owners and occupants within a 300 foot radius of subjec.t property

Small family day care must be considered a residential
use of property. Thus, it is permitted in all zones in
which a residence is permitted. Furthermore, a local
government cannot impose any regulations on small family
day care homes which are in addition to, or conflict with,
those in State law.
Large family day care cannot be prohibited in any
single family residential zone.
However, State law allows a city/county to choose
between one of three approaches for regulating large family
day care homes located in residential areas of the city.
The three choices are:
1. Make them a permitted use;
2. Establish statutory "standards in four areas and
grant a permit to all providers who meet those
standards;
3. Require a modified conditional use permit
process which uses 100 square foot notice,
allows no hearing unless one is requested, and
imposes reasonable statutory standards which
regulate only four specific areas.
The only four areas open to local regulation under

either permit options (2) or (3) are: ~oise, traffic,
parking and spacing and concentration. All regulations
must be reasonable. Noise regulations must be consistent
with any general noise ordinance and take into
