March 30,2001 City of Carlsbad Planning Department 1635 Faraday Avenue Carlsbad, CA 92008 RE: Hillside Development Amendment St. Amour Residence Lot 264 Aviara Drive Carlsbad, California Dear Planning Department Personnel: We are requesting a modification to the Hillside Development Permit for the St. Amour Residence on Lot 264 on Aviara Drive, Carlsbad, California. When the St. Amour's purchased Lot 264, the Hillside Development Requirement was not adopted. We proceeded in designing a residence that required two (2) retaining walls on the northerly property line. The City reviewed the concept and was supportive of the solution. We proceeded with the development of drawings and obtained approval from the Aviara Architectural Design Review Board. During that period of time, the City adopted the Hillside Development Ordinance which impacted this project. This is the only lot on Aviara Drive that is impacted by the Hillside Ordinance. This ordinance severely impacts the development of this lot, reducing the development of the lot by more than 50% compared to all the other lots on Aviara Drive. Since the St. Amour's purchased this lot at full market value when the hillside development was not a factor, they stand to lose their investment into this property. c The building of two (2) retaining walls in the side yard (north side property line) is a good solution as the walls will not be visible to the public and will be lushly landscaped to help soften the terracing effect. Your consideration of our request to amend the Hillside Development Permit would be appreciated.
