The City of Carlsbad has conducted an environmental review of the above described
prqject pursuant to the Guidelines for Implementation of the California Environmental
Quality Act and the Environmental Protection Ordinance of the City of Carlsbad. As a
result of said review, a Negative Declaration (declaration that the project will not have a
significant impact on the environment) is hereby issued for the subject project. Justification
for this action is on file in the Planning Department.

ENVIRONMENTAL IMPACTS
STATE CEQA GUIDELINES, Chapter 3, Article 5, section 15063 requires that the
City conduct an Enyironmental Impact Assessment to determine if a project
may haye a significant effect on the enyironment. The Environmental Impact
Assessment appears in the following pages in the form of a checklist. This
checklist identifies any physical, biological and human factors that might
be impacted by the proposed project and provides the City with information
to use as the basis for deciding whether to prepare an Environmental Impact
Report or Negative Declaration.
* A Negative Declaration may be prepared if the City perceives no
substantial evidence that the project or any of its aspects may cause a
significant effect on the environment. On the checklist, "NO" will be
checked to indicate this determination.
* An EIR must be prepared if the City determines that there is substantial
evidence that any aspect of the project may cause a significant effect on
the enyironment. The project may qualify for a Negative Declaration
however, if adverse impacts are mitigated so that environmental effects
can be deemed insignificant. These findings are shown in the checklist
under the headings "YES-sig" and "YES-insig" respectively.
A discussion of potential impacts and the proposed mitigation measures
appears at the end of the form under DISCUSSION OF ENVIRONMENTAL EVALUATION.

DISCUSSION OF ENVIRONMENTAL EVALUATION
This project entails 900 cubic yards of grading on a hillside lot to
accommodate the construction of an additional 3,691 square foot garage and
1,064 square foot guest quarters adjacent to an existing single-family
residence. The topography is relatively steep, containing areas of slope
that exceed 40%. The parcel is surrounded by existing single-family
developments. The proposed addition encroaches into 2:1 manufactured slopes
not higher than 15 feet.
PHYSICAL ENVIRONMENT
Grading to create a building pad will modify the topography of the slope,
however, hillside development architectural standards will be applied to
minimize the impact. In addition, development on the steep portions of the
slope higher than 15 feet will be prohibited.
Drainage and erosion control facilities will be incorporated into the
project by conditions of approval and no unstable earth conditions or unique
geologic features are located on the project site or in the general
vicinity. Development of the project would create impervious surfaces
onsite which reduce absorption rates and increase surface runoff and runoff
velocities, however, drainage facilities will be provided.
Construction of accessory structures to an existing single-family residence
will not contribute to the depletion of fossil fuel and other natural
resources, or increase local and regional air emissions. Residential
development on this site at the appropriate density has been accounted and
planned for in the City's General Plan, as well as the Zone 6 Local
Facilities Management Plan, therefore, the above-mentioned impacts to
physical resources have been anticipated.
The project is an addition to an existing single-family residence on a
previously graded infill lot. There are no significant archaeological/
paleontological/historical sites in the area.
BIOLOGICAL ENVIRONMENT
The small scale size of the area being graded to accommodate development and
isolation of the area created by surrounding single-family residences limits
the biological value of the site. The site is adjacent to existing
development so there is no threat of introducing new species into a natural
area or limiting the movement of native animal species.

HUMAN ENVIRONMENT
Traffic impacts, increase to population, increased public facility demands
and the planned use of the area have all been accounted and planned for in
the City's General Plan and Zone 6 Local Facilities Management Plan. The
project will be required to pay public facility fees that will be used to
adequately mitigate any impacts upon utilities and public facilities.
The proposed project will incrementally increase noise levels in the area
due to traffic and contribute to light and glare in the project vicinity,
however, these impacts are considered insignificant due to the small nature
of the project. The development will be compatible with surrounding land
uses, and the project is required to meet City standards, ordinances, and
policies; therefore, no safety impacts are anticipated.

a) Phased development of the project, b) alternate site designs,
c) alternate scale of development, d) alternate uses for the site,

ANALYSIS OF VIABLE ALTERNATIVES
The small nature of this single-family addition infill project limits any
phased development, nor does it lend itself to alternative site design or
scale of development. The property is zoned for single-family residential
uses and the project conforms to the adopted residential density for the
area; therefore, consideration of alternative uses or sites is not
appropriate in this case. Development of the site at some future time or
the no project alternative is not of benefit and only postpones the site's
inevitable development.

Will the activity involve construction of facilities on a slope of 25% or greater?
Yes. Tha activity will involve a section of an existing man made slope which
ranges from 25% to 40% on the top and bottom of the slope and a minor middle
section of the same slope greater than 40%.
As explained above, the minor area of slope greater than 40% is located between an
upper and lower area of slope less than 40% which can be improved. This
sandwiched area of slope into which we propose to develop, is not visible by any
near or distant neighbor and is located where it will not impact any other
property.
The proposed activity is to remove only the portion of the slope beneath the
building and leave the remainder of the slope intact. The soils report indicates
the soil composition of the slope is laterally stable; minimizing back cutting and
allowing for practically vertical cuts.
The location' of the proposed improvements is such that it will not impact
neighboring views of the site. The improvements are recessed into the hill behind
the existing structure and the perimeter of the site is currently landscaped with
vegetation which will screen the improvements from view.
Although this project is developed over a slope of 25% requiring a hillside
development permit, the design has sensitively and successfully addressed the
issues of hillside develbpment and minimized the affect of the improvements on the
hillside slopes.

Dear Mr. Beery:
The City has completed a review of the application for a Hillside Development for grading
to accommodate accessory structures including garages and a guest house.
It is the Planning Director's determination that the project is consistent with the City's
Hillside Development Ordinance, Chapter 21.95 of the Carlsbad Municipal Code and
therefore APPROVES this request based on the following:
Findings:
1. Hillside conditions have been properly identified on the constraints map which show
existing and proposed conditions and slope percentages.
2. Undevelopable areas of the project, i.e. slopes over 40%, have been properly
identified on the constraints map.
3. All development is designed to minimize grading. As per the Hillside Development
Ordinance, Chapter 21.95.090 (a)(1) and (3), the Planning Director has excluded
from hillside development standards a portion of the subject site. This area includes
1,296 sq. feet of previously graded 2:1 slopes (greater than 40%). The subject
accessory structures are located in this area and comply with Hillside Architectural
and Design Standards.
4. The grading design minimizes disturbance of hillside lands.

5. The project design substantially conforms to the intent of the concepts illustrated
in the Hillside Development Guidelines Manual as follows:
a) Cut slopes are screened from view behind buildings.
b) Accessory structures are concealed from view behind the existing structure
so that visual impact on the surrounding area is eliminated.
