council unless the appropriate granting authority, in its sole discretion, determines that the granting of such permission will be to the best interests of the city. (Ord. 8041 §4). 11.04.090 Permission to be written and approved as to form. Any permission granted under this chapter to install and maintain encroachments shall be effective only when evidenced by a document in writing approved as to form by the city attorney. (Ord. 8041 §5). 11.04.100 Installation without permission. Any en- croachment on a public right-of-way of any nature whatso- ever, which is installed without appropriate permission as required in this chapter, shall constitute a request for such permission and shall forthwith be brought to the attention of the city council. The city council may then decide, in its sole discretion, whether or not to allow the maintenance of such encroachment, and if allowed, upon whatever conditions it may impose. (Ord. 8041 §6). 11.04.110 Fees. Any builder, other than a public utility, who applies for permission to encroach as provided in this chapter, shall pay a nonrefundable application fee as follows: BEFORE AFTER INSTALLATION INSTALLATION Aboveground $50.00 $100.00 Belowground $35.00 $ 70.00 (Ord. 8041 §7). 11.04.120 Exceptions. Marquees, awnings, and building mounted signs, completely supported by a private building, in a commercial zone are excepted from the provisions of this chapter. The city engineer may grant conditional permission for the encroachment of marquees, awnings, and building mounted signs. All such installations shall be in conformance with the requirements and regulations of the Uniform Building Code, latest edition, and the city sign ordinance. I. RECOMMENDATION It is recommended that the Design Review Board and Planning Commission APPROVE the Negative Declaration issued by the Land Use Planning Manager and ADOPT Resolution Nos. 2345 and 042, DENYING CUP-249 and RP/CUP 84-15 based on the findings contained therein. It is further recommended that the Planning Commission direct staff to begin immediate abatement procedures on all illegally placed bus benches. II. PROJECT DESCRIPTION The applicant is requesting approval of a Conditional Use Permit to allow bus bench advertising at 51 locations throughout Carlsbad. Most of the requested bus benches are already in place. Most, but not all, of the benches currently display advertising. Benches would be blank when advertising space has not been leased. The advertising space is generally leased in three month increments. Each bench can accommodate one or two advertisers. Twenty-one of the benches are located in the Village Re- development Area (please see Exhibif'A", attached list of bench locations). The Village Design Manual states that no street furniture should be located in the project area without prior approval of the Design Review Board or upon appeal of the Housing and Redevelopment Commission. The City's Sign Ordinance provides that the Planning Commission, and in the event of a dispute the City Council, may conditionally approve bench advertising. Permits for the placement of such benches are subject to any conditions imposed by the Planning Commission and the following standard conditions: 1) The permit shall allow the placement of such a bench in one specific place within the city and no other; 2) The permittee shall furnish proof that the city is named as an additional insured on a policy of liability insurance in the amount of not less than ten thousand dollars covering liability arising in connection with such bench or benches; 3) Either the city planning commission or council may demand the immediate removal of such bench or benches at any time, in its sole discretion, without liability to the permittee; 4) In the event of such a demand for removal and the failure of permittee to immediately remove, the city may itself remove the benches in question, without liability to the permittee; 5) A permit fee of five dollars per bench per year permitted shall be paid to the city. The City's Municipal Code further provides that the City Council may grant conditional permission to install and maintain encroachments in the public right-of-way when it is determined that it will not be detrimental to the interests of the city. The application fee for the required encroachment permit is $50 before installation and $100 after installation. As previously noted, most requested bench signs are in place. No conditional use permit or encroachment permits have been granted for any of the benches. In late 1980, the City Council considered a bus shelter program which incorporated advertising. Although expressing some concerns, the City Council approved the concept and directed staff to prepare a zone code amendment bringing shelters under the same provisions as bench advertising. An amendment was prepared and denied by the Planning Commission as having a detrimental affect on the public's health and welfare and creating adverse visual impacts on the community and because climatic conditions in Carlsbad do not warrant bus shelters with advertising. Due to the provision of the Village Design Manual requiring Design Review Board approval of street furniture, the project is being brought before both the Design Review Board and Planning Commission for consideration. If approved by both bodies, the applicant must then seek City Council approval of the necessary encroachment permits. Ill. ANALYSIS Planning Issues 1) Is the proposed project consistent with the guidelines and objectives of the Village Design Manual? 2) Can the findings required for approval of a conditional use permit be made? -2- Specifically: a) That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the general plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located; b) That the site for the intended use is adequate in size and shape to accommodate the use; c) That all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained; d) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. Discussion Staff does not believe that the proposed project is consistent with the guidelines and objectives of the Village Design Manual. In general, the manual promotes an aesthetically-pleasing and cohesive atmosphere for the village. Particular attention is given both to signage and street furniture. The Design Guidelines state that "enlightened sign control and the artistic selection of external graphics and street furniture are prerequisites for the establishment of the setting." Specifically, the Design Manual indicates that sign designs shall be simple, unobtrusive and coordinated for a consistent and complimentary theme. Staff believes that bench advertising fails to satisfy this criteria for signs and is similarly inappropriate as street furniture. In calling for the "artistic use of external furniture", the Design Manual cites as an example that "advertising on benches and other street furniture should be prohibited." As a part of the Village Streetscaping Program, specific street furniture including benches, were approved. The village benches are constructed of cast iron and oak. Nineteen of these benches are currently being installed, some at locations requested by the applicant. One advertising bench has been relocated by City contractors to accommodate the new bench. The Redevelopment office is currently investigating replacement of the applicant's benches with the village bench. In analyzing the project, staff is unable to make the findings necessary for the required conditional use permit. The finding at issue is whether the requested use is necessary and desirable for the development of the community and is essentially in harmony with the various elements and objectives of the general plan. -3- staff believes that the proposed use is not necessary or desirable for the downtown area or community in general. To properly evaluate the project, the use itself must be fully considered. At best, bus benches can be a desirable amenity. At worst, however, the use is an off-premise sign located in the City right-of-way. Staff believes that the negative aesthetic impacts as well as the precedent for off-premise, billboard- type, signage far outweigh the possible benefits. Staff believes that while the provision of bus benches may be desirable at key locations, bench advertising is obtrusive and aesthetically displeasing. The subject benches are not designed to be an artistic amenity but rather to convey advertising. Because of the variety of advertising, the benches offer no continuity of appearance or control of content or maintenance. Several of the benches observed by staff contained grafitti or were in a general state of disrepair. Finally, staff believes that accommodating and promoting private advertising in a public right-of-way may be inappropriate. Some existing and proposed locations are, in fact, not bus stops and appear chosen solely for high exposure. Encroachments in the right-of-way also have the potential of obstructing motorists' line-of-sight and pedestrian mobility. Street furniture is rapidly being recognized for the importance it plays in establishing themes and enhancing streetscapes. It is for this reason, and those noted above, that bench advertising is prohibited by the Village Design Manual and the newly adopted El Camino Real Development Standards. Noting that the majority of the subject benches are or would be located in the redevelopment area, on El Camino Real or Carlsbad Boulevard (another eligible scenic corridor), staff believes the request is inconsistent with city ordinances and the Scenic Preservation Element of the general plan and generally not desirable for the development of the community. IV. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this project will not have a significant impact on the environment, and therefore, issued a Negative Declaration on August 30, 1984.
