Reference: Tavelman Tennis Court Case No HDP 02-06
Dear Mr. Fisher:
Based on the limited information in the Notice of Request for a Hillside Development
Permit and the telephone conversations on 11/4/02 held with yourself and Mr. David
Rick in the city Engineering Department, we have a number of objections and concerns
about the proposed project.
Specifically we object to the following:
I. Grading should not proceed until after the rainy season. During construction of
the Tavelman house by the previous owners approximately 15 years ago, several
cubic yards on loose dirt washed fiom their property on to our lot and onto the lot
immediately north of ours, causing considerable damage to our neighbor’s house,
then under construction.
2. We object to any changes which will reduce the stability of the pad on which the
Tavelman house is built. We reserve the right to have our own experts review the
soil analysis and engineering related data and calculations on the stability of the
Tavelman house pad, any retaining walls and related grading.
3. We object to any grading which will adversely affect the drainage from the
Tavelman lot. To reduce standing water in our own back yard, we have installed
an extensive drainage system, in addition to that required by the city when our
house was built. Even with this, we have had problems when leaks have occurred
in the irrigation system on the Tavelman lot. This has occurred when slow leaks
from their irrigation system flowed down the hill, in the soil under our brow ditch
and into our back yard. We reserve the right to have our own experts review the
proposed drainage plans. If the drainage plans require granting an easement to
empty into our brow ditch, we will take that into consideration although we are
not making any commitments at the present time. Note that pipes from the
Tavelman lot currently empty into our brow ditch in a less than optimal manner.
4. We object to any changes which will adversely affect the aesthetic appearance of
the neighborhood from our lot, including the proposed installation of a 10 foot
fence around the tennis court and the installation of lights on the tennis court.
5. We object to any changes to the landscaping and irrigation which will result in
additional water flow onto our property. We object to any additional irrigation
which cannot easily be turned off by an adult with nominal mechanical ability in
the event of a broken pipe or sprinkler. Within the past two months we have had

such a problem and were told by the Tavelman’s that their gardener would fix it
in five or six days. This months will not be an acceptable answer during the rainy
season when the hillside is already soaked.
6. We object to any discharge of contaminated water, cement slurry, sludge, etc. into
the brow ditch, into the pipes leading to the brow ditch or otherwise onto our
property. Such a discharge of a cubic foot or more of some sort of wallboard like
material occurred about a year ago during the construction of an addition by the
Tavelman’s house.
Until these objections and concerns can be properly addressed, we respectfully request
that the hillside development permit be denied.
