Pam Drew, Associate Planner FILE COPY Ccicyof Carlsbad Via ~·.(If Dave de Cordova, Principal Planner Re: 'Q(IY EA 14-02-EL CAMINO REAL AT CANNON ROAD INTERSECTION IMPROVEMENTS Thank you for submitting an Early Assessment to widen the El Camino Real (ECR) bridge, at the intersection of Cannon Road, on the west and east sides to construct: 1) an additional northbound through lane; 2) a sidewalk on the east side of the bridge to complete the missing section of sidewalk; and 3) widen the sidewalk on the west side of the bridge for improved pedestrian access (alternative). In response to your application, the Planning Division has prepared this comment letter. Please note that the purpose of an Early Assessment is to provide you with direction and comments on the overall concept of your project. This Early Assessment does not represent an in-depth analysis of your project. It is intended to give you feedback on critical issues based upon the information provided in your submittal. This review is based upon the plans, policies, and standards in effect as of the date of this review. Please be aware that at the time of a formal application submittal, new plans, policies, and standards may be in effect and additional issues of concern may be raised through a more specific and detailed review. Planning: General 1. Although you stated during our site visit that you probably will include widening the sidewalk on the west side of the bridge, planning staff encourages the sidewalk widening to be included in this project to improve pedestrian· mobility and to increase the pedestrian experience through this area. 2. The proposed project is located within the city's El Camino Real Scenic Corridor Overlay Zone. To improve the scenic character at this intersection, and to off-set additional impervious area created by the widening project, please include in the project a pervious pedestrian path and landscaping at the southwest corner of the intersection to match the pathway and landscape along Cannon Road east ofthe intersection. The project is .located within the Mello II Segment of the Local Coastal Program and will require a CDP issued by the city. In addition, the project is within the California Coastal Commission appeal jurisdiction since the project is within 100 feet of a wetland. Since the project is proposed within Agua Hedionda Creek, which is within the 100-year floodplain, the project will also require a Special Use Permit {SUP) -floodplain for any construction or development within the flood hazard area. The project is also proposed on El Camino Real, which will require a Scenic Corridor Special Use Permit-for development within the El Camino Real Scenic Corridor Overlay Zone. Furthermore, if the project proposes any direct or indirect impacts to natural habitat, including any permanent impacts to riparian habitat, the project may need a Habitat Management Plan {HMP) permit. 4. The proposed project is near a Hardline Conservation Area that borders the downstream site of the Cannon Road bridge, as depicted in the City of Carlsbad's Habitat Management Plan {HMP), dated November, 2004. Please review and comply with the adjacency standards listed in HMP Section F {3), which addresses development on sites that are adjacent to wildlife preserves, and are intended to prevent negative effects on wildlife preserves. 5. No trimming of vegetation shall occur between February 15 and September 15 during the bird breeding season, unless a qualified biologist conducts a focused survey for bird nests not more than 72 hours prior to commencement of vegetation trimming activities. If active nests are found, the city's contractor shall cease vegetation trimming activities with in 500-foot buffer zone around the nest site, as determined by a qualified biologist, until juveniles have fledged and the nesting cycle is complete. Furthermore, no activities which would result in noise levels exceeding 60 dBA hourly Leq within this 500-foot buffer shall be allowed during the bird breeding season. 6. Environmental review for compliance with the California Environmental Quality Act {CEQA) will need to be performed prior to construction. Based on the location of the project adjacent to wetlands, and within the Agua Hedionda Creek, a Biological Resources Technical Report {BTR) and a Jurisdictional Waters/Streambed Delineation Report will need to be prepared for the project. Please review the Guidelines for Biological Studies available on the city's website. Please submit the BTR and Jurisdictional Waters/Streambed Delineation Report with the submittal of a CDP and SUP application. 7. All work, including staging, contractor parking and storage areas, shall be located outside of sensitive habitat areas and shall be depicted on the plans. 8. The project may require permits from the CDFW, USACE, and RWQCB, respectively, depending on potential impacts to sensitive habitat and streambed impacts. This determination can be made once a BTR and Jurisdictional Waters/Streambed Delineation Report is submitted for planning staff review. Although the storm water standard questionnaire indicates less than 10,000 square feet of impervious area proposed, please include in the project description what square footage of impervious area (paving, curb, gutter, sidewalk, etc.) is proposed/reconstructed with this project. Please verify the storm water standards that apply to this project. 10. Under the technical study section, consider listing a bridge design study that may be used to determine construction and design methods to widen the existing bridge. 11. In the description proposal consider listing traffic signal modification for ultimate lane configurations, if needed. All necessary application forms and submittal requirements are available at the Planning counter located in the Faraday Building at 1635 Faraday Avenue or online at www.carlsbadca.gov.
