Description of Project
The proposed project involves the placement of up to nine temporary 24'
X 40' modular office structures totaling approximately 8,640 square feet to be
located at the City of Carlsbad's Safety Center.
The office structures are to be moved to the site during the month of June,
1988, in order to provide temporary housing for the Carlsbad Unified School District
Education Center staff during the construction period.
Current plans indicate that the structures will be placed ten feet apart;
however, we understand that this will require special authorizations. We are
hopeful that this will be granted, as this is a temporary one-year plan. Twenty
feet is planned between the two rows of buildings.

that we needed some specific guidance in moving this
relocation plan along.

Conditional Use Permit CUD-295, which will be the basis for
the School District bringing in modular relocatable office
facilities.
It was agreed that time is of the essence and that you plan
to put someone on it right away. Please contact me if other

a) The use is temporary, and does not lend itself to phasing.
b) The modulars are placed to make best use of the site,
maximizing the street frontage.
c) The proposed scale of development, using 40* x 24' office
modular units, is the smallest scale that can accommodate the
requirement for providing temporary office space for school
district staff.
d) The ultimate use of this site is additional parking area for
the Safety Center. The proposed temporary use will not affect
this long term plan. Until additional parking is added, the site
is rough graded and vacant.
e) The School District's need for temporary office space is tied
to the City and School District's proposal to redevelop the Pine
Street site, and cannot be put off to some future time.
f) Alternate sites for the administrative offices could be found
in office buildings throughout the City. However, the combination
of office and parking space to fit the School District's require-
ments cannot be found within the limited time available to them.
g) There is no "no project" alternative, since the School District
must maintain its operations in order to continue to serve the
community.

III. DISCUSSION OF ENVIRONMENTAL EVALUATION
The proposed use is temporary — projected time limit is 18
months, and involves no construction or development. There
will be no permanent site alteration except the fine grading
and asphalting of walkways in a previously graded area.
The ultimate use of the area proposed for this project is an
expansion of the existing parking area to the west. As this
site is currently not required for parking, it is a suitable
location for the proposed temporary use.

occupied space on El Camino Real, south of PAR in the old Watkins Building, for administration and bus

Dear Mr. Blair:
With reference to our letter of April 27, the application for an
amendment to CUP 295 is still incomplete as detailed in our
previous letter.
We have spoken to Duane Feasel who has indicated that the School
District is still not certain as to the number of employees who
will need to be housed at the Safety Center site.
In order to submit this proposed amendment to the Planning
Commission, we must have a plan of the proposed uses, and a
parking plan which will provide parking spaces for the employees
in accordance with the zoning code, and an area with aisle
widths, turning radius, and parking spaces adeguate for school
buses.
The original application specifies 9 modular office units and
parking for 60 vehicles. We can process the proposed amendment
in accordance with the application, but would like to point out
some difficulties that may arise:
1. Nine 40' x 24' office modulars will reguire 35 parking
spaces to be assigned and marked exclusively for employee
parking. The remaining 25 spaces can be used for district
vehicles and busses. This 25 may not be adeguate for the
number of vehicles you wish to park on site.
2. If we proceed with the CUP as originally requested, the
Planning Commission approval will be specifically for that
plan. Any changes which you may wish to make with regard to

number of type of modular units, number of employees, or
number of district vehicles may require another amendment.
The time frame for processing a CUP is approximately 6-8 weeks
from complete application. We understand that there is some
urgency in this matter, and would appreciate additional

application is deemed complete, i.e. all information needed to
fully review the project is on file, we cannot continue with our
staff review or schedule it on the Planning Commission agenda.
We would appreciate hearing from you as to how you wish us to
proceed with this application.

I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 3991
Al'PROVING a five year extension of CUP 295x2 based upon the findings and subject to the
conditions contained therein.
II. INTRODUCTION
Fhis proposed five year extension of CUP 295x1 will allow the continued operation of five
temporary modular buildings used by the Carlsbad Unified School District at the City of
(. a. lsbad's Safety Service Center located at 2650 Orion Way through October 31, 2001.
Hi. PROJECT DESCRIPTION AND BACKGROUND
On August 19, 1992, the Planning Commission approved CUP 295x1 to continue the use of five
modular buildings at 2650 Orion Way to October 1, 1996. Condition No. 2 of the approving
CUP Resolution No. 3419 specifies that CUP 295x1 is granted for a period of 5 years but may be
extended upon written application of the permittee (City of Carlsbad). The applicant, City of
Cai lsbad, is requesting a 5 year extension of CUP 295x1 to allow the continued use of the
mciJular buildings at this she. The School District has a lease with the City for the space to
loeate the modulars until September 19, 1998.
IV. ANALYSIS
i\. The Carlsbad Unified School District's modular buildings continue to be consistent with
all applicable plans, policies and regulations described below:
1. Carlsbad General Plan;
2. Local Facilities Management Plan; and
3. Title 21 of the Carlsbad Municipal Code.

B. The adopted project findings for CUP 295, which are contained in Planning Commission
Resolutions No. 2622 and 3419 still apply to this project (CUP 295x2).
C. The adopted project conditions for CUP 295, which are contained in Planning
Commission Resolution No. 2622 still apply to this project (CUP 295x2) with the
exception of Condition No. 2 which is amended by Condition No. 2 in Planning
Commission Resolution No. 3991 to extend CUP 295x1 for 5 years (through October 30,
2001).
D. No formal written complaints regarding CUP 295x1 have been submitted to the City.
E. Annual reviews have been conducted for CUP 295x1 and the project is in compliance
with all conditions of approval
F. The extended CUP should be exempted from environmental review per Section 15301,
Existing Facilities, of CEQA.
V. ENVIRONMENTAL REVIEW
T he Planning Director has determined that this project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the
State CEQA Guidelines and will not have any adverse significant impact on the environment.

I. RECOMMENDATION
That the Planning Commission ADOPT Resolution No. 3419 APPROVING CUP 295x1 based
on the findings and conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
The Carlsbad Unified School District is requesting an extension to the existing Conditional
Use Permit 295, to allow the continued use of five modular buildings, used by the Carlsbad
School District, located in the northeastern area of the City of Carlsbad's Safety Service
Center located at 2560 Orion Way. The original Conditional Use Permit was approved by
the Planning Commission on October 1, 1986.
Four modulars are currently used by the school district for administration, storage, and a
restroom and an office/lounge for the bus drivers of the school district. Some time in
1988-0)9, a modular was moved offsite. Although the modulars were to be temporary and
removed when the school district administrative facility on Pine Avenue was completed,
the school district still needs and uses the modulars. The City of Carlsbad entered into a
year to year lease with the school district for the use of the modulars and a ten year lease
for the space to locate the modulars, which expires on September 19, 1998. The City
would like to extend the time period for the CUP and ensure that the permit retain the
ability to accommodate five modulars in the event a fifth modular was to be retumed on
the site. The fifth modular would be placed as shown on the original site plan.

III. ANALYSIS
Can the four findings required for a Conditional Use permit still be made?
Speciflcally:
a) That the modulars are necessary or desirable for the development of the community,
are essentially in harmony with the various elements of the General Plan and are
not detrimental to the existing uses or to uses specifically permitted in the zone in
which the modulars are located;
b) That the site for the modulars continues to be adequate in size and shape to
accommodate the use;
c) That all of the yards, setbacks, walls, fences, landscaping and other features
necessary to adjust the modulars to the existing or permitted future uses in the
neighborhood is provided and maintained;
d) That the street system serving the modulars is adequate to properly handle all the
proposed traffic generated by the modulars.
DISCUSSION
A. Desirability and Fiarmonv of Use
The modulars continue to provide a desirable use, by providing office space and storage,
on a lease basis, for the Carlsbad Unified School District. The modulars will not be
detrimental to the existing uses as they are physically separated from the police and fire
department offices, and will not conflict with their operations.
B. Adequacy of Site in Size and Shape
The site continues to be adequate in size and shape for the modulars since they are located
in what has been labeled as a future parking area. The modulars maintain setbacks from
the property hnes in excess of 200 feet. The site has maintained adequate parking and
circulation.
C. Features Necessarv to Adiust
All yards, setbacks and other features have been maintained to adjust the modulars to the
site. As mentioned above, adequate setbacks have been provided as well as building
separation. The site has been screened from Orion Way by the use of eucalyptus trees.
Access to the modulars is limited to regular working hours as the site is secured in the
evenings.

D. Adequacy of Street System
The street system continues to adequately serve the modulars. The traffic generated, 244
Average Daily Trips, is less than what the ultimate projected traffic is for the buildout of
the site.
The annual reviews have indicated compliance with the original conditions of approval and
no new conditions are necessary to ensure compatibiUty with the surrounding uses.
IV. ENVIRONMENTAL REVIEW
Since this extension does not alter the original approved use or its impacts, the Plarming
Director has determined that the environmental effects of the project have already been
considered in a Negative Declaration dated August 23, 1986. A notice of Prior Compliance
will be issued for the Conditional Use Permit extension.
SUMMARY
Since the findings for a Conditional Use Permit can still be made for the existing modulars,
staff recommends that the Planning Commission approve the requested extension of the
Conditional Use Permit for a period of five years.

RECOMMENDATION
That the Planning Commission APPROVE the Negative Declaration
issued by the Planning Director and ADOPT Resolution No. 2622
APPROVING CUP-295, based on the findings and subject to the
conditions contained therein.
II. PROJECT DESCRIPTION
The proposed project involves the placement of five temporary
modular office structures totaling approximately 5,500 square
feet to be located at the City of Carlsbad's Safety Center. Two
of the structures will be relocated from their present site at
City Hall. Two other structures will be assembled at the
project site and the fifth structure will be relocated frora its
present site at the Lake Calavera Hills Wastewater Treatment
facility.
The Safety Center is located in an M-Q zone and, as such, the
proposed use is permitted with either the issuance of a
conditional use permit or a site development plan.
Ill. ANALYSIS
Planning Isaues
1) Can the four findings required for approval of a Conditional
Use Permit, be made? Specifically:
a) That the requested use is necessary or desirable for the
development of the community; is essentially in harmony
with various elements and objectives of the General
Plan, and is not detrimental to existing uses or to uses
specifically permitted in the zone in which the proposed
use is to be located;
b) That the site for the intended use is adequate in size
and shape to accommodate the use;

c) That all of the yards, setbacks, walls, fences,
landscaping and other features necessary to adjust the
requested use to existing or permitted future uses in
the neighborhood will be provided and maintained;
d) That the street system serving the proposed use is
adequate to properly handle all traffic generated by the
proposed use.
Discussion
The proposed site for the temporary office structures is to be
located near the Police Administration building which is under
construction at the Safety Center. The modulars are proposed to
include three office structures, a portable restroom and an
employee's lounge. The purpose of the modulars is to house the
water, streets and sanitation divisions of the Utilities and
Maintenance Departments.
The proposed temporary use is desirable in order to solve an
operational "problem which could affect the efficient delivery of
community service. The recent move of the vehicle maintenance
division to the Safety Center has fragmented the operations of
the Utilities and Maintenance (U/M) Department. Currently the
field crew and their vehicles are located at the Oak Street
facility approximately seven miles from the Safety Center.
Further fragmenation will occur when the administrative staff of
U/M moves to the Las Palmas facility. The relocation of the
field staff to the Safety Center would consolidate the field and
maintenance operations at a single location which is also in
close proximity to the Las Palmas facility and the administrative
staff. It should be noted that ultimately all functions of
Utilities and Maintenance will be located at the Safety Center.
There is additional benefit of relocating U/M's field staff to
the Safety Center at this time. The site is centrally located so-
that emergency response time to all sections of the City will be
more rapid than from the Oak Street facility. This last
consideration has become increasingly more important over the
last five years with the development of the southern portion of
the City.
The site is adequate in size and shape to accommodate the use.
The modular buildings will be located in what has been designated
as a future parking area. The modulars will be removed prior to
occupancy of the new Utilities and Maintenance building, which
will require parking in the area occupied by the temporary
structures. All yards, setbacks and other features have been met
as the modulars will be located no less than 200 feet from any
property line.

Finally, the street system serving the site will be adequate to
handle the traffic generated by the use. Presently, Faraday
Avenue carries 1,174 ADT. The proposed use will contribute
another 244 ADT's. The combined total of 1,418 ADT's is well
under the 21,200 ADT's projected for Faraday Avenue.
Overall, staff feels the requirements for a conditional use
perrait can be met by the proposed project, therefore, staff
recommmends approval of CUP-295.
IV. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not
have any significant impact on the environment and, therefore,
has issued a Negative Declarations on August 23, 1986 and
September 2 0, 1986.
