Holmiller Planning Director City of Carlsbad, CA 92009 Subject: Response to HDP 97-1 1, Golnick residence, letter, August 1 1, 1977 Attached is revision of grading plan for the above project indicating areas of cut and fill as requested in compliance with F3 Hillside Development Permit requirements. The matter of requiring this project to be reviewed under the Hillside Development formula borders on the ridiculous, since the standards are obviously intended for large scale development and initial review labeled the hillside development consideration “discretionary”. According to webster, discretionary: subject or left to one’s own discretion (freedom of judgment or choice). It appears no planning employe (as is typical in city government and other bureaucracy) will make a reasoned judgment - only follow the adopted rules to the letter. With perhaps 200 yards of earth to be moved involving an area of 2300 sq. ft. (.07 Acre) it is difficult to make a case for preservation of the public’s interest and safety, presumably the intent of the hillside ordinance. It is this kind of mandated procedure that reinforces the public distrust in the governing establishment, government of, by, and for the people indeed! Patently, the rules operate only as a means of taxation when applied to the trivial concerns of this project, not to mention the outrageous delay in the execution of the project. I trust we have answered the triviality of the current request and that these remarks may elicit some element of sense of reason in the proceedings. I urge you to claim discretionary judgment and dispense with the hillside development aspects in this single-lot application. Let this applicant proceed with his project. L copy to Lon Golnick
