Subject: Request for legal opinion regarding new use at South Coast Asphalt
The South Coast Asphalt Plant is an M Zone and approved through Conditional Use Permit No. 9. The General Plan calls for residential in the area with special treatment overlay.
The . parent company of South Coast Asphalt wishes to build an office and truck yard for another subsidiary company at the site of South Coast Asphalt. The new business would be allowed by right in the M Zone. They could either build a new building or enlarge the existing office building. Their questions are: 1) does CUP-9 need to be amended to allow this new uSe on the site, even though the new use is permitted by right? 2) if they decide to have the new use on a separate lot, will lot splitting require General Plan consistency? The M Zone has no minimum lot size.
If it is feasible, the new development will be served by
septic system.
