These laws require permits authorizing activities in or affecting navigable waters of the United States, the discharge of dredged or fill material into waters of the United States, and the transportation of dredged material for the purpose of dumping it into ocean waters. Information provided on this form will be used in evaluating the application for a permit. Information in this application is made a matter of public record through issuance of a public notice. Disclosure of the information requested is voluntary; however, the data requested are necessary in order to communicate with the applicant and to evaluate the permit application. ACTIVITY Batiquitos Lagoon is a surface water impoundment that functions as a tidal estuary for part of the year and as a brackish water lake for most.of the year. The lagoon mouth is blocked by a semipermeable cobble barrier that severely limits water flow in and out of the lagoon. To support management of water level in Batiquitos Lagoon, 10 eight-inch diameter PVC pipes will be installed beneath the berm at the mouth of the lagoon. Plans are in Section 3.0 of the attached environmental assessment. Plastic (PVC) pipe will be used for ease of installation and removal. This will reduce the need for heavy equipment on the beach. Flap gates will be installed on the ocean end of the pipes to prevent backflow during high tides: The upstream ends of the pipes will be fitted with removable caps. Sandbag cutoff walls will be used to stabilize the pipes and to prevent erosion of thp cobbles in the pipe bed. 4b. PUS urpose of this proposed lagoon water level management program is to provide an interim method for regulating lagoon water levels based on a strategy that preserves and enhances sensitive biological resources while safeguarding public infrastructure. The objective of the interim water level management project is to enhance water quality in the lagoon, to maintain water levels that conserve sensitive biological resources and safeguard public infrastructure. Specifically, the project will assure that: • The lagoon is open to the ocean and the effects of tidal flushing at least once Per year. • Least tern and snowy plover nesting habitat is exposed and above water no later than 15 April of each year. • Water levels in the Lagoon remain 12-24 inches below the level that floods La Costa Ave. infrastructure; • Tidal mudflats and shallow water habitat shall be available to support the shore bird populations. • Adequate intermediate and deep water habitat for the dabbling and plunge dive feeding birds in the lagoon. 4c. DISCHARGE OF DREDGED OR FILL MATERIAL The project requires no dredging or filling. Essentially the existing cobble berm will be temporarily reconfigured to allow installation of the drain pipes. After the pipes are installed the berm will be returned to its original condition. Pipes installation will require a two days period. After installation, no equipment other than the pipes will remain on the berm. Approximately 6-12" of the pipe will be exposed on the ocean side of the berm. The maximum discharge rate for the pipe system will be 2.14 Mft/day assuming five feet of head. At this rate it will require 9.2 days to lower the lagoon one foot. It is my understanding that if the interested parties (Hillman Properties, Inc., and the Batiquitos Lagoon Foundation) still wish to pursue the project they will conduct the necessary biological and environmental studies that would support the proposal. As I noted before, the City would only pursue the project if the wildlife agencies support this short term water level management plan. The City as well as the other MOA agencies strongly believe tha the only viable long term restoration and enhancement plan for the lagoon is Mitigated Alternative "B" which now has the support of the Coastal Commission ,the Army Corps of Engineers and the Environmental Protection Agency.
