NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Carisbad will hold a public
hearing at the Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:00 p.m. on
Wednesday, November 2, 1994, to consider a request for approval of an extension of Conditional Use
Permit 256 allowing the continued operation of the City's Police Department firing range facility located
on a .88 acre site in the future Veterans Memorial Park located in the OS Zone in Local Facilities
Management Zone 8 and more particularly described as:
A portion of Lot F of Rancho Agua Hedionda in the City of Carlsbad,
State of California, according to Map No. 823 recorded November 16,
1896 in the office of the San Diego County Recorder.
Those persons wishing to speak on this proposal are cordially invited to attend the public hearing. Copies
of the staff report will be available on and after October 27, 1994. If you have any questions, please call

review, a Negative Declaration (declaration that the project will not
have a significant iinpact on the envirorment) is herdby issued for the

RE: RANGE INCOME
Currently we do not charge other police agencies for the use of the police
range. Only Oceanside Police Dept. uses the range on a regular basis, all
other agencies are quarterly. Southern California Edison uses the range an
average of 6 days a month for training of their security personnel. In
return they pay for all maintenance on the range. This maintenance
includes: Dumpster costs, porta-potti costs, and all weed control. In
addition they paid for the existing fencing ($12,000.00) and have twice
paid to have the road re-graded at a cost of $2500.00 each time. They are
happy with the arrangement and it serves the department well.

The Costa Real Municipal Water District has reviewed the subject
application for a zone change for the portion of the property of
the City's "Macario Canyon Park" which is to be utilized for a

time with respect to the public water service to the property.
Public water service will be made available to the proposed
Macario Canyon Park area from existing facilities of the District
as well as new facilities that will be constructed as a part of the
overall development projects for the area. At such time the specific

Recently I have been informed that there could be a considerable delay in the
completion of the approved temporary police firing range. Robert Wojcik, engineer-
ing department indicates that a delay of up to 23 weeks could occur due to the
procedures and permits required prior to construction.
It is my understanding that the time frame can be shortened significantly if these
procedures and permits are processed at the same time. A second possible route to
shorten the time necessary would be to advertise the contract prior to receiving
all permits.
As you are aware, this item was raised as an issue during the heated labor problem
with police employees in 1983. The range construction was approved by the council
during that period. The police association has reminded me that they are still
concerned about this item and have indicated they wish a more timely resolution.
Any efforts you can place in expediting the completion of this project is appreciated.
I have attached both the notification of timeframes from Robert Wojcik and my
memorandum to the city engineer.

n. PROJECT DESCRIPTION AND BACKGROUND
On September 26, 1984 the Plarming Commission approved CUP 256 to construct and operate
a police firing range in the future Veterans Memorial Park (formerly known as Macario Canyon
Park). On November 15, 1989 the Planning Commission granted a five-year extension of the
conditional use permit (CUP). The Police Department is requesting another five-year extension
of the permit to continue their operations at the site. This site was chosen for safety reasons.
This canyon site is isolated and surrounded by steep hillsides. The hillsides create a suitable
barrier to prevent stray rounds and noise from exiting the area. The open space lands
surroimding the site are vacant, except for agricultural fields located to the north. The firing
range is orientated toward the south and away from the agricultural land use.
The outdoor firing range is necessary for the safety of the City's Police Department. It is very
important for the department to have firing practice enabling them to react quickly and
confidently when a real life shooting situation occurs. The firing range is one of a few outdoor
ranges in northem coastal San Diego County, therefore, other law enforcement agencies,
including Oceanside Police, the Federal Bureau of Investigation, and the United States Border
Patrol train at the facility for a fee. The leasing of the firing range assists other law enforcement
agencies and helps the Police Department with the facility's operation and maintenance costs.

The Planning Department has reviewed the previous staff reports and adopting resolutions for
CUP 256 and visited the site. Based on this review, staff concludes that the permit's original
conditions of approval are still applicable. The site for the firing range facility is adequate in
size and shape to accommodate the land use. The firing range is surrounded by a tall fence and
ten to fifteen foot high earthen berms are incorporated into the design of the facility. In addition,
the range is orientated toward a steep hillside that acts as a further barrier. Veterans Memorial
Park is still considered a fxiture park, the firing range is still isolated from surrounding industrial
or residential land uses, and the range is used on a limited basis, approximately ten to twelve
times per month.
Staff is recommending that all the conditions of CUP 256 be carried over and become the
conditions of approval for a five-year extension of the permit. Veterans Memorial Park is still
slated for fixture development, therefore, staff is also recommending that the CUP be reviewed
by the Planning Director on a yearly basis to determine its compatibility with other permitted
land uses within Veterans Memorial Park as the area develops.
in. ENVIRONMENTAL REVIEW
The environmental impacts of this CUP have akeady been considered in the project's original
Negative Declaration approved by the Planning Commission on September 26, 1984. The facility
has been in operation for over 10 years and is clarified as a categorically exempt project under
Section 15301 of the CEQA guidelines. The CUP extension allows the continued operation of
an existing pubUc facility. Continued operation of the firing range is within the scope of the
original environmental document and will not create additional significant adverse environmental
impacts.
IV. SUMMARY
The operation of the police firing range complies with the conditions of CUP 256, and will not
significantly impact the environment, therefore, staff recommends approval of a five-year
extension for CUP 256x2

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A FIVE-
YEAR EXTENSION OF A CONDITIONAL USE PERMIT TO
CONTINUE THE OPERATION OF A POLICE FIRING RANGE
ON PROPERTY GENERALLY LOCATED IN THE FUTURE
VETERANS MEMORIAL PARK.

WHEREAS, a verified appUcation has been filed with the City of Carlsbad and
referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request for extension of CUP
256 as provided by that CUP; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Plarming
Commission did, on the 2nd day of November, 1994, hold a duly noticed public hewing to
consider said application on property described as:
A portion of Lot F of Rancho Agua Hedionda in the City of
Carlsbad, State of Califomia, according to Map No. 823 recorded
November 16, 1896 in the office of the San Diego County
Recorder.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to CUP 256x2.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission
of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct
B) That based on the evidence presented at the public hearing, the Commission APPROVES
CUP 256x2, based on the following findings and subject to the following conditions:
Findings;
1. That the findings of Planning Commission Resolution Nos. 2355 and 2938 are still
applicable to the continued operation of the police firing range, except, currently the
facility is not used exclusively by the City's Police Department The Police
1 Department allows other law enforcement agencies to train at the facility, which
provides an important regional service and helps pay for the facility's maintenance
2 and operation costs.

" The Planning Conmiission finds that the conditional use pemiit extension is
4 categorically exempt from further environmental review according to Section 15301
ofthe CEQA guidelines, and the environmental impacts of this project have already
5 been considered during the original approval of CUP 256, resulting in the approval
of a Negative Declaration dated September 26,1984. The continued operation of the
^ firing range is within the scope of the original environmental document, and there
^ are no additional significant adverse impacts to the environment.
8 3, There will be no substantial adverse impacts on surrounding land uses or to the
public's health and welfare due to the continuation of this use. The facility is used
9 on a limited basis, during fair weather, and does not significantly impact the existing
dirt access road.
11 4. The applicant has satisfactorily complied with all conditions of approval imposed
upon CUP 256 as stated in Planning Commission Resolution Nos. 2355 and 2938.
12 The Planning Commission has reviewed these conditions and determined that they
are adequate and shall apply as conditions of approval for CUP 256x2.

15 1. All conditions of approval imposed upon CUP 256 as stated in Planning Commission
Resolution Nos. 2355 and 2938 shall apply as conditions of approval for CUP 256x2,
"16 except Condition No. 4 of Planning Commission No. 2355, which is replaced by
^ ^ Condition No. 2 below.
13 2. This conditional use permit is extended for a period of five years. This conditional use
permit shall be reviewed by the Planning Director on a yearly basis to determine if all
19 conditions of this permit have been met and that the use does not have a significant
detrimental impact on surroimding properties or the public health and welfare. If the
Planning Director determines that the use has such significant adverse impacts, the
21 Planning Director shall recommend that the Planning Commission, after providing the
permittee the opportunity to be heard, add additional conditions to mitigate the significant
22 adverse impacts. This permit may be revoked at any time after a public hearing, if it is
found that the use has a significant detrimental affect on surrounding land uses and the
23 public's health and welfare, or the conditions imposed herein have not been met. This
2^ permit may be extended for a reasonable period of time not to exceed five years upon
written application of the permittee made no less than 90 days prior to the expiration date.
25 In granting such extension, the Planning Commission shall find that no substantial adverse
affect on surrounding land uses or the public's health and welfare will result because of
2^ the continuation of the permitted use. a substantial adverse affect on surrounding land
27 uses or the public's health and welfare is found, the extension shall be considered as an
original application for a conditional use permit. There is no limit to the number of

WHEREAS, a verified application has been filed with the City of
Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided
by Title 21 of the Carlsbad Municipal Code; and

the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commission
APPROVE CUP-256 extension, based on the following findings and subject to
the following conditions:

1. That the requested use is necessary or desirable for the development of
the community, is essentially in harmony with the various elements and
objectives of the general plan, and is not detrimental to existing uses
or to uses specifically permitted in the zone in which the proposed use
is to be located;
2. That the site has proven to be adequate in size and shape to accommodate

5. The environmental impacts of this project have already been considered
during the original approval of CUP-256, resulting in the issuance of a
Negative Declaration dated August 30, 1984. Staff has issued a Notice of
Prior Environmental Compliance dated October 18, 1989.
6. There will be no substantial adverse impacts on surrounding land uses or
to the public's health and welfare due to the continuation of this use.
7. The applicant has satisfactorily complied with all conditions of approval
imposed upon CUP-256 as stated in Planning Commission Resolution No. 2355.
Staff has reviewed these conditions and determined that they are adequate
and shall apply as conditions of approval for CUP-256 extension.
Conditions:
1. This Conditional Use Permit shall be reviewed on a yearly basis to
determine its compatibility with other permitted uses within the^future
Macario Canyon Park as the park is developed.
2. All conditions of approval imposed upon CUP-256 as stated in Planning
Commission Resolution No. 2355 shall apply as conditions of approval for
CUP-256 Extension.

2) The site is adequate in size and shape to accommodate the
proposed use, because it is isolated from existing and future
residential development.
3) All of the yards, setbacks, walls, fences, landscaping and
other features necessary to adjust the requested use to
existing and permitted future uses in the neighborhood will be
provided and maintained, because there are no other uses in
the vicinity at this time and this conditional use permit will
be reviewed on a yearly basis to determine its compatibility
with future development within Macario Canyon Park.
4) The street system serving the subject property is adequate to
properly handle all traffic generated by the proposed use,
because the existing dirt roads will only be used by the
police department in fair weather.
5) This project will not cause any significant environmental
impacts and a Negative Declaration has been issued by the Land
Use Planning Manager on August 30, 1984 and approved by the
Planning Commission on September 26, 1984.
Conditions:
1) Approval is granted for CUP-256, as shown on Exhibits "Af and
"B", dated September 6, 1984, incorporated by reference ^nd on
file in the Land Use Planning Office. Development shall occur
substantially as shown unless otherwise noted in these
conditions.
2) The applicant shall prepare a reproducible mylar of the final
site plan incorporating the conditions contained herein. Said
site plan shall be submitted to and approved by the Land Use
Planning Manager prior to the issuance of building permits.
3) A master plan of the existing on site trees shall be provided
19 j to the Land Use Planning Manager as part of the final grading
plan to determine which trees shall be required to be removed
20 prior to the issuance of a grading permit or a building
permit, whichever occurs first.

4) This conditional use permit is granted for a period of five
22 years. This conditional use permit shall be reviewed by the
Land Use Planning Manager on a yearly basis to determine if
23 all conditions of this permit have been met and that the use
does not have a significant detrimental impact on surround-
24 ing properties or the public health and welfare. If the Land
Use Planning Manager determines that the use has such
25 significant adverse impacts, the manager shall recommend that
the Planning Commission, after providing the permittee the
26 opportunity to be heard, add additional conditions to mitigate
the significant adverse impacts. This permit may be revoked
27 at any time after a public hearing, if it is found that the
use has a significant detrimental affect on surrounding land
28 uses and the public's health and welfare, or the conditions

1 imposed herein have not been met. This permit may be extended
for a reasonable period of time not to exceed five years upon
2 -written application of the permittee made not less than 90
days prior to the expiration date. In granting such
3 extension, the Planning Commission shall find that no
substantial adverse affect on surrounding land uses or the
4 public's health and welfare will result because of the
continuation of the permitted use. If a substantial adverse
5 affect on surrounding land uses or the public's health and
welfare is found, the extension shall be considered as an
6 original application for a conditional use permit. There is
no limit to the number of extensions the Planning Commission
7 may grant.
8 Engineering Conditions:
9 5) The developer shall obtain a grading permit prior to the
commencement of any clearing or grading of the site.

6) A separate grading plan shall be submitted and approved and a
11 separate grading permit issued for the twrrow or disposal site
if located within the city limits.

7) All slopes within this project shall be no steeper than Z: 1.
13 except that the backstop may be 1:1.
14 8) The developer shall exercise special care during the
construction phase of this project to prevent any off-site
15 siltation. The developer shall provide erosion control
measures and shall construct temporary desiltation/detention
16 basins of type, size and location as approved by the City
Engineer. The basins and erosion control measures shall be
17 shown and specified on the grading plan and shall be
constructed to the satisfaction of the City Engineer prior to
18 the start of any other grading operations. Prior to the
removal of any basins or facilities so constructed the area
19 served shall be protected by additional drainage facilities,
slope erosion control measures and other methods required or
20 approved by the City Engineer. The developer shall maintain
the temporary basins and erosion control measures for a period
21 of time satisfactory to the City Engineer and shall guarantee
their maintenance and satisfactory performance through cash
22 deposit and bonding in amounts and types suitable to the City
Engineer.

9) Additional drainage easements and drainage structures shall be
24 provided or installed as may be required by the County
Department of Sanitation and Flood Control or the City Engi-
25 neer.

SUBJECT: 2C-314/CUP-256 - CITY OF CARLSBAD - Request for a zone
change from L-C to 0-S for 288 acres and a conditional
use permit for a Police Firing Range on an .88 acre site
within the 288 acres which comprise the future Macario
Canyon Park.
I. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2354 recommending APPROVAL of ZC-314 and
Resolution No. 2355 APPROVING CUP-256 based on the findings and
subject to the conditions contained therein.
II. PROJECT DESCRIPTION ^
As mentioned above, this is a two-part application. The first
portion is a zone change for 288 acres which comprise the portion
of the future Macario Canyon Park that is presently owned by the
City. The requested zone change would change the zoning from L-
C, Limited Control, to 0-S, Open Space. The rezone to 0-S would
bring the zoning of the property into conformance with the
General Plan and would allow the City of Carlsbad's Police
Department to apply for a Conditional Use Permit to build a
Police Firing Range. The L-C, Limited Control zone is a holding
zone which does not permit any conditional use permits.
The proposed firing range will be located in an abandoned
trailer park within the future Macario Canyon Park. This site
was chosen for safety reasons. The existing topography can be
incorporated into the design of the firing range to create a
suitable barrier. In addition, this site is oriented towards
steep hillsides to the south that will provide additional
barriers to any stray rounds. Construction of the proposed
firing range will require approximately 2000 cubic yards of
grading.
The surrounding property is vacant at the present time. The
property immediately to the north of the site is used for
agriculture, but as mentioned previously, the firing range is
oriented away from this area.
Representatives for the City of Carlsbad's Police Department
have informed staff that the firing range they are presently
using is inadequate for realistic firing practice.
III. ANALYSIS
Zone Change
1) Is the Proposed 0-S zone consistent with the OS General Plan
designation?
2) Is the proposed O-S zone and the uses allowed within this
zone consistent with the surrounding zoning and land uses?
Conditional Use Permit
3) Can the four findings, required for approval of a
conditional use permit be made? Specifically:
a) That the requested use is necessary or desirable for
the development of the community, is essentially in
harmony with the various elements and objectives of the
general plan, and is not detrimental to existing uses
or to uses specifically permitted in the zone in which
the proposed use is to be located?
b) That the site for the intended use is adequate in size
and shape to accommodate the use; }
c) That all yards, setbacks, walls, fences, landscaping,
and other features necessary to adjust the requested
use to existing or permitted future uses in the
neighborhood will be provided and maintained;
d) That the street system serving the proposed use is
adequate to properly handle all traffic generated by
the proposed use.
Discussion
The proposed zone change to O-S is consistent with the subject
property's general plan designation of OS, Open Space. O-S is
the implementing zone for property designated OS by the general
plan. The existing L-C, Limited Control zone was just a holding
zone to facilitate the annexation of this property into the City
of Carlsbad.
The proposed O-S, Open Space, zone and the uses allowed within
it will be consistent with surrounding zoning and land uses.
This zoning will allow this area to be developed into a future
city park. This zoning will also allow the police department to
construct a firing range on a .88 acre site within this area.
The City of Carlsbad has already certified an Environmental
Impact Report and approved a plan for the development of this
area as a future city park.

Conditional Use Permit
The requested use is necessary for the safety of the City's
Police Department. As mentioned previously, the Police
Department lacks adequate facilities for realistic firing
practice. It is important for the department to have realistic
firing practice to enable them to react in a rapid, confident
manner when a real life situation occurs. The City Council
realizes the importance of this need and has already authorized
funds for the construction of this facility.
At this time, staff does not know the exact date of the
development of Macario Canyon Park. This permit will be
reviewed on a yearly basis to determine its compatibility with
other permitted uses within Macario Canyon Park as it is
developed. This range will only be used once or twice a month,
so there is a possibility that its use will not conflict with
future development within this area, however, that cannot be
determined at this time.
The site for the proposed use is adequate in size and shape to
accommodate the proposed use. Mounding, created by the
construction of an abandoned trailer park, will be incorporated
into the design of the firing range. In addition, the range
will be oriented towards a steep hillside which will act as a
further backstop.
The proposed firing range will be located over a mile from the
nearest existing residence and approximately a half mile from
future residential development.
This site can only be accessed via dirt roads at the present
time. These roads are adequate to provide access to this site
by regular vehicles except during heavy winter storms. This
should not create any problems for the Police Department as they
can schedule their practices around inclement weather.
In conclusion, staff believes that the proposed zone change is
compatible with the general plan and will not adversely affect
any of the adjacent properties. In addition, staff can make all
four of the findings necessary for the approval of a conditional
use permit. Therefore, staff recommends approval of ZC-314/CUP-
CUP-256.
IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not have a significant impact on the environment and,
therefore, has issued a Negative Declaration on August 30, 1984.

I. RECOMMENDATION

IL PROJECT DESCRIPTION AND BACKGROUND
On September 26, 1984 the Planning Commission approved CUP-256 to construct and
operate a police firing range in the future Macario Canyon Park. This site was
chosen for safety reasons. The existing topography with steep surrounding
hillsides creates a suitable barrier, to prevent stray rounds from exiting the
site. At the time of approval, properties surrounding the site were vacant
except for an agricultural use to the north, which is orientated away from the
firing range. The Police Department is requesting a five-year extension of the
CUP to continue their operations at the subject site.
Staff has reviewed the staff report and adopting resolution for CUP-256 and
visited the site and concludes that the original findings and the conditions
placed upon CUP-256 are still valid. Macario Canyon Park is still considered
a future park, the firing range is still isolated form surrounding incompatible
land uses, and the range is utilized on a limited basis, approximately six times
per month.
In conclusion, the facility is needed and desirable for the safety of the City's
Police Department and for the development of the community. Staff is
recommending that all conditions of CUP-256 be carried over and become the
conditions of approval for a five-year extension of CUP-256. Macario Canyon Park
is still slated to be developed, therefore, staff is also recommending that the
permit be reviewed on a yearly basis to determine its compatibility with other
permitted uses within Macario Canyon Park as it is developed.

Discussion
The proposed zone change to 0-S is consistent with the subject
property's general plan designation of OS, Open Space. 0-S is
the implementing zone for property designated OS by the general
plan. The existing L-C, Limited Control zone was just a holding
zone to facilitate the annexation of this property into the City
of Carlsbad.
The proposed O-S, Open Space, zone and the uses allowed within
it will be consistent with surrounding zoning and land uses.
This zoning will allow this area to be developed into a future
city park. This zoning will also allow the police department to
construct a firing range on a .88 acre site within this area.
The City of Carlsbad has already certified an Environmental
Impact Report and approved a plan for the development of this
area as a future city park.

Conditional Use Permit
The requested use is necessary for the safety of the City's
Police Department. As mentioned previously, the Police
Department lacks adequate facilities for realistic firing
practice. It is important for the department to have realistic
firing practice to enable them to react in a rapid, confident
manner when a real life situation occurs. The City Council
realizes the importance of this need and has already authorized
funds for the construction of this facility.
At this time, staff does not know the exact date of the
development of Macario Canyon Park. This permit will be
reviewed on a yearly basis to determine its compatibility with
other permitted uses within Macario Canyon Park as it is
developed. This range will only be used once or twice a month,
so there is a possibility that its use will not conflict with
future development within this area, however, that cannot be
determined at this time.
The site for the proposed use is adequate in size and shape to
accommodate the proposed use. Mounding, created by the
construction of an abandoned trailer park, will be incorporated
into the design of the firing range. In addition, the range
will be oriented towards a steep hillside which will act as a
further backstop.
The proposed firing range will be located over a mile from the
nearest existing residence and approximately a half mile from
future residential development.
This site can only be accessed via dirt roads at the present
time. These roads are adequate to provide access to this site
by regular vehicles except during heavy winter storms. This
should not create any problems for the Police Department as they
can schedule their practices around inclement weather.
In conclusion, staff believes that the proposed zone change is
compatible with the general plan and will not adversely affect
any of the adjacent properties. In addition, staff can make all
four of the findings necessary for the approval of a conditional
use permit. Therefore, staff recommends approval of ZC-314/CUP-
CUP-256.
IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not have a significant impact on the environment and,
therefore, has issued a Negative Declaration on August 30, 1984.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
CONDITIONAL USE PERMIT TO CONSTRUCT AND OPERATE
A POLICE FIRING RANGE ON PROPERTY GENERALLY
LOCATED IN THE FUTURE MACARIO CANYON PARK.
APPLICANT: CITY OF CARLSBAD

WHEREAS, a verified application has been filed with the
City of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code,
the Planning Commission did, on the 26th day of September, 1984,
hold a duly noticed public hearing to consider said application on
property described as:
A portion of Lot F of Rancho Agua Hedionda according to
Map No. 823 recorded November 16, 1896,
WHEREAS, at said hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be
heard, said Commission considered all factors relating to CUP-256.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
(A) That the foregoing recitations are true and correct.
(B) That based on the evidence presented at the public hearing, the
Commission APPROVES CUP-256, based on the following findings
and subject to the following conditions:
Findings;
1) The proposed use is necessary and desirable for the
development of the community, is essentially in harmony with
the various elements of the General Plan, and is not
detrimental to existing uses or to uses specifically
permitted in this zone, because there is a need for an
adequate firing range for the City's Police Department.
2) The site is adequate in size and shape to accommodate the
proposed use, because it is isolated from existing and future
residential development.
3) All of the yards, setbacks, walls, fences, landscaping and
other features necessary to adjust the requested use to
existing and permitted future uses in the neighborhood will be
provided and maintained, because there are no other uses in
the vicinity at this time and this conditional use permit will
be reviewed on a yearly basis to determine its compatibility
with future development within Macario Canyon Park.
4) The street system serving the subject property is adequate to
properly handle all traffic generated by the proposed use,
because the existing dirt roads will only be used by the
police department in fair weather.
5) This project will not cause any significant environmental
impacts and a Negative Declaration has been issued by the Land
Use Planning Manager on August 30, 1984 and approved by the
Planning Commission on September 26, 1984.

3) A master plan of the existing on site trees shall be provided
19 i to the Land Use Planning Manager as part of the final grading
plan to determine which trees shall be required to be removed
20 prior to the issuance of a grading permit or a building
permit, whichever occurs first.

4) This conditional use permit is granted for a period of five
22 years. This conditional use permit shall be reviewed by the
Land Use Planning Manager on a yearly basis to determine if
23 all conditions of this permit have been met and that the use
does not have a significant detrimental impact on surround-
24 ing properties or the public health and welfare. If the Land
Use Planning Manager determines that the use has such
25 significant adverse impacts, the manager shall recommend that
the Planning Commission, after providing the permittee the
26 opportunity to be heard, add additional conditions to mitigate
the significant adverse impacts. This permit may be revoked
27 at any time after a public hearing, if it is found that the
use has a significant detrimental affect on surrounding land
28 uses and the public's health and welfare, or the conditions

1) Approval is granted for CUP-256, as shown on Exhibits "A" and
"B", dated September 6, 1984, incorporated by reference and on
file in the Land Use Planning Office. Development shall occur
substantially as shown unless otherwise noted in these
conditions.
2) The applicant shall prepare a reproducible mylar of the final
site plan incorporating the conditions contained herein. Said
site plan shall be submitted to and approved by the Land Use
Planning Manager prior to the issuance of building permits.

imposed herein have not been met. This permit may be extended
for a reasonable period of time not to exceed five years upon
written application of the permittee made not less than 90
days prior to the expiration date. In granting such
extension, the Planning Commission shall find that no
substantial adverse affect on surrounding land uses or the
public's health and welfare will result because of the
continuation of the permitted use. If a substantial adverse
affect on surrounding land uses or the public's health and
welfare is found, the extension shall be considered as an
original application for a conditional use permit. There is
no limit to the number of extensions the Planning Commission
may grant.
Engineering Conditions:
5) The developer shall obtain a grading permit prior to the
commencement of any clearing or grading of the site.
6) A separate grading plan shall be submitted and approved and a
separate grading permit issued for the borrow or disposal site
if located within the city limits.
7) All slopes within this project shall be no steeper than 2:1.
except that the backstop may be 1:1.
8) The developer shall exercise special care during the
construction phase of this project to prevent any off-site
siltation. The developer shall provide erosion control
measures and shall construct temporary desiltation/detention
basins of type, size and location as approved by the City
Engineer. The basins and erosion control measures shall be
shown and specified on the grading plan and shall be
constructed to the satisfaction of the City Engineer prior to
the start of any other grading operations. Prior to the
removal of any basins or facilities so constructed the area
served shall be protected by additional drainage facilities,
slope erosion control measures and other methods required or
approved by the City Engineer. The developer shall maintain
the temporary basins and erosion control measures for a period
of time satisfactory to the City Engineer and shall guarantee
their maintenance and satisfactory performance through cash
deposit and bonding in amounts and types suitable to the City
Engineer.
9) Additional drainage easements and drainage structures shall be
provided or installed as may be required by the County
Department of Sanitation and Flood Control or the City Engi-
neer.

use permit for a Police Firing Range on an .88 acre site

I. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2354 recommending APPROVAL of ZC-314 and
Resolution No. 2355 APPROVING CUP-256 based on the findings and
subject to the conditions contained therein.
II. PROJECT DESCRIPTION
As mentioned above, this is a two-part application. The first
portion is a zone change for 288 acres which comprise the portion
of the future Macario Canyon Park that is presently owned by the
City. The requested zone change would change the zoning from L-
C, Limited Control, to 0-S, Open Space. The rezone to 0-S would
bring the zoning of the property into conformance with the
General Plan and would allow the City of Carlsbad's Police
Department to apply for a Conditional Use Permit to build a
Police Firing Range. The L-C, Limited Control zone is a holding
zone which does not permit any conditional use permits.
The proposed firing range will be located in an abandoned
trailer park within the future Macario Canyon Park. This site
was chosen for safety reasons. The existing topography can be
incorporated into the design of the firing range to create a
suitable barrier. In addition, this site is oriented towards
steep hillsides to the south that will provide additional
barriers to any stray rounds. Construction of the proposed
firing range will require approximately 2000 cubic yards of
grading.
The surrounding property is vacant at the present time. The
property immediately to the north of the site is used for
agriculture, but as mentioned previously, the firing range is
oriented away from this area.
Representatives for the City of Carlsbad's Police Department
have informed staff that the firing range they are presently
using is inadequate for realistic firing practice.
III. ANALYSIS
Zone Change
1) Is the Proposed 0-S zone consistent with the OS General Plan
designation?
2) Is the proposed 0-S zone and the uses allowed within this
zone consistent with the surrounding zoning and land uses?
Conditional Use Permit
3) Can the four findings, required for approval of a
conditional use permit be made? Specifically:
a) That the requested use is necessary or desirable for
the development of the community, is essentially in
harmony with the various elements and objectives of the
general plan, and is not detrimental to existing uses

the proposed use is to be located?
