Dear Anne,
As a result of the project assessment letters dated October 10 & 18, 2002, we met with you and
David Rick on October 24 and more recently, December IO, we had a meeting with David Rick, Julia
Coleman and David Hauser. The purpose of these meetings was to resolve several issues related
to the proposed development of this site. The issue which has not been resolved is related to the
proposed development within the limits of the existing slopes which are within the 40% category.
We understand that both the Coastal Development requirements as well as the Hillside
Development Design Standards are applicable to the subject property. However, we believe that the
site deserves special consideration, which would allow encroachment into the current steep slope
areas. Our request for special consideration is based on the following comments.
1) The Report prepared by Larry Taylor of Taylor-Hunter Associates (THA), copy attached, shows
that top of slope has regressed 5 to 9 feet (20' at an isolated location) since 1966.
2) The THA Report also indicates that remedial grading wilt be required for both the proposed
residence and the reinstallation of the storm drainage system which traverses the site. The removal
and recompaction effort is necessary to an estimated depth of 25k feet. The remedial grading side
slopes for the storm drainage pipe alone will extend into developable pad. Consequently, it is
practical to complete the remedial grading for the storm drain and the residential pad during the
same operation.
3) The remedial grading effort for the drainage improvements and building pad will impact the
"natural" slopes and the result will be a 2: 1 manufactured slope face.
4) The basis for the "steep slope" development restrictions stated in the Coastal Regulations and the
Hillside Ordinance are to preserve the natural bluffs that are considered sensitive for appearance as
a natural setting or as a prominent land form feature.
5) The steep slopes on this site have been severety eroded as a result of uncontrolled storm water
runoff and breaks in the public storm drain system. This being the case, the slopes have lost the
characteristic of being natural. In addition, the slopes can not be classified as prominent as they are
not within a public view corridor.

In conclusion, we believe the application of the steep slope restrictions over this site are not
warranted because the subject slopes will be reconfigured as a result of the remedial and
stabilization grading.
In light of the above statements, we request that this site be exempted from the described steep
slope restrictions. We understand that you may not be able to make this determination yourself, so
please present this letter to your supervisor or if needed to the Planning Director.
We appreciate your attention given this matter. We are available for further discussion of this issue.
