SUBJECT: HDP 96-1O(A) - CADE HILLSIDE DEVELOPMENT
PERMIT AMENDMENT
The City has completed a review of the application for a Hillside Development Permit
Amendment. The approved Hillside Development Permit (HDP 96-10), which was
processed in conjunction with a minor subdivision to create two single family lots,
consisted of grading to accommodate two single family residences on a 3.71 acre
hillside parcel located between Adams Street and the Agua Hedionda Lagoon between
Cove Drive and Highland Avenue. Prior to the issuance of building permits for single
family homes, HDP 96-10 was conditioned to require an amendment to the permit.
The proposed Hillside Development Permit amendment includes a single family
residence on each of the two lots, minor revisions to the previously approved grading
design to create building pads for the two single family homes, and the improvement of
a boat launch ramp on Parcel 2. These proposed revisions have been approved by the
California Coastal Commission through their approval and issuance of Coastal
Development Permit 6-96-1 59.
It is the Planning Director's determination that the project is consistent with the City's
Hillside Development Ordinance, Chapter 21.95 of the Carlsbad Municipal Code, and
therefore APPROVES this request based on the following:
Findinas:
1. All Findings of HDP 96-10 dated January 20, 1997 are incorporated herein by
reference except Finding No. 3 which is modified by Finding No. 2 below.
2. The development proposal is consistent with the intent, purpose, and
requirements of the Hillside Ordinance, Chapter 21.95, in that 1) the grading
design avoids steep slopes (40% and greater); 2 development on 25%
slopes located on the parcel and within the coastal zone (Agua Hedionda
LCP Segment) is limited to that necessary to grade a driveway that would
provide access to the site; 3) manufactured slopes do not exceed 30' in
height; 4) manufactured slopes are contoured to follow the natural
landform; 5) the grading volume of 7,251 cubic yarddacre falls within the
acceptable range; 6) natural drainage patterns are maintained to the
maximum extent feasible and storm drain facilities include energy
dissipators; and 7) the proposed single family structures are oriented

parallel with the hillside contour, the dominate roof slope follows the
dominate slope of the hillside, and exterior textures and colors will blend
with the surrounding natural landscape.
3. The development proposal is consistent with Coastal Development Permit
6-96-159 approved on May 14,1998 and issued on April 6,1999.
4. The Planning Director has determined that the project is exempt from the
requirements of the California Environmental Quality Act ’ (CEQA) per Section
15303 of the state CEQA Guidelines and will not have any adverse significant
impact on the environment.
Plannina Conditions:
1. All conditions of approval of HDP 96-10 dated January 20, 1997 are incorporated
herein by reference except as amended by Condition no. 2.
2. The Planning Director does hereby APPROVE Hillside Development Permit
Amendment, HDP 96-1O(A), for the project entitled “Cade Hillside
Development Permit”. (Exhibit(s) “A - I” dated April 7, 1999, on file in the
Planning Department and incorporated by this reference), subject to the
conditions herein set forth. Staff is authorized and directed to make, or require
the Developer to make, all corrections and modifications to the exhibits or
documents, as necessary to make them internally consistent and in conformity
with the final action on the project. Development shall occur substantially as
shown on the approved Exhibits. Any proposed development substantially
different from this approval, shall require an amendment to this approval.
3. The project shall be subject to and consistent with all conditions imposed
by Coastal Development Permit 6-96-159 approved on May 14, 1998 and
issued on April 6, 1999.
4. The single family structures shall be constructed and maintained using
exterior textures and colors that blend with the surrounding natural
landscape.
5. The private boat launch ramp improvement approved as part of Coastal
Development Permit 6-96-159 shall be for the exclusive and private use of
the owner of Parcel 2 as shown on Exhibit “A”.
Enaineerina Conditions:
NOTE: Unless specifically stated in the condition, all of the conditions of HDP
96-10 are incorporated into the approval of this proposed
amendment.
6. Prior to the ‘issuance of a grading permit the developer shall enter into a
Hold Harmless agreement for all encroachment and for all improvements or

obstructions located within the existing sewer easement and within the
proposed public access easement. Specifically, the boat launch shall be
identified as an encroachment for which the City will be indemnified and
protected from all claims resulting in or caused by the construction, use,
and/or maintenance of the encroachment.
7. Prior to the issuance of a building permit for Parcel 2, the developer shall
apply for and receive approval of a quitclaim or release of access rights to
the proposed 22' wide driveway on Cove Drive. No encroachment of fence,
gate or other appurtenances is hereby approved or permitted by this
application. The developer shall apply for and receive approval of an
encroachment agreement from SDG&E for the proposed boat launch. If the
quitclaim and encroachment agreement cannot be obtained then the
proposed boat launch shall be removed from this permit approval.
8. A right of way permit is required prior to construction of driveway access
onto Cove Dr.
9. The owner of the subject property shall execute an agreement holding the City
harmless regarding drainage across the adjacent property.
IO. The developer shall comply with the City's requirements of the National Pollutant
Discharge Elimination System (NPDES) permit. The developer shall provide
best management practices as referenced in the "California Storm Water Best
Management Practices Handbook" to reduce surface pollutants to an acceptable
level prior to discharge to sensitive areas. Plans for such improvements shall be
approved by the City Engineer. Said plans shall include but not be limited to
notifying prospective owners and tenants of the following:
A. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic
and hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other
such fluids shall not be discharged into any street, public or private, or into
storm drain or storm water conveyance systems. Use and disposal of
pesticides, fungicides, herbicides, insecticides, fertilizers and other such
chemical treatments shall meet Federal, State, County and City
requirements as prescribed in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.
11. NPDES filters shall be installed on the drain systems and shall be located
prior to headwall or drainage outlet on Agua Hedionda Lagoon.
12. Pool and spa drainage shall be dechlorinated prior to drainage into the

lagoon. The dechlorination system shall be shown on the building plans
for the pool or spa. A note to this affect shall be placed on the grading
plans as part of the storm drain design.
