In response to your call on Friday April 28, 1972, please be advised as follows:
1, The Planning Commission did grant a Conditional Use Permit for the Carlsbad Raceway, for a period

2. A CUP requires only Planning Commission action for renewal
3. The procedure of publication and mailed notice of Public Hearing to property owners within a 30fS radiw-. of the property involved was followed. Since your property does not abutt and is outside the 300' radius, you were not included in the list of those persons mailed notlce of the Public Hearing.
4. The granting of the Conditfonal Use Permit by the Planning Commission does allow for appeal to the City Council of this decision within ten (10) days. The final date for an appeal of the CUP granted Carlsbad Raceway Corporation is May 5, 1972.
I enclose for your information, a copy of Planning Commission Resolution No. 749, granting a CUP to the Carlsbad Raceway Corporation, and page 41, Section 2004 of the City's zoning ordinance relating to publlc hearings. I trust this will clarify the positlon of the City of Carlsbad with regard to this matter.
