Southern California Edison uses the range an average of 6 days a month for training of their security personnel. In return they pay for all maintenance on the range. Robert Wojcik, engineer- ing department indicates that a delay of up to 23 weeks could occur due to the procedures and permits required prior to construction. It is my understanding that the time frame can be shortened significantly if these procedures and permits are processed at the same time. A second possible route to shorten the time necessary would be to advertise the contract prior to receiving all permits. As you are aware, this item was raised as an issue during the heated labor problem with police employees in 1983. The range construction was approved by the council during that period. The police association has reminded me that they are still concerned about this item and have indicated they wish a more timely resolution. Any efforts you can place in expediting the completion of this project is appreciated. The open space lands surroimding the site are vacant, except for agricultural fields located to the north. The firing range is orientated toward the south and away from the agricultural land use. The outdoor firing range is necessary for the safety of the City's Police Department. It is very important for the department to have firing practice enabling them to react quickly and confidently when a real life shooting situation occurs. The firing range is one of a few outdoor ranges in northem coastal San Diego County, therefore, other law enforcement agencies, including Oceanside Police, the Federal Bureau of Investigation, and the United States Border Patrol train at the facility for a fee. The leasing of the firing range assists other law enforcement agencies and helps the Police Department with the facility's operation and maintenance costs. CUP 256x2 POLICE FIRING RANGE NOVEMBER 2, 1994 PAGE 2 The Planning Department has reviewed the previous staff reports and adopting resolutions for CUP 256 and visited the site. Based on this review, staff concludes that the permit's original conditions of approval are still applicable. The site for the firing range facility is adequate in size and shape to accommodate the land use. The firing range is surrounded by a tall fence and ten to fifteen foot high earthen berms are incorporated into the design of the facility. In addition, the range is orientated toward a steep hillside that acts as a further barrier. Veterans Memorial Park is still considered a fxiture park, the firing range is still isolated from surrounding industrial or residential land uses, and the range is used on a limited basis, approximately ten to twelve times per month. Staff is recommending that all the conditions of CUP 256 be carried over and become the conditions of approval for a five-year extension of the permit. The proposed firing range will be located in an abandoned trailer park within the future Macario Canyon Park. This site was chosen for safety reasons. The existing topography can be incorporated into the design of the firing range to create a suitable barrier. In addition, this site is oriented towards steep hillsides to the south that will provide additional barriers to any stray rounds. Construction of the proposed firing range will require approximately 2000 cubic yards of grading. The surrounding property is vacant at the present time. The property immediately to the north of the site is used for agriculture, but as mentioned previously, the firing range is oriented away from this area. Representatives for the City of Carlsbad's Police Department have informed staff that the firing range they are presently using is inadequate for realistic firing practice. III. ANALYSIS Zone Change 1) Is the Proposed 0-S zone consistent with the OS General Plan designation? 2) Is the proposed O-S zone and the uses allowed within this zone consistent with the surrounding zoning and land uses? Conditional Use Permit 3) Can the four findings, required for approval of a conditional use permit be made? O-S is the implementing zone for property designated OS by the general plan. The proposed O-S, Open Space, zone and the uses allowed within it will be consistent with surrounding zoning and land uses. This zoning will allow this area to be developed into a future city park. This permit will be reviewed on a yearly basis to determine its compatibility with other permitted uses within Macario Canyon Park as it is developed. This range will only be used once or twice a month, so there is a possibility that its use will not conflict with future development within this area, however, that cannot be determined at this time. The site for the proposed use is adequate in size and shape to accommodate the proposed use. Mounding, created by the construction of an abandoned trailer park, will be incorporated into the design of the firing range. In addition, the range will be oriented towards a steep hillside which will act as a further backstop. The proposed firing range will be located over a mile from the nearest existing residence and approximately a half mile from future residential development. This site can only be accessed via dirt roads at the present time. These roads are adequate to provide access to this site by regular vehicles except during heavy winter storms. This should not create any problems for the Police Department as they can schedule their practices around inclement weather. In conclusion, staff believes that the proposed zone change is compatible with the general plan and will not adversely affect any of the adjacent properties. In addition, staff can make all four of the findings necessary for the approval of a conditional use permit. Therefore, staff recommends approval of ZC-314/CUP- CUP-256. IV. Staff has reviewed the staff report and adopting resolution for CUP-256 and visited the site and concludes that the original findings and the conditions placed upon CUP-256 are still valid. Macario Canyon Park is still considered a future park, the firing range is still isolated form surrounding incompatible land uses, and the range is utilized on a limited basis, approximately six times per month. In conclusion, the facility is needed and desirable for the safety of the City's Police Department and for the development of the community. Staff is recommending that all conditions of CUP-256 be carried over and become the conditions of approval for a five-year extension of CUP-256. APPLICANT: CITY OF CARLSBAD CASE NO: CUP-256 WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission did, on the 26th day of September, 1984, hold a duly noticed public hearing to consider said application on property described as: A portion of Lot F of Rancho Agua Hedionda according to Map No. 823 recorded November 16, 1896, WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to CUP-256. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearing, the Commission APPROVES CUP-256, based on the following findings and subject to the following conditions: Findings; 1) The proposed use is necessary and desirable for the development of the community, is essentially in harmony with the various elements of the General Plan, and is not detrimental to existing uses or to uses specifically permitted in this zone, because there is a need for an adequate firing range for the City's Police Department. 2) The site is adequate in size and shape to accommodate the proposed use, because it is isolated from existing and future residential development. 3) All of the yards, setbacks, walls, fences, landscaping and other features necessary to adjust the requested use to existing and permitted future uses in the neighborhood will be provided and maintained, because there are no other uses in the vicinity at this time and this conditional use permit will be reviewed on a yearly basis to determine its compatibility with future development within Macario Canyon Park. 4) The street system serving the subject property is adequate to properly handle all traffic generated by the proposed use, because the existing dirt roads will only be used by the police department in fair weather. 5) This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Land Use Planning Manager on August 30, 1984 and approved by the Planning Commission on September 26, 1984. Conditions: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 3) A master plan of the existing on site trees shall be provided 19 i to the Land Use Planning Manager as part of the final grading plan to determine which trees shall be required to be removed 20 prior to the issuance of a grading permit or a building permit, whichever occurs first. 21 4) This conditional use permit is granted for a period of five 22 years. This conditional use permit shall be reviewed by the Land Use Planning Manager on a yearly basis to determine if 23 all conditions of this permit have been met and that the use does not have a significant detrimental impact on surround- 24 ing properties or the public health and welfare. If the Land Use Planning Manager determines that the use has such 25 significant adverse impacts, the manager shall recommend that the Planning Commission, after providing the permittee the 26 opportunity to be heard, add additional conditions to mitigate the significant adverse impacts. This permit may be revoked 27 at any time after a public hearing, if it is found that the use has a significant detrimental affect on surrounding land 28 uses and the public's health and welfare, or the conditions PC RESO NO. 2355 -2- 1) Approval is granted for CUP-256, as shown on Exhibits "A" and "B", dated September 6, 1984, incorporated by reference and on file in the Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions. 2) The applicant shall prepare a reproducible mylar of the final site plan incorporating the conditions contained herein. This permit may be extended for a reasonable period of time not to exceed five years upon written application of the permittee made not less than 90 days prior to the expiration date. In granting such extension, the Planning Commission shall find that no substantial adverse affect on surrounding land uses or the public's health and welfare will result because of the continuation of the permitted use. If a substantial adverse affect on surrounding land uses or the public's health and welfare is found, the extension shall be considered as an original application for a conditional use permit. There is no limit to the number of extensions the Planning Commission may grant. Engineering Conditions: 5) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. 6) A separate grading plan shall be submitted and approved and a separate grading permit issued for the borrow or disposal site if located within the city limits. 7) All slopes within this project shall be no steeper than 2:1. except that the backstop may be 1:1. 8) The developer shall exercise special care during the construction phase of this project to prevent any off-site siltation. The developer shall provide erosion control measures and shall construct temporary desiltation/detention basins of type, size and location as approved by the City Engineer. The basins and erosion control measures shall be shown and specified on the grading plan and shall be constructed to the satisfaction of the City Engineer prior to the start of any other grading operations. Prior to the removal of any basins or facilities so constructed the area served shall be protected by additional drainage facilities, slope erosion control measures and other methods required or approved by the City Engineer. I. RECOMMENDATION It is recommended that the Planning Commission APPROVE the Negative Declaration issued by the Land Use Planning Manager and ADOPT Resolution No. 2354 recommending APPROVAL of ZC-314 and Resolution No. 2355 APPROVING CUP-256 based on the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION As mentioned above, this is a two-part application. The first portion is a zone change for 288 acres which comprise the portion of the future Macario Canyon Park that is presently owned by the City. The requested zone change would change the zoning from L- C, Limited Control, to 0-S, Open Space. The rezone to 0-S would bring the zoning of the property into conformance with the General Plan and would allow the City of Carlsbad's Police Department to apply for a Conditional Use Permit to build a Police Firing Range. The L-C, Limited Control zone is a holding zone which does not permit any conditional use permits. The proposed firing range will be located in an abandoned trailer park within the future Macario Canyon Park. This site was chosen for safety reasons. The existing topography can be incorporated into the design of the firing range to create a suitable barrier. In addition, this site is oriented towards steep hillsides to the south that will provide additional barriers to any stray rounds. Construction of the proposed firing range will require approximately 2000 cubic yards of grading. The surrounding property is vacant at the present time. The property immediately to the north of the site is used for agriculture, but as mentioned previously, the firing range is oriented away from this area. Representatives for the City of Carlsbad's Police Department have informed staff that the firing range they are presently using is inadequate for realistic firing practice. III. ANALYSIS Zone Change 1) Is the Proposed 0-S zone consistent with the OS General Plan designation? 2) Is the proposed 0-S zone and the uses allowed within this zone consistent with the surrounding zoning and land uses? Conditional Use Permit 3) Can the four findings, required for approval of a conditional use permit be made? Specifically: a) That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the general plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located? b) That the site for the intended use is adequate in size and shape to accommodate the use; c) That all yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained; d) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. Discussion The proposed zone change to 0-S is consistent with the subject property's general plan designation of OS, Open Space. 0-S is the implementing zone for property designated OS by the general plan. The existing L-C, Limited Control zone was just a holding zone to facilitate the annexation of this property into the City of Carlsbad. The proposed 0-S, Open Space, zone and the uses allowed within it will be consistent with surrounding zoning and land uses. This zoning will allow this area to be developed into a future city park. This zoning will also allow the police department to construct a firing range on a .88 acre site within this area. The City of Carlsbad has already certified an Environmental Impact Report and approved a plan for the development of this area as a future city park. •2- Conditional Use Permit The requested use is necessary for the safety of the City's Police Department. As mentioned previously, the Police Department lacks adequate facilities for realistic firing practice. It is important for the department to have realistic firing practice to enable them to react in a rapid, confident manner when a real life situation occurs. The City Council realizes the importance of this need and has already authorized funds for the construction of this facility. At this time, staff does not know the exact date of the development of Macario Canyon Park. This permit will be reviewed on a yearly basis to determine its compatibility with other permitted uses within Macario Canyon Park as it is developed. This range will only be used once or twice a month, so there is a possibility that its use will not conflict with future development within this area, however, that cannot be determined at this time. The site for the proposed use is adequate in size and shape to accommodate the proposed use. Mounding, created by the construction of an abandoned trailer park, will be incorporated into the design of the firing range. In addition, the range will be oriented towards a steep hillside which will act as a further backstop. The proposed firing range will be located over a mile from the nearest existing residence and approximately a half mile from future residential development. This site can only be accessed via dirt roads at the present time. These roads are adequate to provide access to this site by regular vehicles except during heavy winter storms. This should not create any problems for the Police Department as they can schedule their practices around inclement weather. In conclusion, staff believes that the proposed zone change is compatible with the general plan and will not adversely affect any of the adjacent properties. In addition, staff can make all four of the findings necessary for the approval of a conditional use permit. Therefore, staff recommends approval of ZC-314/CUP- CUP-256. IV. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this project will not have a significant impact on the environment and, therefore, has issued a Negative Declaration on August 30, 1984. -3- Attachments 1.
