AGENDA OF: May 1, 2013 Project Planner: Shannon Werneke Project Engineer: N/A SUBJECT: GPA 11-05/ZCA 09-03/LCPA 09-02 – CUP CODE AMENDMENTS – A request for a recommendation of approval of a General Plan Amendment, Zone Code Amendment, and Local Coastal Program Amendment to simplify and streamline the development review process for conditional use permits in the nonresidential zones by reassigning the approval authority to the lowest appropriate decision-maker, to amend the text of the General Plan and Zoning Ordinance to provide greater flexibility for a variety of conditional uses in the nonresidential zones, and to amend the Commercial Visitor-Serving Overlay Zone to address minor miscellaneous amendments relating to decision-making authority for conditional uses. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 6960, 6961 and 6962 RECOMMENDING APPROVAL of GPA 11-05, ZCA 09-03, and LCPA 09-02 based on the findings contained therein. II. INTRODUCTION At the April 17, 2013 hearing the Planning Commission continued the agenda item to May 1, 2013 to allow the commissioners sufficient time for discussion and consideration of the CUP Code Amendments project. The public hearing was not opened on the item due to the late hour at which the previous agenda item was finished. III. DISCUSSION At the April 17, 2013 Planning Commission hearing, a letter from Mr. Ted Owen, President of the Carlsbad Chamber of Commerce, was circulated to each of the commissioners. Based on the project’s beneficial impact on businesses interested in locating to Carlsbad, the letter indicated the Chamber of Commerce’s strong support for the project. In addition, Mr. Owen requested that the proposed changes for properties located outside of the coastal zone become effective immediately following approval from City Council. This is being requested not only because it is anticipated that it will take up to 18 months for the California Coastal Commission to act on the project, but also because the vast majority of properties which would benefit from the project are located outside of the coastal zone. While staff understands this issue and the need for the changes to become effective as soon as possible, currently there is only one city-wide Zoning Code which covers properties located inside as well as outside of the coastal zone. Because the proposed CUP amendments affect a number of chapters within the Zoning Code, it would create the need to publish a second Zoning 1 GPA 11-05/ZCA 09-03/LCPA 09-02 – CUP CODE AMENDMENTS May 1, 2013 PAGE 2 Code for properties located outside of the coastal zone. Although this is the direction staff appears to be headed towards with the General Plan update, because the General Plan update process has not been completed, it is staff’s desire to retain one Zoning Code. Not only is it unknown what the format will be for the new Zoning Code, but it is also extremely complex, costly and time-consuming (i.e., could take up to a year) to publish a second Zoning Code. Therefore, staff cannot support the request to separate the proposed amendments for properties located outside of the coastal zone. ATTACHMENT: 1.
