HomeMy WebLinkAboutCUP 42E; Carlsbad Raceway; Conditional Use Permit (CUP) (20)MEMORANDUM October 24, 1977 nm 10/24/77 TO: FROM: Bud Plender, Assistant Planning Director Charles Grim, Assistant Planner 0% REGARDING: Noise Complaint and Skateboard Park Mr. Ledri's letter of October 18, 1977 is at least his fourth complaint concerning the loud music occurring at or coming from Skateboard Park. The first complaint was received by staff in May of 1976 and was referred to the Police Department. Subse- quent complaints were received in June of 1976 and September of 1977. After the June, 1976 complaint staff phoned Roy Sloane, the developer in charge of park construction. Mr. Sloane indi- cated that the problem would be rectified and installed smaller speakers. Apparently the problem was solved until workers at the site began increasing the volume. After the September, 1977 complaint, staff again called Mr. Sloane who indicated the prob- lem would be solved immediately. The music was turned down for several weeks but has now been increased to nuisance level. None of the conditions listed in the CUP for the Skatepark (42-E) address noise as a problem. The CUP for the entire raceway (42-A) does not contain any conditions for noise limitations either. Ap- parently it was staff's feeling at the time that nothing could produce more noise than automobile racing. Since there are no applicable conditions in the CUP'S, it would appear that options are limited. ATTACHMENTS CUP Conditions CG : nm
