Subject: Amendment to Conditional Use Permit No. 9 - South Coast Asphalt
to allow the use of a trailer as a temporary office for Brown
Trucking, located on the south side of Haymar Drive, west of
College Boulevard.
Gentlemen :
The Planning Department is currently processing a conditional use permit
to allow the use of a trailer as a temporary office at the above described
location. While processing this application .we have discovered that there
are several problems involved.
First, it appears that you have applied for a separate conditional use
permit to allow use of the trailer as a temporary office building. In
researching our records, we have discovered that there is currently a
conditional dse permit issued that covers the entire South Coast Asphalt
property including the portion occupied by Brown Trucking. There is nothing
in our records that indicates that there has ever been a parcel map filed
which would separate the property leased by Brown Trucking from the rest
of the operation of South Coast Asphalt, therefore, in my opinion the prop-
erty occupied by Brown Trucking is under the conditional use permit issued
to South Coast Asphalt. The proper application then would be to amend
conditional use permit no. 9 rather than to apply for a new conditional use
permit. Or, to submit a parcel map which would delineate and separate the
property leased by Brown Trucking from South Coast Asphalt, and then apply
for a separate conditional use permit.
Second, Section 21.42.010 of the Carlsbad Municipal Code allows the temporary
use of trailers or mobile homes for commercial offices under the following
condition: "The occupancy shall not exceed one year after the issuance of
the pentiit, unless otherwise extended by the Planning Commission. The
conditional use permit shall not be extended unless construction of the
structure intended for occupancy by the applicant has begun and reasonable
proyress towards completion is being made. The method of placement of t.hc
trailer, the landscaping, and other design aspects shall be approved as part
of the conditional use permit.

Third, Planning Commission Resolution No. 1429 stipulated as a condition of
approval for an amendment to conditional use permit no. 9 issued to South
Coast Asphalt that the mobile unit existing at the intersection of Haymar
and the driveway shall be removed prior to use of another trailer as a lunch-
room. This condition has not been met.
Fourth, on site inspection by staff shows that there is illegal outdoor
storage of rubbish and scrap metal at the site used by Brown Trucking. There
is surface storage of fuel and no lavoratory facilities on the site.
I. feel these items need to be addressed in the amendment to the conditional
use permit no. 9 issued to South Coast Asphalt. Also, staff will recommend
that conditions of approval include a ridqedly enforced schedule of events that
will include the submission of plans, issuance of building permits and beginning
of construction for the permanent office building for Brown Trucking.

screening outdoor storage, provisions €or lavoratory facilities and strict
compliance with all aspects of the Carlsbad Zoning Code.

need to be resolved before we can process this application further. I suggest .
that we hold a meeting with the representatives of Brown Trucking, South Coast
Asphalt and the City at the Planning Department, City Hall on April 5, 1978,
at 11:OO A.M. If the time is not convenient to you, please contact the under-
signed.
