12) By law a Conditional Use Permit may be approved only if certain facts
are found to exist. Please read these required facts carefully and ex-
plain how the proposed project meets each of these facts. Use additional
sheets if necessary:
a) Explain why the requested use is necessary or desirable for the de-
velopment of the community, is essentially in harmony with the various
elements and objectives of the General Plan, and-is not detrimental to
existing uses or to uses specifically permitted in the zone in which the
proposed use is to be located:

b) Explain why the site for the intended use is adequate in size -and
shape to accommodate the use:
Has been used previously for Symphony, obviously adequate for purpose.
c) Explain why you believe the proposed yards, setbacks, walls, fences,
landscaping, etc., will be adequate to adjust the requested use to exist-
ing or permitted future uses in the neighborhood:

d) Explain why you believe the street system serving the proposed use
is adequate to properly handle all traffic generated by the proposed use:
Ingress from El Camino Real East on Alga - Thence on Putisma and Alicante to
Site - Adequate for event. Additional Egress to come from opening Alfil
Street after event - thus lessening load on Alga.
As the proposal has been presented to me, I hereby find that the following facts.
apply to the subject request: -
1) That the requested use is necessary or desirable for the development
of the community, is essentially in harmony with the various elements
and objectives of the General Plan, and is not detrimental to existing
uses or to uses specifically permitted in the zone in -which the proposed
use is to be located;
2) That the site for the intended use is adequate in size and shape to
accommodate the use; -

3) That all of the yards, setbacks, walls, fences, landscaping, and other
features necessary to adjust the requested use to existing or permitted
future uses in the neighborhood will be provided and maintained; and
4) That the street system serving the proposed-use is adequate to properly
handle all traffic generaged by the. proposed use. (Ord. 9252, Section

CONDITIONS OF APPROVAL
1) This CUP is granted only for the activity, dates and
place described in the application (CM CUP 79-1) and
as shown on Exhibit "A" dated 6/28/79. This CUP shall
expire at midnight on August 16, 1979.
2) Adequate off street parking to handle the. estimated
attendance shall be provided.
3) Traffic control and security shall be provided by the
applicant as required and approved by the Police
Department. There shall be a minimum of four security
guards, one of which shall be female.
4) A minimum of 15 sanitary units shall be provided by
the applicant in accordance with County Department of
Health standards. If attendance is estimated at more
than 3,000, sanitary units shall be provided at a ratio
of one unit per 200 people.
5) TIie applicant shall obtain any electrical permits
and/or inspections required by the Carlsbad Building
and Housing Code prior to the installation of any
electrical facilities.
6) The applicant shall reimburse the City for actual costs
of city services, including police and fire services,
upon written notice from the City Manager.
7) All lighting shall be designed and located to prevent
adverse impacts to any surrounding property or public
roadways.
8) All refuse shall be removed from the site after each
performance. In additon, the site shall be returned
to its preexising condition after the last performance.
