Creek. The storm water from these existing structures currently runs from
the existing headwall outlets to Buena Vista Creek in two open man-made
drainage ditches, causing a certain amount of siltation into the creek
during rains. Enclosure of these ditches will eliminate this siltation.

a fairly even, ground plane. The site will then be generally covered with a
1½' to 2' layer of fill per grading plans approved by the cities of Carlsbad
and Oceanside. This fill will consist of usable materials dredged from
Buena Vista Lagoon by the State Department of Fish & Game (under separate
permit) per an agreement between the property owners and the Department of
Fish & Game. This application also requests consideration of the provision
for the construction of a single-pier bridge structure across Buena Vista
Creek during the implementation phase of the site development.

not required for the proposed work.
Public Hearing . Any person may request, in writing, within the comment period specified in this notice, that
a public hearing be held to consider-this application. Requests for public hearing shall state with
particularity the reasons for holding a public hearing.

Cultural Resources - The latest version of the National Register of Historic P)ce'shas been consulted and
this site is not listed. This review constitutes the extent of cultural resource inVètiations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Endangered Species - Preliminary determinations indicate that the proposed activity will not affect
endangered species, or their critical habitat, designated as endangered or threatened (Endangered Species
Act). Formal consultation under Section 7 (C) of the Act is not required.
Authority. This permit will be issued or denied under the following authorities: o Structures or work in or affecting navigable waters of the United States - Section 10, River and Harbor
Act of 1899 (33 U.S.C. 403).
Discharge of dredged or fill material for purpose of dumping into waters of the United States - Section
404, Clean Water Act (33 U.S.C. 1344).
OTransportation of dredged material for purpose of dumping into ocean waters - Section 103, Marine
Protection, Research and Sanctuaries Act of 1972 (33 U.S.C. 1413).
Evaluation - The dec.sion whether to issue a permit will be based on an evaluation of the probable impact
Including cumulative impacts of the proposed activity on the public interest. That decision will reflect the
national concern for both protection and utilization of important resources; The benefit which reasonably
may be expected to accrue from the proposal must be balanced against its reasonably foreseeable
detriments. All factors which may be relevant to the proposal will be considered including the cumulative
effects thereof; among those are conservation, economics, aesthetics, general environmental concerns,
wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use-
shoreline erosion, and accretion, recreation, water supply and conservation, water quality, energy needs,
safety, food production and, in general, the needs and welfare of the people. In addition, if the proposal
would discharge dredged or fill material, the evaluation of the activity will include application of the EPA
Guidelines (40 CFR 230) as required by Section 404 (b) (1) of the Clean Water Act.

DETAILED DESCRIPTION OF ACTIVITY AND PURPOSE (per applicant):
The project will be conducted in the following manner:
1. A temporary constrwtion closure will be constructed at the Interstate 5
highway bridge to retain as much as possible of the turbid water in the
upper lagoon work area. ,•
2. A haul causeway will be constructed to facilitate recoritouring of present
sediments into one or two permanent islands (one to three acres) for bird
nesting. The causeway may also be used to move material from the lagoon
to the disposal site(s). There may be importation of solid material to
provide a firm base for excavation equipment utilized to build the islands
and haul off spoilmaterial.
3. Sediments will be removed from within the upper lagoon most probably using
a combination of hydraulic dredging and mechanical means. Disposal of
dredged materials will be on the islands and off-site.
The initial phase of the removal stage of the operating will be to over-
excavate a deep water area just downstream from the Jefferson Street
bridge.
Hydraulic dredging, if utilized, will be to an adjacent landowners
parcel. This procedure would necessitate that decanted water, after
desilting operations, be routed back to Buena Vista Creek and hence, into
the upper Buena Vista Lagoon work area.
In the event that the hydraulic dredging cannot be used because of the,
inavailability of an adjacent disposal site, the sediment would be removed
by mechanical means. In this case the sediments would-be pulled from the
• deep restoration areas and placed on the future islands. After the
• dredged material has drained enough to allow for hauling, it would be
removed by truck, utilizing the haulcausewaY, and taken to the disposal
site(s).
14, At the completion of the removal of the sediment, and the formation of the
island(s), for nesting California least terns and other shorebirds, the
• haul causeway will be removed. Additionally, the last step in the project
will by the. removal of the temporary construction closure at the Interstate
5 highway bridge.
• 5. As much as possible, the proposed work will be conducted (September,
•
October and November) after the spring wildlife nesting season and prior
to the winter rainy period.
This project is the repair and restoration of upper Bu,ena Vista. Lagoon for
Fish and Wildlife. -
