AGENDA OF: September 3, 2008 Application complete date: June 12, 2008 Project Planner: Dan Halverson Project Engineer: Jeremy Riddle SUBJECT: CUP 90-13x3 - CARLSBAD HIRING CENTER - Request for a retroactive five-year extension of Conditional Use Permit (CUP 90-13x3) to allow the continued operation of the Carlsbad Hiring Center on property generally located on the west side of Orion Street between Faraday Avenue and El Camino Real in Local Facilities Management Zone 5. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 6456 APPROVING a retroactive five year extension of CUP 90-13x3 based upon the findings and subject to the conditions contained therein. II.INTRODUCTION This proposed retroactive five year extension of CUP 90-13x3 will allow the continued operation of the Carlsbad Hiring Center on property generally located on the west side of Orion Street between Faraday Avenue and El Camino Real for a five (5) year period from July 15, 2008 through July 15,2013. III. PROJECT DESCRIPTION AND BACKGROUND On February 21, 1991, the Planning Commission approved CUP 90-13 for two years to allow a Hiring Center that would provide a centralized location for those seeking temporary employment in the City of Carlsbad. On March 2, 1994, the Planning Commission approved CUP 90-13x1 to allow the Carlsbad Hiring Center to continue operations for a five-year period through February 21, 1998. On July 16, 2003 the Planning Commission retroactively approved CUP 90-13x2 to extend the operation of the Hiring Center from February 21, 1998 to July 15, 2008. The applicant, the City of Carlsbad, applied for an extension of the CUP prior to the expiration date of July 15, 2008. Staff has reviewed the project site and the files for the Hiring Center and has determined that there are no issues and therefore is recommending approval of an additional five year CUP extension. IV. ANALYSIS A. The Carlsbad Hiring Center continues to be consistent with all applicable plans, policies and regulations described below: 1.Carlsbad General Plan; CUP 90-13x3 - CARLSBAD HIRING CENTER September 3, 2008 Page 2 2. Title 21 of the Carlsbad Municipal Code; and 3. Local Facilities Management Plan for Zone 5. B. The adopted project findings for CUP 90-13x2 which are contained in Planning Commission Resolution No. 3190 and referred to in Planning Commission Resolution No. 5439 still apply to this project (CUP 90-13x3) with the exception of Finding No. 4 of Planning Commission Resolution No. 3190 which is superseded by Finding No. 2 in Planning Commission Resolution No. 6456. C. The adopted project conditions for CUP 90-13x2, which are contained in Planning Commission Resolution No. 5439 (CUP 90-13x2) still apply to this project (CUP 90- 13x3) with the exception of Condition No. 4 which is replaced by Condition No. 4 in Planning Commission Resolution No. 6456 to extend CUP 90-13x3 for 5 years from July 15, 2008 through July 15, 2013. D. No formal written complaints regarding CUP 90-13x2 have been submitted to the City. E. Annual reviews have been conducted for CUP 90-13x2 and the project is in compliance with all conditions of approval. V. ENVIRONMENTAL REVIEW The Planning Director has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the State CEQA Guidelines and will not have any adverse significant impact on the environment. Planning Commission Resolution No. 3190, dated February 21, 1991 SITEMAP NOT TO SCALE Carlsbad Hiring Center CUP 90-13x3 CARLSBAD HIRING CENTER REPORT SUMMARY Background: • Opened July 15, 1991 • Operating for almost 17 years • Works with La Posada de Guadalupe (Catholic Charities) Facts: • A total of 1,407 placements made for 2007 • Average wage was $9.92 per hour • Average number of placements made per month was 117 • Total number of placements made since 1991 is approximately 42,456 • More than 90% of placements are for 1 day jobs Employers: • 247 new employers registered • Most new employers are homeowners looking for day-laborers • Most come from Carlsbad but a some from surrounding communities • Over the duration of the Hiring Center placements have been made in California Counties and throughout the US Employees: • Most of the employees utilizing the Hiring Center services are from Mexico (approx. 76%), a small percentage from other South American Countries (approx. 5%), and the rest were from the US (approx. 19%) • Sixty-three percent (63%) of the workers registered at the Hiring Center own a personal vehicle, 32% ride the bus or public transportation, and less then 5% walk, bike, or car pool to the center.' • During the reporting period 22% of the workers registered live in Carlsbad, 39% Oceanside, 5% Encinitas, and 34% from other surrounding areas.
