SUBJECT: HDP 97-09 - CALABRESE RESIDENCE
Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Hillside Development Permit, application no. HDP 97-09, as
to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is
information which must be submitted to complete your application. This list of items must
be submitted directly to your staff planner by appointment. All list items must be
submitted simultaneously and a copy of this list must be included with your submittals. No
processing of your application can occur until the application is determined to be complete.
The second list is issues of concern to staff. When all required materials are submitted the
City has 30 days to make a determination of completeness. If the application is
determined to be complete, processing for a decision on the application will be initiated. In
addition, please note that you have six months from the date the application was initially
filed, June 30, 1997, to either resubmit the application or submit the required information.
Failure to resubmit the application or to submit the materials necessary to determine your
application complete shall be deemed to constitute withdrawal of the application. If an
application is withdrawn or deemed withdrawn, a new application must be submitted.

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION
NO. HOP 97-09 - CALABRESE RESIDENCE
Planning:
1. Please submit five (5) copies of a slope analysis indicate the acreage and percentage
of slope for the four categories shown in Section 21.95.020 of the Hillside
Ordinance, copy attached. The slope analysis should be the same scale as the site
plan and grading plan. The slope analysis must be stamped and signed by either a
registered land surveyor, civil engineer or landscape architect. This assurance must
indicate the datum, source and scale of topographic data used in the slope analysis,
and must attest to the fact that the slope analysis has been accurately calculated
and identified.
2. Please submit five (5) copies of the slope profiles that conform to the requirements
of section 21.95.020(b) of the Hillside Ordinance. While only three profiles are
needed, two of the profile should be roughly parallel and the other at roughly a 45
degree angle to the other slope profiles and existing contour lines.
ISSUES OF CONCERN
Planning:
1. The proposed retaining walls in the front and side yard exceed the maximum height.
Please relocate these walls outside of the required front and side yard setback
areas.
2. . The existing grade (presumably shown by dashed lines), proposed slope and top of
wall retaining wall elevations along the westerly property line do not match, please
clarify.
3. Based upon site visits, the existing deck appears to have been modified without
benefit of a valid building permit. Please provide the dimensions of the original deck
along with proof that the deck was built with a valid building permit. If no permit
for the original deck can be produced, the maximum downhill height of the deck is
six (6) feet. An open safety railing may extend above the deck surface, but only as
high as needed for safety reasons. A portion of the deck is shown in the side yard
setback. As with the downhill portions, proof of a valid permit for the original deck
would be necessary to allow the replacement deck to encroach into the setback
area.
4. The retaining wall proposed along the Argonauta Street frontage exceeds six feet in
height. As stated in comment no. 3 above, the maximum downhill height of a deck
or wall is six feet. Please pull the retaining wall back to accommodate this height
maximum.

5. The building elevations infer that the exterior retaining wall matches the grade break
in the house, thus requiring no stem walls. The grading plans contradict this
inference, please clarify. Any exposed stem walls would be factored in calculating
the building height.
6. The typical top of slope setback for second story features is 15 feet. The proposed
second story deck appears to be only six feet from the proposed overheight
retaining wall and less than one foot from the existing top of slope. Please adjust
the site or building location to meet the 15 foot typical top of slope setback.
7. The landscaping plans are still under review and comments will follow in' a separate
correspondence.
