Executive Summary A Phase I Environmental Site Assessment (ESA) was conducted for a property located at 6697 Black Rail Road in Carlsbad, California. The assessors parcel number (APN) for the property is 215-040-03. The subject property is approximately 19 acres and is partially used for agricultural purposes. Structures on the property include a residence, a maintenance building, and a small shack. This Phase I ESA has been prepared for Taylor Woodrow Homes who plans to develop the property for residential use. The findings of this investigation are based upon a review of historical aerial photos, historical topographic maps, a radius search performed by Environmental Data Resources, Inc. (EDR), an interview with the current owner, and a site reconnaissance. Information gathered for this report indicated the following: • The subject property was undeveloped until the mid-to late-1950s or early-1960s when it was cleared and possibly used for agriculture purposes (the 1963 aerial photograph shows a portion of the site as graded land, possibly used as a field). The current owner stated that the site was vacant when they purchased it in 1973. • The subject property is currently used for agricultural purposes. In 1973 when the current owners bought the site, they grew potted plants and ground cover. In 1980 they began to grow palm trees and phased out the potted plants and ground cover. • Currently two pounds per month of a fungicide, weedkiller, and oil spray are used for the potted palm trees. More pesticides were used in the past for the potted plants and ground cover, but the amounts were not recorded. The owner stated they did not use DDT on the site. • One 500 gallon aboveground diesel tank has been used for approximately 1 0 years on the subject property. Two previous 500 gallon aboveground diesel tanks were used from approximately 1973 until approximately 1995, when they were removed from the site. These two tanks were located in the same area as the current tank. No staining was observed near the current tank. • Based on a review of data for two adjacent properties and based on the slope of the site and surrounding areas, there is potential for the adjacent properties to the east and north to have affected conditions at the subject property. The adjacent properties previously used pesticides and elevated concentrations of chlorinated pesticides were detected in the soil on the adjacent properties. As the surrounding area slopes toward the subject property, it is possible that the runoff from the adjacent sites would have entered the subject site. Phase I Environmental Site Assessment Muroya Growers Carlsbad, California 1 5089-I DUDEK 4/14/2006 ---- • -• -.. -----.. ---• -• --- • -• .. .. ----- Based on the findings that pesticides were used on the subject property and because the subject property receives storm water runoff from the adjacent properties which also used pesticides, Dudek recommends collecting and analyzing surface soil samples from the subject property for the presence of chlorinated pesticides. Additionally, subsurface soil samples should be collected from the aboveground tank area and analyzed for diesel range total petroleum hydrocarbons. 2. Introduction This Phase I Environmental Site Assessment was performed according to the guidelines stipulated in the American Society for Testing and Materials Standard E 1527-05, "Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process". The subject property is at 6697 Black Rail Road in Carlsbad, California. The property is used partially for an agricultural nursery. 2.1. Assessment Procedure and Scope of Investigation Phase I Environmental Site Assessments assist in identifying past and present land use, including identification of possible on-site releases or disposal of manufacturing or other wastes if such information is contained within regulatory reports, files, and/or is currently visible on-site. The assessment reviews Local, County, State, and U.S. Environmental Protection Agency lists of known or potentially hazardous waste sites, landfills, and sites currently under investigation for environmental violations that may be of concern to this site . The scope of the environmental investigation consisted of: 1) a site reconnaissance; 2) a computerized database search of regulatory agency records; 3) a review of historical aerial photographs and topographic maps; 4) a review of available Sanborn fire insurance maps and City Directory listings; 5) an interview with the site owner; and 7) the preparation of this Phase I Environmental Site Assessment Report detailing the findings of the investigation . These activities were conducted in order to identify recognized environmental conditions. The term recognized environmental conditions means the presence or likely presence of any hazardous substances or petroleum products on the property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into the ground, groundwater, or surface water on the property . The term recognized environmental condition is not intended to include de minimus conditions. De minimus conditions are conditions that generally do Phase I Environmental Site Assessment Muroya Growers 5089-l DUDEK Carlsbad, California 2 4/l4/2006 ---------------.. ---- ---------.. ------ 2.2 not present a material risk of harm to public health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies. Qualifications of Environmental Professionals This Phase I ESA has been prepared by and under the supervision of environmental professionals. The Phase I ESA was written by and conducted under the supervision of Nicole Peacock, a Professional Engineer with over six years of relevant experience. The site reconnaissance and interviews were conducted by Glenna McMahon, an environmental engineer with more than six years of relevant experience. We declare that, to the best of our professional knowledge and belief, we meet the definition of Environmental professionals as defined in Section 312.10 of 40 CFR 312. We have the specific qualifications based on education, training, and experience to assess a property of the nature, history, and setting of the subject property. We have developed and performed the all appropriate inquires in conformance with the standards and practices set forth in 40 CFR Part 3.12. 3. Site Location The subject property is an approximately 19 acre parcel located west of Black Rail Road in Carlsbad, California (Figure 1). The address for the nursery, which occupies approximately half of the subject property, is 6697 Black Rail Road in Carlsbad, California. The APN for the subject property is 215-040-03. The subject property is bordered by mostly residential neighborhoods and some agricultural developments. The subject property is the proposed site for a residential development. 4. Environmental Setting General topographic information for the subject property and the surrounding area was obtained from a review of a United States Geological Survey (USGS) topographic maps for the site, from the EDR report (Appendix A), and from the site visit. The site generally slopes from the north to the south and from east to west. The northeastern and eastern portions of the site are relatively flat, while drainages with topographic depressions are located in the southwest portion of the property. The elevation of the subject property is approximately 300 feet above mean sea level. The subject property is located north of Batiquitos Lagoon. No surface water was observed on the subject property during the site reconnaissance. Phase I Environmental Site Assessment Muroya Growers Carlsbad, California 3 5089-1 DUDEK 4/14/2006 ----- --- ----- -- -- • --------- ---.. -- No subsurface geologic investigations were performed as part of the Phase I ESA. According to the EDR Report, the soils in the vicinity of the site consist mostly ofloamy coarse sand (Appendix A). No water wells were mapped by EDR within one mile of the subject property. Based on a site investigation performed on the site to the north of the subject property, the depth to groundwater in the vicinity of the site is 46 feet below ground surface (See Section 1 0.4). 5. Interview On April7, 2006 Dudek interviewed Mrs. Toshiko Muroya ofMuroya Growers. Mrs. Muroya and her husband have owned the property at 6697 Black Rail Road in Carlsbad since 1973. Initially, the Muroyas grew potted plants and ground cover. Around 1980 the Muroyas started growing palm trees at the nursery. Eventually the potted plants and ground cover were phased out. Currently they continue to grow palm trees. Mrs. Muroya said that everything they have grown at the nursery has been potted or containerized. There are no surface water bodies on the site. Mrs. Muroya stated that surface drainage is directed to the canyon, which is located in the central and southwestern part of the property. There are three structures on the property - a house, a maintenance building, and a small shack. The house is located on 2 acres in the southeastern comer of the property. It was built in 1978. The house is approximately 2800 square feet. It is connected to City water and sewer. The maintenance building is northeast of the center of the site. It is approximately 1000 square feet and was built in 1976. Mrs. Muroya said that the maintenance building is used for storage of equipment, chemicals, fertilizers and pesticides. Part of the maintenance building is used by the workers as a rest area. The small shack is located near the northern entrance of the site. Mrs. Muroya said that it was brought over from Encinitas, where they used it at a farmer's market. Mrs. Muroya said that there is a septic tank and cesspool on the site just south of the maintenance building. There is currently one 500-gallon aboveground diesel tank on the property. It is located south of the maintenance building. Mrs. Muroya thinks that it has been there for about 10 years. She said that there used to be two 500-gallon aboveground diesel tanks on the site. They were in the same location as the current tank and were removed about 10 years ago. Mrs. Muroya said that there was previously on the site a 55-gallon drum that contained oil for maintenance purposes. It was stored in the maintenance building and used about 20 years ago. Currently, 3336 WP (fungicide), Roundup (weed killer) and Clean Crop Spray 415 are used for the palm trees. Approximately two pounds per month of these items are sprayed on the palm trees, which are potted. Mrs. Muroya said that more pesticides were used in the past for the potted plants and ground cover, but she was not sure of the amount. She said that DDT was never used. Mrs. Muroya said that it is emptied once per week. Mrs. Muroya said that there are no wells located on the property. Mrs. Muroya said that they hired a company called Pasco to perform a site survey including a biology survey and a slope analysis. Properties surrounding the subject site were used for agricultural purposes. Mrs. Muroya said that flowers were grown on the properties to the north and east. 6. Site Reconnaissance A site reconnaissance was conducted on April 7, 2006 by Glenna McMahon of Dudek. The site reconnaissance consisted of walking the site, taking notes on what was observed and taking photographs. Photographs are located in Appendix B. A map of the site is presented in Figure 2. The site covers approximately 19 acres and is mostly sloped from the northeast to the southwest. There is a canyon which occupies approximately half of the site. The part of the site not occupied by the canyon is covered mostly by potted palm trees. The younger, smaller palms are located on the northeastern portion of the site. This area appears to have been a covered area in the past, as there was wooden framing still in place (Appendix B, Photograph I). There are three buildings on the subject property: a house in the southeastern comer of the site; a maintenance building/garage on the northeastern part of the site; and a small shack east of the maintenance building (Figure 2). The shack is located near the entrance to the property and is used as an office. The maintenance building in the northeastern part of the property has a garage area, a bathroom and a small apartment used by the workers (which also has a bathroom). The garage has two bays and is used to store fertilizer, chemicals, tools, and other equipment (Appendix B, Photographs 2 and 3). A tractor is also stored in the garage. There was some staining on the concrete where the tractor is stored (Appendix B, Photograph 4). The concrete driveway outside the garage had no evidence of staining (Appendix B, Photograph 5). There were a few 5-gallon buckets labeled PVC primer outside, next to the building. There was a sign on the garage door which indicated hazardous material storage in the form of pesticides, fertilizer and oil. The southern part of the site consists of more plots of palm trees and Mr. and Mrs. Muroya's house (Figure 2). Dudek did not enter the residence. The canyon, which occupies approximately half of the subject property to the southwest, is thick with vegetation (Appendix B, Photograph 6). Dudek walked through the trails in the canyon. Some concrete debris and plastic pots were observed on the slopes of the Phase I Environmental Site Assessment Muroya Growers Carlsbad, California 5 5089-1 DUDEK 4/14/2006 ---.. --- --------- - -----.. ------ --- canyon. The drainage course in the canyon appeared to be dry. There is a road at the southern end of the canyon. It appears to be a maintenance road, used by the city, to service the storm drain inlet. There was a lot of mud/sand on the road due to the recent rainfall (Appendix B, Photograph 7). The subject site is bordered to the north, south, and west by residential developments. The property to the east has notices posted for future residential development. Mrs. Muroya said that all ofthese areas were used for agriculture in the past, specifically for cut flowers. She said the property to the north grew carnations. Just beyond the eastern border of the site there are poles for electrical lines on the shoulder of Black Rail Road. One of the poles has three transformers. No staining was observed on the ground below the transformers. Additionally, there is a transmission line tower on the northwest part of the site (Appendix B, Photograph 8). Wetlands and Natural Waterways Batiquitos Lagoon is located approximately 1.25 miles south of the subject property. Surface Water Discharge Rain water that falls on the majority of the property percolates into the soil or flows over land from the northeast to the southwest and drains into the canyon. A concrete drain which empties into the canyon was observed on the site (Appendix B, Photograph 9). Additionally, two drain pipes were observed near the residence. The drain pipes (a PVC pipe and a corrugated metal drain pipe) empty into the canyon. The northwestern part of the property slopes to the northwest toward a storm drain inlet located just beyond the property border. Distressed Vegetation No distressed vegetation was observed on the subject property during the site reconnaissance. Mrs. Muroya said that she had not observed distressed vegetation other than vegetation intentionally killed using a weed killer, such as Roundup. Indications of Solid Debris Storage A few areas of solid debris were observed on the subject property during the site reconnaissance. There is a dumpster on site that is emptied once per week . Materials, such as pots and potting soil for the trees are stored in the northwest portion of the site (Appendix B, Photographs 10 and 11 ). Dudek observed a small pile of solid waste in this area consisting of plastic pots, wood from wooden pots and palm trees. Additionally, Dudek observed an old metal wagon in the west of the potting soil area. No staining was observed on or around the wagon. Chemical Storage or Use Small containers of various chemicals were located in a storage closet in the maintenance building (Appendix B, Photograph 3). Mrs. Muroya said that they are no longer used and Phase I Environmental Site Assessment Muroya Growers Carlsbad, California 6 5089-1 DUDEK 4/14/2006 -- '------- - --- - - --- ------------- are awaiting disposal. Additionally, bags of fertilizer are stored in the maintenance garage. Unnaturally Discolored Ponds or Flowing Waters No discolored waste was observed on the subject property. Groundwater Wells, Cisterns, Cesspools or Septic Tanks No wells were observed on the subject property. Mrs. Muroya stated that there is a septic tank and cesspool on the property adjacent to the maintenance building, near the dumpster (Figure 2). Abnormal Odor Dudek did not notice any abnormal odors during the site reconnaissance. Soil Disturbances Dudek did not observe any soil disturbances on the subject property during the site reconnaissance. Storage Tanks One aboveground 500-gallon diesel storage tank was observed during the site reconnaissance, south ofthe maintenance building (Appendix B, Photograph 12; Figure 2). Mrs. Muroya said that it is filled twice a year. There was no staining observed on the ground under the diesel tank; however staining was observed on the tank at the dispenser connection. In the northeastern part of the site, Dudek observed an approximately 5.5 foot tall white fiberglass tank (Appendix B, Photograph 13). It appeared to be approximately 500 gallons. Mrs. Muroya said that this tank used to be used for mixing fertilizer. Now the fertilizer is mixed in two 32-gallon trash cans, which are located next to the tank (Appendix B, Photograph 14). 7. Review of Historical Aerial Photographs Historical aerial photographs from EDR were reviewed. The photographs provided background information needed to assess the possibility of historical activities that could indicate environmental concerns. Historical aerial photos were reviewed for the years 1939, 1947, 1953, 1963, 1974, 1990, 1994 and 2002 (Appendix C). The subject property appears to be mostly undeveloped in the 1939 photograph. Two unpaved roads are visible in the northern portion of the subject property. The property to the east of the subject property appears to be graded or developed in some way. The majority of the surrounding area is undeveloped. Phase I Environmental Site AssessmeQt Muroya Growers Carlsbad, California 7 5089-l DUDEK 4114/2006 --------------------------- ---------- The subject property and surrounding area appear similar in the 1947 and 1953 photographs. Some agriculture (appears to be a grove) is visible east of the subject property. In the 1963 photograph, the northern and eastern portions of the subject property have been graded and are similar in appearance to the surrounding properties to the north and east. It appears that the subject property and many surrounding properties have been developed for agricultural use or as a field. Some buildings or greenhouses are visible east of the subject property. Additionally, an aboveground tank is visible north of the subject property. In the 1974 photograph, rows are visible on the portions of the subject property developed for agriculture. The southwest portion of the subject property is still undeveloped. A few more structures are visible in the vicinity of the subject property. The structures include more greenhouses and another aboveground tank. In the 1990 photograph, half of the site is developed for agriculture. Additionally, the majority of the surrounding sites to the north and east are developed for agriculture. Much of the area to the south has been graded. In the 1994 and 2002 photographs, the subject property appears as it did in the 1990 photograph. Houses and the A viara golf course are visible south of the subject property. Between 1994 and 2002, several of the former agricultural areas surrounding the subject property have been redeveloped for residential use. Additionally, a third aboveground tank (water tank) is visible north of the subject property. 8. Review of Historical Topographic Maps Historical topographic maps were obtained from EDR. Historical topographic maps are another historical source that can be used to document the prior use of the property and surrounding area. Topographic maps from 1901, 1947, 1949, 1968, 1975 (revision), and 1997 were reviewed (Appendix D). One building and a few dirt roads are shown in the vicinity of the site in the 1901 map, which has a scale of 1 :62,500. The subject property appears to be undeveloped. On the 1947 map (scale= 1 :50,000), a road leading to a building and a mine is visible just east of the subject property. The type of mine formerly located on the adjacent property is not known. Additionally, the EDR report did not note any mines in the site vicinity. The subject property appears to be undeveloped in the 194 7 map. In the 1949 map (scale= 1 :24,000), the subject property and surrounding area appear undeveloped. In the 1968 map, an electric power line is mapped through the subject property. Greenhouses are located east of the subject property and a water tank is located north of the subject property. In the 1975 photorevision, more greenhouses are mapped north and Phase I Environmental Site Assessment Muroya Growers Carlsbad, California 8 5089-1 DUDEK 4/14/2006 ------------- ---- -- ----- ----- --- east of the subject property. Additionally, a second water tank is located north of the subject property. In the 1997 map, the area to the south and west is largely residential. Large buildings, possibly greenhouses are shown north and east of the subject property. Two buildings are shown on the subject property, near the western and northern property boundaries. A third water tank is mapped north of the subject property. 9. Site History Based on the review of historical sources and based on the interview, the subject property was graded in the mid-to late-1950s or early 1960s. It is not clear if it was used for agricultural purposes at that time. When the current owner purchased the site in 1973, they used it for potted plants and ground cover. In 1980 they started growing palm trees and eventually phased out the potted plants and ground cover. A maintenance building was erected in 1976. The owners built their current residence in the southeast corner of the site in 1978. And, a small shack was moved on to the site many years ago. Historical Sanborn fire insurance maps were requested from EDR. Sanborn maps provide information regarding the historical uses of the site and surrounding properties; however, Sanborn maps were not available for the subject property (Appendix E). City directory listings were requested from EDR as another source of historical information (Appendix F). The city directory listings do not provide any information for the subject property. Surrounding properties listed are mostly residences, but also include some flower farms. 10. Public Agency Records Search Review The regulatory database search results present a listing of sites, within an approximately one-mile radius ofthe subject property, which are known to be chemical handlers, hazardous waste generators, or polluters. Information in these listings includes the location of the site relative to the subject property, sources of pollution, and the status of the site. The search performed for this assessment was conducted in March 2006 by EDR. The complete database search report is included in Appendix A. No facilities were mapped within the search radius. Due to inadequate address information, seven facilities were cited but were not mapped. The unmapped sites are discussed in Section 1 0.4. Unmapped Sites Unmapped sites are due to inadequate address information. Seven sites were listed in the EDR report as unmapped sites. Based on the limited address information supplied, it is possible that one of the sites is located within one mile of the subject property. The site, the Carnation/Spectrum Property Site on Black Rail Road was listed in the LUST database due to a leaking diesel tank that impacted soil only. Total petroleum hydrocarbon (TPH) concentrations in soil were as high as 27 parts per million (ppm). No detectable concentrations ofTPH or benzene were reported in a water sample collected from a deep boring on the site. The depth to water at this site was reported to be 46 feet below ground surface. This case was closed in 1999. This site was also listed in Geotracker due to a voluntary investigation and cleanup with County oversight. Based on the closure letter of June 2003, the site and an adjacent site called Hadley/Spectrum Property were sampled for pesticides. The two properties were agricultural nursery facilities proposed for redevelopment as a residential development. Twenty-five samples were collected from one site and twenty from the adjacent site across Black Rail Road. DDT concentrations were as high as 0.99 and 1.66 ppm on the two sites. Additionally, toxaphene, endosulfan, and dieldrin were detected in the soil. Concentrations of some of the pesticides exceeded the EPA preliminary remediation goals for the residential scenario. At both sites, the upper one foot of soil was removed from the site and placed at least five feet below ground surface under the streets Corte Orchildia and Sito Cedrela. These two streets are located north of the subject property. Verification samples were collected from the areas of soil removal. Closure reports for the two sites are presented in Appendix G. Although an address was not provided for these two sites, it appears that the s-i1es were the two residential developments located just north and northeast of the subject property. The pesticide investigation of the former agricultural nurseries may provide some insight into potential pesticide contamination at the subject property. 11. Evaluation of Potential Hazards and Environmental Concerns Dudek obtained information regarding the following potential sources of hazards and hazardous material releases from the site reconnaissance, the EDR report, and the interview. Agricultural Use Based on the aerial photographs reviewed, the site has been used for agriculture or as a field since at least 1963. According to Mrs. Muroya, the property was vacant when they bought it in 1973. Based on the aerial photographs reviewed, the southwestern half of the site has not been developed and only the northern and western portions of the site were used for agriculture. Off-site sources Based on the results ofthe database search by EDR it is unlikely that off-site sources have impacted the environmental conditions at the subject property. However, it is possible that runoff from the former agricultural sites to the north and east may have run across the subject site, toward the canyon, thus having an impact on the subject site. Residential Use Based on the interview and site reconnaissance, a residence and maintenance building are present on the subject property. The residence was built in 1978 and the maintenance building was built in 1976. Based on the age of these buildings, there is a potential for asbestos and lead-containing materials on the structures. Prior to demolition of the buildings, an asbestos and lead paint survey should be conducted by a certified assessor. PCB Items There are three pole-mounted transformers outside the eastern border of the site. No staining was observed on the ground under the transformers. Fill Material Mrs. Muroya stated that fill has not been brought in since they owned the property. Potting soil for the palm trees is brought in on a regular basis. It is purchased from Hanson. Debris There were a few piles of solid waste debris observed on the site. The debris included pots, plants, wood, and concrete. Tanks One aboveground 500-gallon diesel storage tank was observed during the site reconnaissance, south of the maintenance building. This tank replaced two former aboveground diesel tanks formerly located in the same area. Those two tanks were removed approximately 10 years ago. There is a septic tank located adjacent to the maintenance building. There are two bathrooms in the maintenance building which are connected to the septic tank. The septic tank and cesspool should be properly abandoned. 12. Conclusions and Recommendations Information obtained during the Phase I Environmental Site Assessment indicated that the subject property has been used for agriculture purposes since at least I 973 and possibly as early as the 1960s. In 1980 they started growing palm trees and phased out the potted plants and ground cover. Pesticides were used on the site and surrounding sites. Surrounding sites were mostly used for cut flowers. Sampling results from those sites indicated elevated concentrations of pesticides including DDT, toxaphene, endosulfan, and dieldrin were in the shallow soils. The types of pesticides used on the subject property are not known; however, Mrs. Muroya stated that they did not use DDT. Most of the site and surrounding area is sloped from the northeast to the southwest. Thus, runoff from the site drains to the canyon. Runoff from the former agricultural sites to the north and east may have run across the subject site, toward the canyon. One aboveground 500-gallon diesel storage tank was observed during the site reconnaissance, south of the maintenance building. This tank replaced two former aboveground diesel tanks formerly located in the same area. Those two tanks were removed approximately 10 years ago. No stained soil was observed in this area during the site reconnaissance; however, staining was observed on the tank near the dispenser connection. There are two buildings on the site; a maintenance building and a residence, which were built in 1976 and 1978, respectively. Based on the age ofthese buildings, there is a potential for asbestos and lead-containing materials on the structures. Dudek has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527 of APN 215-040-03, the subject property. Based on these findings, Dudek recommends collecting and analyzing shallow soil samples from the subject property for the presence of chlorinated pesticides. Additionally, Dudek recommends collecting subsurface soil samples near the aboveground diesel tank for analysis for diesel range total petroleum hydrocarbons. Dudek also recommends that an asbestos and lead paint survey be conducted on the maintenance building and residence by a certified assessor prior to demolition. 13. Limitations The findings and conclusions presented in this report are professional opinions based solely upon the indicated data described in this report, visual observations of the site and vicinity and our interpretation of the available historical information and documents reviewed. Site investigation included collection and analysis of twenty five (25) soil samples from 0.5-1.5 feet below grade from the entire area. Site remediation consisted of removal of the upper one foot of the soil where pesticide residue concentrations were detected and placement of this soli within the overexcavated portions of streets named Corte Orchldia and Sltlo Cedrela. The remedial fill materials were placed at least five feet below asphalt grades In these street areas. Subsequently, four verification samples were collected from the exposed portions of the excavated area to ensure low or no residual contamination was left at new home sites. A water sample was collected from a deep boring during the site Investigation. No Impact to groundwater was reported.
