RE: CUP-60 Gaycrest Kennels
Dear Mr. Renshaw:
It has been brought to my attention that you represent a
party who may be interested in the above-referenced
conditional use permit. The permit in question was
approved by Planning Commission Resolution No. 730 in
1971. A copy of that resolution is enclosed herewith.
You will note that Condition 12 of said resolution
requires that a trailer located on the premises be
removed. At the present time, the trailer remains on
the site and is being used as living quarters on a full-
time basis. The trailer is not only in violation of
the terms of the conditional use permit, but it is also
a violation of Section 5.24.145 of the Carlsbad Municipal
Code which prohibits the use of such trailers outside of
an authorized mobile home park.
This matter has been brought to the attention of Mr. Pollard by the City on numerous occasions, including by a letter from the Planning Director dated July 14, 1976. Discussions
have also been held with Mr. Pollard which failed to resolve
the matter. The Planning Director's letter of July 23, 1976
and the City Managers letter of August 3, 1976 explained
the problem further for Mr. Pollard. Copies of the above-
referenced letters are enclosed.
Mr. Pollard has not responded to our letters and continues
to refuse to comply with the terms of his conditional use
permit and continues to persist in his violation of the
Carlsbad Municipal Code. As a result, the Planning
Commission, on September 22, 1976, adopted Resolution No.131,
setting a public hearing to consider the revocation of the

conditional use permit.

1976, at 7:30 P.M. A copy of the resolution is enclosed.

It is not the City’s intention to cause unnecessary
difficulties for the operators of the Gaycrest Kennels.
However, it is not possible for us to continue to allow
the terms of the kennel’s permit, and our ordinance, to
be violated by Mr. Pollard. Unless the trailer is removed
immediately, I would expect that the Planning Commission- would have no choice but to revoke the conditional use permit for a failure of the operator to comply with the
conditions of his permit.
Please advise if you need any further information in
regards to this matter. It remains my hope that I can be
resolved without the necessity of closing the kennel or
instituting a criminal prosecution for the zoning violation,
