SUBJECT: HDP 96-11 AND 96-12 - SCOTT RESIDENCE AT 7333 AND 7337
ALTIVA PLACE.
The City has completed a review of the applications for Hillside Development Permits
for building single family homes on existing graded lots.
It is the Planning Director’s determination that the project is consistent with the City’s
Hillside Development Ordinance, Chapter 21.95 of the Carlsbad Municipal Code and
therefore $@proves this request based on the following:
Findings:
I. Hillside conditions have been properly identified- on the constraints map which
show existing and proposed conditions and slope percentages.
2. Undevelopable areas of the project, i.e. slopes over 40%, have been properly
identified on the constraints map.
3. The development proposal is consistent with the intent, purpose and
requirements of the Hillside Ordinance, Chapter 21.95.
4. The project design substantially conforms to the intent of the concept illustrated
in the Hillside Development Guidelines Manual.
5. Areas previously disturbed by authorized grading (HDP 89-5) have been fully
identified and are excluded from the requirements of the Hillside Development
Permit per Carlsbad Municipal Code Section.21.95.090.
Conditions:
1. Approval is granted for HDP 96-1 1 and HDP 96-12, as shown on Exhibit(s) A-L,
dated 11-25-96, incorporated by reference and on file in the Planning
Department. Development shall occur substantially as shown on the approved
exhibit(s). Any proposed grading and/or development substantially different from

this approval as determined by the Planning Director, shall require an
amendment to this Hillside Development Permit.
2. Unless specifically stated in the condition, all of the following conditions, upon
the approval of this hillside development permit, must be met prior to issuance of
any building permit.
3. The developer shall pay all current fees and deposits required.
4. Prior to hauling dirt or construction materials to or from any proposed
construction site within this project, the developer shall submit to and receive
approval from the City Engineer for the proposed haul route. The developer
shall comply with all conditions and requirements the City Engineer may impose
with regards to the hauling operation.
5. Plans, specifications and supporting documents for all improvements shall be
prepared to the satisfaction of the City Engineer. The developer shall install, or
agree to install and secure with appropriate security as provided by law,
improvements shown on the hillside development permits (HDPs 96-1 1 and 96-
12), and, improvement drawing 299-2 to City Standards and to the satisfaction of
the City Engineer, in accordance with the following:
a. Concrete Sidewalk;
b. Repair concrete curb and gutter on the west side of the cul-de-sac;
c. Improvements listed above shall be constructed within 18 months of
approval of the secured improvement agreement or such other time as
provided in said agreement.
6. The owner shall grant covenants of easements for private sewer easements as
shown on the hillside development permit.
7. Building permits will not be issued for development of the subject property unless
the Leucadia County Water District, District Engineer determines that sewer
facilities are available.
8. The project is subject to all applicable provisions of local ordinances, including
but not limited to the following; The developer shall exercise special care during
the construction phase of this project to prevent off-site siltation. Planting and
erosion control shall be provided in accordance with the Carlsbad Municipal
Code and the City Engineer.

9. Side yard graded swales shall be provided along property lines so that cross-lot
drainage does not occur.
10. The legal description shall be revised in accordance with the following; The legal
description for HDP 96-1 1 shall be revised to correctly read: ’’ Parcel 1 of Parcel
Map 15678.. .’I and for HDP 96-12 shall be revised to correctly read: “Parcel 2 of
Parcel Map I 5678.. . ’I.
11. Prior to the issuance of the building permit, Developer shall submit to the City a
Notice of Restriction to be filed in the office of the County Recorder, subject to
the satisfaction of the Planning Director, notifying all interested parties and
successors in interest that the City of Carlsbad has issued a Hillside
Development Permit on the real property owned by the Developer. Said Notice
of Restriction shall note the property description, location of the file containing
complete project details and all conditions of approval as well as any conditions
or restrictions specified for inclusion in the Notice of Restriction. The Planning
Director has the authority to execute and record an amendment to the notice
which modifies or terminates said notice upon a showing of good cause by the
Developer or successor in interest.
