AGREEMENT TO EXTEND TIME LIMITS
TO ALLOW REVIEW OF THE LAND USE
ELEMENT OF THE GENERAL PLAN
In a desire to assist the City of Carlsbad to
expeditiously review the Land Use Element of the General Plan and
to ensure full and adequate review of the application for this
development project the undersigned agrees that the time limits
imposed by law to approve or disapprove this application shall be
extended. If a negative declaration is adopted for this project
the undersigned agrees that the time period for approval or
disapproval is extended for 90 days. If the project requires an
environmental impact report the undersigned agrees that the time
limit impose'? by Section 21151.5 of the Public Resources Code is
extended for six months and that the project shall be approved or
disapproved within 90 days after the certification of the
environmental impact report. The undersigned understands that the
City will process this application according to City Council
Resolution No. 7872 and consents to processing the application
according to that resolution.

STATEMENT OF AGREEMENT
TENTATIVE SUBDIVISION MAP
CITY OF CARLSBAD
The Subdivision Map Act and the Carlsbad Municipal Code sets a
fifty (50) day time restriction on Planning Commission processing
of Tentative Maps and a thirty (30) day time limit for City
Council action. These time limits can only be extended by the
mutual concurrence of the applicant and the City. By accepting
applications for Tentative Maps concurrently with applications
for other approvals which are prerequisites to the map; i.e.,
Environmental Assessment, Environmental Impact Report, Condominium
Plan, Planned Unit Development, etc., the fifty (50) day time
limits and the thirty (30) day time limits are often exceeded.
If you wish to have your application processed concurrently,
this agreement must be signed by the applicant or his agent. If
you choose not to sign the statement, the City will not accept
your application for the Tentative Map until all prior necessary
entitlements have been processed and approved.
The undersigned understands that the processirig time required by
the City may exceed the time limits, therefore the undersigned
agrees to extend the time limits for Planning Commission and
City Council action and fully concurs with any extensions of
time up to one year from the date the application was accepted
as complete to properly review all of the applications.

Gentlemen:
Our District has reviewed the proposed conversion of a rumpus
room to a granny flat at the above-referenced location and
has evaluated the impact of that conversion on the facilities
of the District.
Inasmuch as approval of this request would have no direct
impact upon the enrollment of students in the Carlsbad
Unified School District, we will not require an agreement or
contributions at this time as a result of the conversion.
However, in the event that the flat is converted to a
standard residential unit, we would need that information for
further evaluation. It is highly likely that a school
contribution would be required at that time.

SUBJECT: CUP 298x1 - HINKLEY - Request for an extension of Conditional Use Permit
298 to continue permitting a 226 square foot "granny flat" addition to a
single family residence at 1315 Basswood Avenue in Local Facilities
Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution 3320 APPROVING
a five year extension of CUP 298 based on the findings and subject to the conditions
contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting an extension of Conditional Use Permit 298, which was granted
on December 17th, 1986 and expires December 17th, 1991. Under condition number 17
of Planning Commission Resolution No. 2628, the applicant is given the opportunity to
extend CUP 298 for a maximum of five years.
CUP 298 permits a 226 square foot second dwelling unit to a single family home for use
as a "Granny Flat" at 1315 Basswood Avenue in the R-l Zone.
III. ANALYSIS
1. Can the four findings required for extending Conditional Use Permit 298 still be
made? These requirements are as follows:
a) That the requested use is necessary or desirable for the development of the
community, is essentially in harmony with the various elements and
objectives of the General Plan, and is not detrimental to existing uses or to
uses specifically permitted in the zone in which the proposed use is to be
located;
b) That the site for the intended use is adequate in size and shape to
accommodate the use;

c) That all of the yards, setbacks, walls, fences, landscaping and other features
necessary to adjust the requested use to existing or permitted future uses in
the neighborhood will be provided and maintained;
d) That the street system serving the proposed use is adequate to properly
handle all traffic generated by the proposed use.
2. Does the project still conform with the requirements of Subsection 21.42.010 (11)
(A) titled "Second Dwelling Units" of the Carlsbad Zoning Ordinance?
DISCUSSION
Use of a "Granny Flat" on the property is in harmony with the goals and objectives of the
General Plan, as "Granny Flats" provide opportunities for establishing affordable housing.
The General Plan recognizes the need for "affordable housing opportunities in the City to
meet the needs of groups with special requirements". Currently, the owners (Mr. & Mrs.
Hinkley) of the property are occupying the "Granny Flat" and are renting the main unit to
a family of three. The use is also consistent with the development standards of the R-l
zone, within which the use is proposed. Because the zoning ordinance is the implementing
ordinance of the General Plan, consistency with the General Plan is assured. In addition
to being in harmony with the General Plan, this permit has not been detrimental to existing
uses or future uses of the zone as no complaints in reference to this permit have been filed
with the City.
Because no changes have occurred from the original approval, the site is still adequate in

future uses in the neighborhood have been provided and maintained as required under the
original permit. In addition, the street system, which is fully improved, adequately
accommodates the limited traffic generated by the use.
The project has also conformed with all of the requirements of Subsection
21.42.010(11)(A) titled "Second Dwelling Units" of the Carlsbad Zoning Ordinance and the
Conditions of Plaiming Conmiission Resolution No. 2628.
SUMMARY
Since the four findings required to extend this Conditional Use Permit can still be made and
since the project as proposed conforms with Subsection 21.42.010(11)(A) of the Carlsbad
Zoning Ordinance, staff recommends approval of CUP 298x1.

I. RECOMMENDATION
That the Planning Commission ADOPT Resolution No. 2628
APPROVING CUP-298 based on the findings and subject to the
conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting a conditional use permit to construct
a 226 square foot addition to an existing single family
residential dwelling unit for purposes of creating a "Granny
Flat". As shown on Exhibit "A", this proposed addition would be
located within a sideyard, attached to the rear of a recreation
room, which is part of the existing residence. The recreation
room (294 square feet) would be converted to a living/sleeping
studio. The proposed addition would include a kitchen (130
square feet) and bathroom (96 square feet). The proposed
addition will be composed of wood shingle siding and asphalt roof
shingles which are compatible with the light stucco and asphalt
roof shingle materials of the existing residence.
III. ANALYSIS
Planning Issues
1. Can the four findings, required for the granting of a
condition use permit, be made, which are as follows:
a) That the requested use is necessary or desirable for the
development of the community, is essentially in harmony
with the various elements and objectives of the General
Plan, and is not detrimental to existing uses or to uses
specifically permitted in the zone which the proposed
use is to be located;
b) That the site for the intended use is adequate in size
and shape to accommodate the use;
c) That all of the yards, setbacks, walls, fences,
landscaping and other features necessary to adjust the
requested use to existing or permitted future uses in
the neighborhood will be provided and maintained;
d) That the street system serving the proposed use is
adequate to properly handle all traffic generated by the
proposed use.
2. Does the proposed project conform with the requirements of
S ub section 21.42.010 (11) (A) (Second Dwelling Units) of the
Carlsbad Zoning Ordinance?
Discuss ion
As proposed, it appears that the structural addition for
purposes of creating a "Granny Flat" meets the four findings
necessary for the issuance of a conditional use permit. The use
is overall consistent with the elements and objectives of the
General Plan. One of the Housing Elements primary goals is "to
assure that the City's future development provides an adequate
diversity of housing with types, prices, tenures and locations
consistent with the age and economic characteristics of present
and future residents". It is noted here that there currently
exists an unmet demand for seniors rental housing within the
City of Carlsbad. The proposed "Granny Flat" satisfies both
this General Plan goal and citywide need by providing rental
housing within established single family neighborhoods which can
accommodate senior citizens (60 years or older).
The use as proposed is also consistent with the development
standards of the R-l Zone within which it is proposed. In that
the zoning ordinance is the implementing ordinance of the General
Plan, consistency with the General Plan is assured. Since the
proposed "Granny Flat" should generate very little traffic, it
will not have a deterimental effect on existing uses or on uses
specifically permitted in the zone.
The site appears to be adequate in size and shape to accommodate
the proposed use. As shown on Exhibit "A", all of the yards,
setbacks, fences, landscaping, parking spaces and other features
necessary to adjust the requested use to existing and future
uses in the neighborhood will be provided and maintained.
The subject property is located in an area of the City that has
public streets which should be more than adequate to handle the
limited traffic generated by this project.

As proposed, the project appears to conform with the
requirements of Subsection 21 .42.010(11)(A) (Second Dwelling
Units) of the Carlsbad Zoning Ordinance as discussed below. (1)
The applicant has indicated that the existing residence will
be occupied by the applicant with the "Granny Flat" being
occupied by parents (60 years or older) or rented to a
senior citizen. (2) The size of the existing lot is 10,450
square feet, thereby complying with the minimum 7500 square foot
lot requirement. (3) The second unit addition will add no more
than 226 square feet, thereby complying with the maximum
allowable increase in floor area to the main unit of 350 square
feet. (4) As discussed earlier, the architecture of the second
unit will be compatible with the existing residence. (5) An
additional offstreet, paved parking space will be provided for
the second unit. This space will be located within the yard
along Basswood Avenue. (6) Adequate sewer and water facilities
and capacity are available for the second unit. (7) The "Granny
Flat", as proposed, complies with all of the development
standards of the R-l Zone. (8) The second unit will be attached
at one wall to the existing residence.
Overall, since staff can make the four findings required to
grant a conditional use permit and since the project as proposed
conforms with Subsection 21.42.010(11)(A) of the Carlsbad Zoning
Ordinance, staff recommends approval of CUP-298.
IV. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project qualifies
as a categorial exemption under Subsection 15301(e) of the
California Environmental Quality Act.
