This Property Analysis Record (PAR) was prepared by J. Whalen Associates Inc.
(JWA) in conjunction with the Urban Corps of San Diego County and Cummings and
Associates. The estimates in this PAR are based upon the management and
monitoring requirements outlined and required in the Preserve Management Plan for
the Fair Oaks Valley (HDR, 2013).

A-3 Mitigation Site / Project Status
Project Status
The Fair Oaks Valley property is owned by Fair Oaks Valley, LLC, P.O. Box 230638,
Encinitas, CA 92023. The property consists of two adjacent parcels, APN 223-061-01
and APN 223-061-02 (Figure 1, Fair Oaks Valley Property Map). The current project
design proposes 49 residential units and a storm water retention pond, permanently
impacting approximately 26.1 acres (32 percent of the property). Approximately 1.9
(2.3 percent) additional acres will be temporarily impacted by the construction of a

pipeline, vegetated swale and graded slopes east of the proposed residential units.
Temporarily impacted areas will be planted with native species seed mix. An existing
dirt road will be converted to a public-use trail in the preserved area. The trail,
temporarily impacted areas, and the remaining approximately 55.1 acres of the
property will be preserved as open space upon completion of the project (Figure 2,
Fair Oaks Valley Maintenance Exhibit). An Irrevocable Offer to Dedicate for a future
right of way to extend Camino Junipero will also be included within the preserved
area until such time as the City decides to permit or eliminate the road from the City’s
Master Plan. The Fair Oaks Valley property is part of the Proposed Hardline
negotiated under the North County Multiple Habitat Conservation Plan, City of
Carlsbad Sub Area Plan and is adjacent to other preserves (Figure 3, Open Space
Vicinity Exhibit). The required mitigation for the proposed development is 13.1 acres
of non-native grassland. The remaining 40.2 acres of undeveloped land is being
included in this open space plan and easement, but is not required for mitigation.
Permitting
The project has received the necessary permitting through the City of Carlsbad. Since
approval of the project by the City, the applicant has communicated and coordinated
with various stakeholders including the California Department of Fish and Wildlife,
U.S. Fish and Wildlife Service and Center for Natural Lands Management. While these
entities do not have jurisdiction over the site the applicant has acted in a good-faith
manner in the planning of the Fair Oaks Valley Preserve.
Onsite Mitigation Site (Preserve) Status
An on-site Preserve Management Plan was completed by HDR in August 2013 for the
on-site open space. The site ranges in elevation from 365’ to 690’ above mean sea
level, with the lowest area in the south central part of the property and the highest
point in the northeastern corner of the property. A drainage runs north to south
through the portion of the property south of the power lines. Along this drainage are
some slopes with east and west aspects. A second drainage runs east to west through
the northwestern corner of the property.
The 55.1 acre proposed open space preserve currently contains non-native
grasslands in the formerly grazed portions of the preserve south of the SDG&E power
transmission lines. The area north of the transmission lines was protected from
grazing and contains Diegan coastal sage scrub (Table 1, Vegetation Communities).
Coastal sage areas immediately adjacent to SDG&E power transmission lines are
more disturbed as a result of the installation and continued maintenance of the
power lines. San Diego Gas & Electric and the Olivenhain Municipal Water District
both have maintenance easements within the preserve area. The preserve area also
includes a dedicated City of Carlsbad trail along the eastern boundary of the preserve
area which leads to trails on the adjacent CNLM preserve lands.

An Irrevocable Offer to Dedicate for a future right of way to extend Camino Junipero
crosses the proposed open space preserve area and will be included within the
preserved area until such a time as the City of Carlsbad decides to permit or eliminate
the road from the City’s master plan. If the City decides to permit the road it will
mitigate and permit the road at that time separate from this project.

this project.

B. Preserve Management and Monitoring Goals
The Preserve Manager will be the Urban Corps of San Diego. The Preserve Biologist
will be Gretchen Cummings with Cummings and Associates. Both the Preserve
Biologist and representatives from Urban Corps have visited the site several times to
assess potential threats.
Invasive species and unauthorized access to the preserve from the existing trail are
the main issues of concern. In order to ensure no unauthorized access and use of the
preserve area occurs the preserve manager will have a monthly presence on the
preserve. Therefore, each visit to the preserve by the preserve biologist or preserve
manager will include budgeting for patrol and enforcement activities. Any
occurrences of unauthorized access to the preserve will be reported to the HOA and
the City of Carlsbad if police presence is required. Contingency funds have been
included in the PAR should human encroachment result in authorized structures or
other unanticipated damage to the preserve.

Patches of invasive species are present in the southeastern portions of the preserve
interspersed with non-native grassland. Invasive species removal will occur during
quarterly visits to ensure these species do not spread throughout the preserve. Any
trash and debris found on the preserve will be removed during these quarterly visits.
Fencing will be installed between the planned residential development of Fair Oaks
Valley and the existing developments to the south and west. These fences along the
manufactured slopes between the development and preserve area will be maintained
by the HOA (Figure 4, Fence Exhibit for Fair Oaks Valley). All signage and sign boards
at the two public access points will be provided by the developer, the homeowners
association or the City of Carlsbad. The Preserve manager may use these sign boards
to post notices and preserve rules as needed to provide information at the public
access points noting that the area is a preserve.
Biological monitoring goals include biannual surveys of the preserve. A general
survey of the non-native grassland and Coastal sage scrub habitat will occur during
these biannual visits, one to be completed in spring and one in fall. During the spring
survey, the preserve biologist will assess the condition of the California Adolphia and
San Diego Goldenstar populations on the preserve. In addition, focused protocol
surveys for California gnatcatcher will completed once every three years in
coordination with the City of Carlsbad and other local preserve managers.
The preserve manager will report the condition of the preserve and management
efforts to the HOA on a quarterly basis. Any serious encroachment into the preserve
will be immediately reported to the HOA and City of Carlsbad police if warranted.
Coordination and collaboration with other Carlsbad preserve managers will occur
during the City of Carlsbad Quarterly Habitat Managers Meeting with additional
interactions on an as needed basis. Annual reports will be produced each year in
October with copies provided to the City of Carlsbad, California Department of Fish
and Wildlife and the United States Fish and Wildlife Service and the HOA.

C. Cost Analysis
The PAR cost analysis for the Fair Oaks Valley Preserve was prepared by J. Whalen
Associates in August of 2013. Exhibit A illustrates the Initial PAR for Years 1-3 and
Exhibit B the Ongoing PAR for Perpetual Management with line items for each task
identified in the Preserve Management Plan.
In perpetuity funding will be provided through a non-wasting endowment or other
mechanism approved to the City and Resource Agencies. In order to fulfill all
conditions the project proponent will deposit an endowment of $ 428,747.76 with the
San Diego Foundation as agreed by the Project Proponent and Preserve Manager. An
additional $53,288.33 will be provided separately to cover costs during Year 1-3 as
calculated in the Initial PAR.
