SUBJECT: HILLSIDE DEVELOPMENT PERMIT - HDP 89-21
Dear Mr. Bikadi:
The City has completed a review of the application for a Hillside Development
Permit to accommodate the construction of four condominium units.
It is the Planning Director's determination that the project is consistent with
the City's Hillside Development Ordinance, Chapter 21.45 of the Carlsbad
Municipal Code and therefore approves this request based on the following:
Findings:
1. Hillside conditions have been properly identified on the constraints map
which shows existing and proposed conditions and slopes percentages.
2. No undevelopable areas exist on the site, i.e., slopes over 40%, as
identified on the constraints map.
3. All development is designed to minimize grading and utilize the flattest
portions for the site of the residences.
4. The grading design minimizes the disturbance of hillside lands.
5. The project design substantially conforms to the intent of the concepts
illustrated in the Hillside Development Guidelines Manual as follows:
a) The residence pads and driveways are sited on the flattest areas of
the lot.
b) The location and orientation of the residential pads conform to the
shape and topography of the lot.

Conditions:
1. Approval is granted for HDP 89-21 as shown on Exhibit "A" dated May 17,
1989 and Exhibit "A" dated May 17, 1989 on file with CP 89-03.
2. This approval does not excuse compliance with all sections of the Carlsbad
Zoning Ordinance.
3. The conditions of approval for CP 89-03 and MS 799 are hereby incorporated
by reference.
4. Landscape plans designed in accordance with the City of Carlsbad Landscape
Design Manual shall be submitted for approval prior to issuance of building
permits.

Thank you for applying for Land Use Permits in the City of Carlsbad. The
Planning Department has reviewed your Hillside Development Permit/Condo Permit,
application no. HDP 89-21/CP 89-3, as to its completeness for processing.
The application is complete, as submitted. Although the initial processing of
your application may have already begun, the technical acceptance date is
acknowledged by the date of this communication. The City may, in the course of
processing the application, request that you clarify, amplify, correct, or
otherwise supplement the basic information required for the application. In
addition, you should also be aware that various design issues may exist. These
issues must be addressed before this application can be scheduled for a hearing.

PLANNING:
1. Planning will be checking for compliance with the Hillside Development
Ordinance, Chapter 21.95 and the Planned Development Ordinance, Chapter
21.45 in addition to the environmental review.

1. No grading encroachment allowed on the existing storm drain and sewer main
easement.
2. Provide a "preliminary soils/geologic report".
3. Clarify legal description as described on the Preliminary Title Report.
